ORDINANCE NO. 3902 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 900 TOWER LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Steve Gewartowsk~, has filed an application for variation with respect to property commonly known as 900 Tower Lane in the V~llage of Mount Prospect, Illinols (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 72 of Country Club Terrace a Subdivision of part of Lot 16 and part of Lot 18 ~n the Owner's Subdivision of Section 13, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of a concrete driveway and adjacent patio block walk totaling twenty-four feet and seven inches (24'7") in width, built on the Subject Property, within a zoning d~strict otherwise allowing an eighteen foot (18') wide driveway pursuant to Section 14.116.C of Article I of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 79-V-87) before the Zoning Board of~ Appeals of the Village of Mount Prospect on the 28th day of January, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 11th day of January, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested varlation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested w~th respect to Section 14.116.C of Article I of Chapter 14 of the V~llage Code of Mount Prospect, Illinois, to allow the continuation of the concrete driveway and adjacent patio block walk totaling twenty-four feet seven inches (24'7") ~n width, instead of the permitted eighteen feet (18') w~dth ~n accordance with Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: Except for the variation granted here~n, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. age 2 ZBA 79-V-87 SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication ~n pamphlet form in the manner provided by law.
