CAF/ ORDINANCE NO. 4077 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 308 ERIC, MOUNT PROSPECT, ILLINOIS WHEREAS, George T. Reilly (hereinafter referred to as Petitioner) has filed a petition for a Special Use with respect to property commonly known as 308 Eric (hereinafter referred to as the Subject Property); and WHEREAS, the Subject Property is legally described as follows: Lot 13 in Harvest Heights, being a subdivision of part of the Southwest Quarter of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded as Document No. 88-147393 and amended by Certificate of Correction recorded as Document No. 88-333001, in Cook County, Illinois and WHEREAS, Petitioner seeks a Special Use, as provided in Section 14.1101.C.5 of the Village Code of Mount Prospect, to permit the installation of one satellite antennae 11 feet in height and 10 feet in width in the rear yard of the Subject Property; and WHEREAS, a public hearing was held on the request for Special Use (designated as ZBA Case No. 38-SU-89) before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of June, 1989, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 6th day of June, 1989; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed Special Use to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given further consideration to the requests herein and have determined that the same meets the standards of the Village and that the granting of the proposed Special Use would be in the best interest of the public. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Special Use to permit a satellite antenna eleven feet (11') in height and ten feet (10') in width to be located within the rear yard of the Subject Property. SECTION THREE: This Ordinance shall be in full force and effect BA 38-SU-89 Page 2 of 2 from and after form in the manner provided by law.
