ORDINANCE NO. 4024 AN ORDINANCE AMENDING SPECIFIED SECTIONS OF CHAPTER 10 AMD CHAPTER 11 OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, the Village Code of the Village of Mount Prospect requires all businesses operating within the Village of Mount Prospect to first obtain a business license; and WHEREAS, Chapter 11 of the Village Code of the Village of Mount Prospect provides for annual license fees, setting forth the amount for such business licenses based on a fiscal year; and WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that it is in the best interest of the Village to create an annual billing cycle for specified businesses based on a calendar year; WHEREAS, for the business license year commencing May 1, 1989, the annual business license fee shall be prorated for the eight month period from May 1, 1989 through December 31, 1989 for the purpose of facilitating said change in the billing cycle from fiscal to calendar year: and WHEREAS, from and after December 31, 1989 the billing cycle those licenses designated in Chapter 11 shall commence on January 1. for NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: ~ That effective May 1, 1989 for the calendar year ending December 31, 1989, all business licenses and business inspection certificates established in Chapter 11 of the Village Code requiring an annual licensing fee shall be prorated to equal eight-twelfths (8/12) of the annual fee as set forth in said Chapter 11 and for the purposes of this SECTION it shall deemed that all Sections of Chapter 10 and Chapter 11 of the Village Code are amended to reflect an eight month proration. SECTION TWO: That effective January 1, 1990, Section 10.202 of Chapter 10 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting the language "Director of Code Enforcement" and replacing therewith "Director- of Inspection Services; so that hereinafter said Section 10.202 shall be and read as follows: "Sec.10.202. Investigation. The Director of Inspection Services shall make or cause to be made an investigation in regard to such business inspection certificates to be granted in connection with all fire prevention, building and zoning matters." ~Y~ That effective January 1, 1990, Section 10.304, entitled "License Term", of Chapter 10 of the Village Code of Mount Prospect, as amended, is hereby further amended by changing the termination date from April 30 to December 31; so that hereinafter said Section 10.304 shall be and read as follows: "Sec. 10.304. License Term. Unless otherwise specified in this Village Code, all annual licenses set forth in Chapter 11 of the Village Code of Mount Prospect, issued pursuant to this Chapter shall terminate on December 31 following such issuance." O · That effective January 1, 1990, Section ll.1701.A.1 of Chapter i1 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting "April 30" and replacing therewith "December 31"; so that hereinafter said Section 11.1701.A.1 shall be and read as follows: Such license shall expire the December 31 after the date of issuance, but may be renewed under the provisions of the Article for additional periods of one year." SECTION ~IVE: That effective January 1, 1990, Section 11.3407 of Chapter ll of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting "october 31" and replacing therewith "June 30"; so that hereinafter said Section 11.3407 shall be and read as follows: "Sec. 11.3407. Mid-Year Fee Reduction. Any Class I or Class II business license issued to a business opening after June 30 shall only pay fifty percent (50%) of the annual fee as set forth in subsection A of Sections 11.3404 and 11.3405 respectively. Such business shall also have the inspection limit, as set forth in subsection B of Sections 11.3404 and 11.3405 respectively, reduced by fifty percent (50%)." SECTION SIX: That effective January 1, 1990, Sections 11.3411 of Chapter 11 of the Village Code of Mount Prospect, as amended, is hereby further amended in its entirety; so that hereinafter said Section 11.3411 shall be and read as follows: "Sec. 11.3411. Late Payments. Whenever an application for a renewal of a license previously issued for the prior calendar year is received by the Village Clerk after December 31 but before February i of any given calendar year, the license fee shall be computed at one hundred ten percent (110%) of the annual license fee heretofor designated in this Article. Whenever an application for renewal of a license previously issued for the prior calendar year is received by the Village Clerk after January 31 but before March i of any given calendar year, the license shall be computed at one hundred twenty-five percent (125%) of the annual license fee heretofor designated in this Article. Whenever an application for renewal of a license previously issued for the prior calendar year is received by the Village Clerk after the last day of February but before April i of any given calendar year, the license shall be computed at one hundred fifty percent (150%) of the annual license fee heretofor designated in this Article. De Whenever an application for renewal of a license previously issued for the prior calendar year is received by the Village Clerk after March 31 but before May i of any given calendar year, the license shall be computed at one hundred seventy-five percent (175%) of the annual license fee heretofor designated in this Article. Whenever an application for renewal of a license previously issued for the prior calendar year is received by the Village Clerk after May 31 but before July 1 of any given calendar year, the license shall be computed at two hundred percent (200%) of the annual license fee heretofor designated in this Article. Any application for renewal not received by July i will be enjoined from conducting business until all fees have been paid to the Village." ~ That effective January 1, 1990, Section 11.3605 of Chapter 11 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting the language "Director of Code Enforcement" and replacing therewith "Director of Inspection Services; so that hereinafter said Section 11.3605 shall be and read as follows: "Sec. 11.3605. Investigation. The Director of Inspection Services shall make or cause to be made an investigation in regard to such business inspection certificates to be granted in connection with all fire prevention, building and zoning matters." O · That effective January 1, 1990, Section 11.3607 of Chapter 11 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting the language "April 30" and replacing therewith "December 31; so that hereinafter said Section 11.3607 shall be and read as follows: "Sec. 11.3607. Expiration Date. Ail certificates issued under the provisions of this Article shall terminate on December 31 of the calendar year following such issuance." ~ That effective January 1, 1990, Section 11.3610 of Chapter 11 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting the language "October 31" and replacing therewith "June 30"; so that hereinafter said Section 11.3610 shall be and read as follows: "Sec. 11.3610. Mid-Year Fee Reduction. Any certificate issued to a business opening after June 30 shall only pay fifty percent (50%) of the annual fee as set forth in Section 11.3608." ~ That effective January 1, 1990, Section 11.3613 of Chapter 11 of the Village Code of Mount Prospect, as amended, is hereby further amended in its entirety; so that hereinafter said Section 11.3613 shall be and read as follows: "Sec. 11.3613. Late Payments. ae Whenever an application for renewal of a business inspection certificate previously issued for the prior calendar year is received after December 31 of any given calendar year, the annual fee as set forth in Section 11.3608 shall be computed based on the following schedule: Renewal Received After But Before Fee December 31 February 1 110% of Annual Fee January 31 March i 125% of Annual Fee Last day of February April 1 150% of Annual Fee March 31 May 1 175% of Annual Fee May 31 July 1 200% of Annual Fee B. For any application for renewal not received by July 1 the business shall pay a penalty of not less than Twenty-Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each and every day after June 30 that the business operates without a business inspection certificate." N ' That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
