ORDINANCE NO. 3960 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 601 NORTH WILLE STREET WHEREAS, Richard E. Underwood (hereinafter referred to as Petitioner) has flled an application for a variation from Section 14.102.B.2 of Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 601 North Wllle Street (hereinafter referred to as Sub3ect Property), legally described as follows: Lot 12 in Block 16 in Randvlew Highlands, being a subdivision in the Northwest 1/4 of the Northwest 1/4 and the Northeast 1/4 of the Northwest 1/4 of Section 24, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County Illinois also The West 1/2 of vacated alley east and adjoing above Lot, all in Cook County, Illinois; and WHEREAS, the Petitioner seeks a varlat~on from Section 14.102.B.2 which requires a setback of five feet (5') from the interior s~de lot line; and WHEREAS, a public hearing was held on the variations requested being the sub]ect of ZBA Case No. 28-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of May, 1988,, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of May, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the V~llage have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the V~llage Code and the Board of Trustees further find that it would be in the best interest of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth here~nabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Sub3ect Property a variation from Section 14.102.B.2, as amended by the Petitioner, allow a setback from the ~nterlor side lot line of thirty inches (30") rather than the required five feet (5'). to age 2 of 2 ZBA 28-V-88 SECTION~THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain ~n full force and effect as to the Sub3ect Property. SECTION FOUR: In accordance with the provisions of Section 14.604 the variations being the sub3ect of this Ordinance shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance for any portion of the property.
