ORDINANCE NO. 3946 AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1427 PARK DRIVE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Charles Stempien, has filed an application for variation with respect to property commonly known as 1427 Park Drive in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 37 in Woodview Manor, of Unit No. 1, being a subdivision in the North 1/2 of the Northeast 1/4 of Section 25, Township 42 North, Range 11, East of the Third Prlnc~pal Meridian in Cook County, Illinois; and WHEREAS, Petitioner seeks variations from Section 21.902.C of Chapter 21 of the Village Code of Mount Prospect, Illinois, to allow the continuation of a swimming pool located in side yard of the Subject Property and a variation from Section 21.902.A to permit the swimming pool to be located five feet (5') from the side lot line and extending beyond the front building l~ne; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 21-V-88) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of April, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of April, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards established, and the Village Board further finds that · t would be in the best interest of the Village to grant the request for variations. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth herelnabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the V~llage of Mount Prospect hereby grant to the Subject Property the variations requested with respect to Section 21.902.C of Article IX and Section 21.902.A Article IX of Chapter 21 of the V~llage Code of Mount Prospect, Illinois, to allow the continuation of a swimming pool on the Subject Property which swimming pool encroaches into the sideyard and extends beyond the building line, as indlcated on the attached site plan attached hereto and hereby made a part hereof as Exhibit "A". The approval granted herein is conditioned upon the fact that no additional structures age 2 of 2 ZBA 21-V-88 such as decking or sheds shall be built without first seeking a variation, if required. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
