ORDINANCE NO..,.~,007 FA AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS .1905 WOOD LANE WHEREAS, Douglas L. and Toshiko F. Emling (hereinafter referred to ss Petitioners) have filed an application for variations from certain provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1905 Woo~ Lane (hereinafter referred to as Subject Property), legally described as: Lot 140 in Woodview Manor Unit #1, s Subdivision in the North 1/2 of the Northeast 1/4 of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, Petitioners seek variations from Section 14.1102.B.2 of Chapter 14 of the Village Code of Mount Prospect to permit an exterior side yard of 10 feet rather than the required 20 feet and an interior side yard (west side) of 5 feet Instead of the required 10 feet; from Section 14.1102.C.3 to allow a 3 foot rear yard instead of the required 15 feet to permit a patio and walkways; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 65-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of October, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of October, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations requested and have determined that the same satisfies the standards set forth tn Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interests Of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: ~: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. ~ The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.B.2 to allow an interior side yard of 5 feet instead of 10 feet as required; a 10 foot exterior side yard instead of the Z0 feet required; a variation from Section 14.1102.C.3 to allow a 3 foot rear yard instead of the required 15 feet. ~ Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. ~ In accordance with the provisions of Section 14.604 of chapter 14 of the Village Code, the variations granted herein BA 65-V-88 Page 2 of 2 shall be null and void unless permits are issues and construction begins within one (1) year from the date of of this Ordinance. passage ~: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
