ORDINANCE NO. 3908 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 322 MARCELLA ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Shirley Williams, has filed an application for variation with respect to property commonly known as 322 Marcella Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 21 in Callero and Catino's St. Emily's Resubdlvlsion in the West 1/2 of the West 1/2 of the Southeast 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian ~n Cook County, Illinois together with that part of the West 50 ft. of the East 366 ft. of Lot 11, in C.A. Goelz' Prospect Gardens a Subdivision of the West 1/2 of the West 1/2 of the Southeast 1/4 together with the East 2/3 of the North 3/4 of the Northeast 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, which lies West of and adjoining said Lot 21 in Callero and Cat~no's St. Emily's Resubdiv~slon and which lies South of the North line of said Lot 21 extended West and which lies North of the South line of said Lot 21 extended West all in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an attached garage encroaching to within fifteen feet (15') of the front property line to be built on the Subject Property, within a zoning district otherwise requiring a thirty foot (30') front yard setback pursuant to Section 14.1102.A of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 2-V-88) before the Zoning Board Appeals of the Village of Mount Prospect on the 28th day of January, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 11th day of January, 1988; and of WHEREAS, the Zoning Board of Appeals has submitted ~ts findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that ~t would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth here~nabove are incorporated here~n as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.A of Article XI of Chapter 14 of the Village Code of Mount Prospect, age 2 ZBA 2-V-88 Illinois, to allow the construction of an attached garage encroaching to within fifteen feet (15') of the front property line instead of thirty feet (30') required by Code, in accordance with Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: The architectural elements of the garage shall closely match that of the house ~ncluding the addition of windows on the South face of the new garage wall. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force.and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins w~thin one (1) year of the passage of th~s Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
