ORDINANCE NO. 3976 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1629 GREENWOOD DRIVE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, MARY C. and CANDIDO VANDINI, have filed an application for variation with respect to property commonly know as 1629 Greenwood Drive in the Village of Mount Prospect, Illinois (hereinafter referred to as the" Subject Property") and WHEREAS, the Sub3ect Property is described as follows: Lot 926 in Brickman Manor first addition - Unit 8, being a subdivision in the east 1/2 of the southeast 1/4 of Section 26, Township 42 North, Range 11 East of the Third Principal Meridan in Cook County Illinois and WHEREAS, Petitioner seeks a variation from Section 14.102.B.4 of Chapter 14 of the Village Code of Mount Prospect, Illinois, which provides for a maximum 120 square foot shed to permit a shed of 196 square feet; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 31-V-88) before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th day of June, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 23rd day of May, 1988; and WHEREAS, the Zoning Board of Appeals has submitted 1ts findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Artlcle VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Sub3ect Property the variation requested with respect to Section 14.12.B.4 of Chapter 14 of the Village Code of Mount Prospect, Illinois, to permit a shed of 196 square feet, instead of the 120 square feet allowed by Ordinance. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Sub3ect Property. age 2 ZBA 31-V-88 SECTION FOUR: In accordance with the provIsions of Section 14.604 th~s variation shall be null and void unless permits are issued and construct~on begins within one (1) year of the passage of this Ordinance. SECTION FIVE: Th~s Ordinance shall be in full force and effect from and after its passage, approval and publlcatlon in pamphlet form in the manner provided by law.
