ORDINANCE NO. 3992 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 1708 VERDE DRIVE WHEREAS, Edward and Christine Bujnowski (hereinafter referred to as Petitioners) have filed an application for variations from certain provisions of Chapter 14 of the village Code of Mount Prospect, Illinois, for property commonly known as 910 south owen street (hereinafter referred to as Sub3ect Property), legally described as: Lot 25 (25) Block Four (4) in Hatlen Heights, Unit No. One, a subdivision in the South Half (1/2) of the Northeast Quarter (1/4) of Sectlon 10, Township 41 North, East of the Third Principal Meridian, according to Plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on August 17, 1955 as Document No. 1614665 and WHEREAS, Petxtloners seek a variation from Section 14.1102.A of Chapter 14 of the Village Code of Mount Prospect to permit an eighteen foot (18') front yard instead of the required thirty feet (30') and from Section 14.1102.B.1 to permit a three foot (3') side yard rather than the ten feet (10') required; and WHEREAS, a public hearing was held on the variations requested being the sub3ect of ZBA Case No. 61-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of September, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of September, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the v~llage of Mount Prospect and the President and Board of Trustees of the V~llage have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Artlcle VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be ~n the best interests of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as flndings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Sub3ect Property a variation from Sectxon 14.1102.A to allow an eighteen foot (18') front yard and from Section 14.1102.B.1 to permit a three foot (3') side yard rather than the required ten feet (10'), which variations will permit the expansion of the driveway for the purpose of parking. SECTION THREE: Except for the variations granted herein, all other appllcable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the subject Property. SECTION FOU~: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted BA 61-V-88 Page 2 of 2 herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of th~s ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after ~ts passage, approval and publicat~on in pamphlet form in the manner provided by law.
