AN oRDINANCE PERTAINING TO A DETERMINATION OF THE PREVAILING WAGE RATES OF THE VILT.AGE OF MOUNT PROSPECT PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES the 20th day of June, 1989 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 23rd day of June, 1989. /12/89-CAF/ ORDINANCE NO. ~0~ AN ORDINANCE PERTAINING TO A DETERMINATION OF ~ THE PREVAILING WAGE RATES THE VILLAGE OF MOUNT PROSPECT BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: To the extent as required by "An Act regulating wages of laborers, mechanics and other workmen employed in any public works by the State, County, city or any public body or any political subdivision or anyone under contract for public works," approved June 36, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of the Village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook County areas as determined by the Department of Labor of the State of Illinois as of June, 1989, a copy of which wage rates are on file with the Village Clerk in the main office of the Village. The definition of any terms appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in said Act. SECTION TWO: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertain to any work or employment except public works construction of this Village to the extent required by aforesaid act. SECTION THREE: The Village Clerk shall publicly post or keep available for inspection by any interested party in the main office of this Village this determination of such prevailing rate of wages. SECTION FOUR: The Village Clerk shall mail a copy of this determination to any employer, and to any association of employees and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workmen whose wages will be affect by such rates. SECTION FIVE: The Village Clerk shall promptly file a certified copy of this determination with both the Secretary of State and the Department of Labor of the State of Illinois and shall further cause to be published in a newspaper of general circulation within the Village, a copy of this determination which shall constitute notice that the determination is effective and that this is the determination of the President and Board of Trustees of the Village of Mount Prospect. SECTION SIX: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Rev. Stat. 1987, ch. 48, par. 39s-1 through 39s-12) and Ill~nozs Preference Act (Ill. Rev. Stat. 1987, ch. 48, par. 2201 - 2207) The Illlnols Prevailing Wage Act requires each Public Body ~n the State of Illinois to: 1. Durxng the month of June of each calendar year, ~nvestigate and ascertain the prevailing rates of wages as defined in the Act (par. 39s-9). Upon request, the Department of Labor w~ll ascertain the prevailing rates of wages and certify them to the Public Body (par. 39s-4). Each Publzc Body, durxng the month of June of each calendar year, wzll post or keep available for inspection in ~ts main office, the prevailxng rates of wages f~le a oert~faed copy wzth the Secretary of State ~n Springfield (Index Division, 111E. Monroe, Sprangfield, Ill. 62706) (par. 39s-9) and send a copy to the Illinois Department of Labor (#1 West Old State Cap~tol Plaza, Rm. 300, Sprxngf~eld,'Ill. 62701-1217). W~thzn 30 days after th~s filing, the Public Body shall have published in a newspaper of general circulation w~thln the area, a notice that its determlnatlon ~s effective (parJ 39s-9). A Public Body shall specify in its resolution or ordinance and ~n any c~ll for b~ds for any contract regarding public works, that the general prevailing rates of wages for the locallty shall be paid for each craft or type of worker or mechanic needed to execute the contract or perform such work (par. 39s-4). All contracts and contractor's bonds shall include such provisions as w~ll guarantee that not less than the prevailing rate of wages shall be pa~d to laborers, workers and mechanics performing work as required to complete the contract (par. 39s-3 and 4). The Department of Labor w~ll revzew compliance by each Public Body with the time requirements of the Prevaillng Wage-Act-beginning July 1 of each year (par; 39s- 6). 8. The Preference Act requires that only Illinois-resident laborers be used on any public work~ pro0ect or ~mprovement done by or under contract to a Public Body.
