CAF/ ORDINANCE NO. 4081 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTIES COMMONLY KNOWN AS 1419. 1423. 1435. 1443. 1447 AND 1451 BONITA LANE WHEREAS, Kathleen and Gregory A. Miller (hereinafter referred to as Petitioners) have filed a petition for a Special Use with respect to property commonly known as 1423, 1435, 1439, 1443 and 1147 Bonita Lane (hereinafter referred to as the Subject Properties); and WHEREAS, the Subject Properties is legally described as follows: Lots 1, 2, 3, 5, 8 and 9 in Kathcon Subdivision, being a resubdivision of part of Lot "K" in Kirchoff Subdivision of the Northwest Quarter of the Northwest Quarter and the North 10 chains of the Southwest Quarter of the Northwest Quarter of Section 11, Township 41 North, Range 11 East of the Third Principal Meridian, according to the plat thereof recorded July 20, 1987 as Document No. 87-400753 in Cook County, Illinois and WHEREAS, Petitioners seek a Special Use for the Subject Properties, pursuant to Section 14.102.B.4 and Section 14.1101.C.6, to permit 3-car garages on Lots 2, 3, 5 and 8 not to exceed 750 square feet in size, and on Lots 1 and 9 3-car garages not to exceed 650 square feet; and WHEREAS, a public hearing was held on the request for Special Use (designated as ZBA Case No. 41-SU-89) before the Zoning Board of Appeals of the Village of Mount Prospect on the 13th day of July, 1989, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 27th day of June, 1989; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed Special Use to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given further consideration to the requests herein and have determined that the same meets the standards of the Village and that the granting of the proposed Special Use would be in the best interest of the public. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND 'BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Properties a Special Use to permit 3-car garages on Lots 2, 3, 5 and 8 which 3- car garages shall not exceed 750 square feet in size and on Lots 1 and 9 3-car garages not to exceed 650 square feet in size. SECTION THREE: With the exception of the Special Use granted BA 41-SU-89 Page 2 of 2 herein and the variations granted in Ordinance No. 4082 , the Subject Property shall comply ~ith all other applicable Village of Mount Prospect Ordinances and regulations pertaining thereto. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
