ORDINANCE NO. 3959 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 605 SOUTH EDWARD STREET WHEREAS, Robert E. Wyrwicki (hereinafter referred to as Petitioner) has filed an application for a variation from Section 14.102.B.2 of Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 605 South Edward Street (hereinafter referred to as Subject Property), legally described as follows: Lot 86 in Surety's Bonnie Park, a subdivision of Lot 2 in Oehlerking's division of part of Section 12, Township 42 North, Range 11 East of the Third Principal Meridian, according to plat thereof recorded May 11, 1956 as Document No. 1669522 in Cook County, Illinois and WHEREAS, the Petitioner seeks a variation from Section 14.102.B.2 which requires a setback of five feet (5') from the interior side lot line; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 29-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of May, 1988,, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of May, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interest of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Sub3ect Property a variation from Section 14.102.B.2 to allow a setback from the interior side lot line of two feet (2') rather than the required five feet (5'), subject to the following conditions: 1. The driveway being the subject of this Ordinance may be required to be V-shaped in order to collect the rain water and avert any drainage problems. This problem will be resolved by the Village Engineer. 2. The existing garage being coverted to a family room would be done in a tasteful manner matching the existing brick and frame front elevation of the home. 3. The construction of the north garage walls constst of 5/8" drywal for fire protection purposes. 4. Commonwealth Edison and the Village will have to make a determination as to whether or not the electric lines will have to be moved. age 2 of 2 ZBA 29-V-88 SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Sub3ect Property. SECTION FOUR: In accordance with the provisions of Section 14.604 the variations being the sub3ect of th~s Ordinance shall be null and void unless permits are ~ssued and construction begins withln one (1) year of the passage of this Ordinance for any portion of the property. SECTION FIVE: This Ordinance shall be in full force and effect from and after ~ts passage, approval and publication ~n pamphlet form ~n the manner provided by law.
