RDINANCE NO. _~/~ AN ORDINANCE AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND ILLINOIS DEPARTMENT OF TRANSPORTATION RELATIVE TO THE IMPROVEMENT OF WOLF ROAD WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that it would in the best interests of the Village to participate with the State of Illinois to ~mprove that port~on of Wolf Road between Central Road and Euclid Avenue; and WHEREAS, in order to proceed w~th the improvement of Wolf Road it ~s necessary to execute an Agreement between the State of Illinois, Department of Transportation, and the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Village President of the Village of Mount Prospect is hereby authorized to sign and the Clerk authorized to attest her signature on the Agreement between the V~llage of Mount Prospect and the Illinois Department of Transportation relative to the ~mprovement of Wolf Road between Central Road and Euclid Avenue, a copy of said Agreement is attached hereto and hereby made a part hereof as Exhibit "A". Krause ~ Mayor 3075r AGREEMENT this ~i~ and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter calied the STATE, and the VILLAGE OF MOUNT PROSPECT, County of Cook, of the 5tat, of Iiiinois, hereinafter cailed the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of i,~oreving approximately 10,~96 lineal feet of Wolf Road from Rand Road to Euclio Avenue in the City of Des Rlaines and VILLAGE of Mount Prospect, Cook County, Illinois (F.A.U. Route 2692, STATE Section: 35~9R-87, STATE Job No.: P-PI-ii8-87, VILLAGE Section: ) by making the following improvements: A® Wolf Road - from Rand Road to Euclid Avenue: Roadway widening and reconstruction to prowde two 12' through traffic lanes in each direction separated by a t2' median compIete with curb and gutter and new stoz~n sewer system. (New sidewalk will be instailed along the west side of WoIf Road from Centrel Road to Euciid Avenue.) Wolf Road ~ Feehanville Ditch: Removal of existing bridge and replacement with a double box culvert. Roadway widening of Central Road to p~ovide two 12' through traffic lane~ in each direction separated by a 12' left turn lane; and roadway widening of Kensington/Foundry Road to provide one 12' through traffic lanes in each direction separated by a 12' left turn lane. Installation of permanent traffic signals including installation of OPTICOM equxpment at the intersection of Wolf Road ~ Kensington/Foundry Road and modernization of existing traffzc signals at the intersection of Wolf Road Central Road, and by performing all other work necessary to complete the l~revement xn accordance w~th the approved plans and specifications. WHEREAS, the VILLAGE ks desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the pa~ties agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection durzng construction and cause the improvement to be built in accordance with the plans, specificatzons and contract. The STATE agrees to pay all right-of-way, construction and engineering costs, ~uboect to reimbursement by the VILLAGE as hereinafter stipulated. It is mutualiy agreed by and between the partzes hereto that the estimated cost of the improvement is as shown on Page 2A. The VILLAGE agrees to reimburse the STATE for 100% of all eng~neerzng and construction costs associated with the installation of "OPTICOM" equipment at the intersection of Wolf Road 0 Kensington/Foundry Road ($6,~00.00), the installation of new sidewalk between Central Road and Euclid Avenue ($97,~19.00), the relocation of three (3) VILLAGE owned street light poles ($6,0~7.00), and the relocation o~.two (2) VILLAGE owned fire hydrants ($5,750.00). The VILLAGE also agrees to reimburse the STATE for 100% of all costs associated with obtaining two ~emporary easements (~ Sta. 77+00 which is just south of Kensington/Foundry Road and · Sra. 85+00 which is just so. of Kenszngton/Foundry Road) required for the installation of new szdewalk ($~,000.00>. The total cost to the VILLAGE is estimated to be $119,006.00.' The VILLAGE agrees to pass a supplemental resoIut[on to provide necessary funds for its share of the cost of this zmprovement zf the amount approprzated herein proves to be znsufficient to cover said cost. The VILLAGE has adopted and will put into effect prior to the STATE advertising for the work to be performed he~ein, an ordinance requiring that parkzng be prohibited aIong Wolf Road within the limits of this improvement, wzthln the VILLAGE limits, a copy of whzch is attached hereto as Exhibit B and made a pa~t he,eof, and wzi1 in the future prohibit parking at such iocations on or immedzately adjacent to this improvement as may be determined by the STATE to be necessazy from traffic capaczty studies. Przor to the STATE advertsssng for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by representatives from the VILLAGE and the STATE. The VILLAGE has adopted and will put in effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance relatsve to the disposition of encroachments and prohibiting in the future any new encroacgnents within the limits of the improvement, a copy of which is attached as Exhibit D and made a part hereof. The VILLAGE agrees to adopt a resolutzon or send a letter, prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. Where a municipal utility has been installed (1) on right of way acquired by the STATE or (2) within defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality w~ll bear all utility relocation or adjustment costs made necessary by the construction of this improvement. 10. The VILLAGE and the STATE of Illinozs have agreed to a jurisdictional transfer for the portion of highway described in this agreement. A copy of the jurisdictional transfer is attached as Exhibit C, and made a part hereof. Upon completion of the improvement, fznai field inspection by the STATE and notzfication by the District Engineer, the VILLAGE will assume jurisdiction of Wolf Road from the curb return on the north side of the Wolf Road/Central Road Intersection to Euclid Avenue. The VILLAGE has adopted and will put into effect prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance adding that portlon of roadway described above and identified on Exhibit C to its Village system. A copy of said ordinance is attached hereto as "Addendum 2" and made a part hereof. The VILLAGE will also be responsible for maintenance of crosswalk and stopline markings on all affected routes of this improvement within the VILLAGE limits. The STATE will continue to be responsible for the maintenance of median and lane l~ne markings on STATE maintenance routes. ll. The STATE and the VILLAGE on March 3, 1982 (amended April 2, 1986) entered into a Master Agreement covering maintenance and energy responsibilit~es for all szgnalized intersections along STATE highways tn the VILLAGE, Exhibit A which zs attached hereto as Exhibit D. Upon acceptance by the STATE of the traffic signal work included herein, revisions shall be made in the Master Agreement for the intersections of 1) Wolf Road ~ Euclid Avenue, 2) Wolf Road ~ Kensington Foundry Road and ~) Wolf Road ~ Central Road. Attached hereto and made a material part hereof is "Revised Exhibit A" which contains a comprehensive listing of all signals covered by the MASTER AGREEMENT and reflects the changes described hereinabove. A copy of the aforementioned "Revised Exhibit A' is attached hereto as Exhibit E. The STATE agrees to send the VILLAGE an itemzzed invoice every three (3) months for its proportional share of the actual costs for the maintenance of the traffic signals durzng the preceding per~od. Upon receipt of sa~d invozce, the VILLAGE will pay said by certified checl made payable to the Treasurer, State of Illinois, and send it to the Dzstrzct Engineer, Department of Transportation, Oiwsion of Highways, Distrzct One, 201 West Center Court, Schaumburg, Illinois 60196-1096. It is mutually agreed that the financial responsibility for the maintenance of the "OPTICO~' equipment shall be borne entirely by the VILLAGE and said maintenance shall be in accordance with the provisions set forth in the aforementioned Master Agreement. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The STATE retains the right to control the sequence and timing of the traffic signals.
