ORDINANCE NO. qqB2 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 910 SOUTH OWEN STREET WHEREAS, Michael A. Maday (hereinafter referred to as Petitioner) has filed an application for variations from certain provisions of Chapter 14 of the village Code of Mount Prospect, Illinois, for property commonly known as 910 South Owen street (hereinafter referred to as Subject Property), legally described as: Lot 25 In Clearbrook Estates, being a subdivision of that part of the West Half of the West Half of the Northeast Quarter of section 13, Township 41 North, East of the Third Principal Meridian, lying North of the centerline of Golf Road as per plat of dedication recorded October 11, 1929 as Document 10494973 according to plast of said Clearbrook Estates registered in the Office of the Registrar of Titles of Cook County, Illinois, on Auust 21, 1958 as Document 1690611; and WHEREAS, the Petitioner seeks variations from section 14.1102.B.1 of Chapter 14 of the village Code of Mount Prospect; and WHEREAS, a public hearing was held on the variations requested being the sub3ect of ZBA Case No. 49-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of July, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of July, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interests of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the subject Property a variation from Section 14.1102.B.1 to allow a patio to be located one foot (1') from the side lot line instead of the required 6-1/2 feet. SECTION THREE: Except for other applicable Village regulations shall remain in Sub]ect Property. the variations granted herein, all of Mount Prospect Ordinances and full force and effect as to the SECTION FOUR: In accordance with the provisions of section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and BA 49-V-88 Page 2 of 2 construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect f~om and after its passage, approval and publication in pamphlet form in the manner provided by law.
