CAF/ ORDINANCE NO. 4103 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 2234 WEST LINCOLN STREET WHEREAS, Elizabeth M. Magnone (hereinafter referred to as Petitioner) has filed a petition for a Special Use with respect to property commonly known as 2234 West Lincoln Street (hereinafter referred to as the Subject Property); and WHEREAS, the Subject Property is legally described as follows: That part of the East 1/2 of the Southwest 1/4 of the Southeast 1/4 of the Northwest 1/4 of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, beginning at the Southwest corner of said East 1/2 running thence East along the South line of said East 1/2 165 feet, thence North Parallel with the West line of said East 1/2 264 feet, thence, west parallel with the South line of said East 1/2 165 feet to the West line of said East 1/2, thence South along the West line of East 1/2 264 feet to the point of beginning. and WHEREAS, Petitioner seeks a Special Use for the Subject Property, pursuant to Section 14.1101.C.6, to permit a 3-car garage; and WHEREAS, a public hearing was held. on the request for Special Use (designated as ZBA Case No. 60-SU-89) before the Zoning Board of Appeals of the Village of Mount Prospect on the 5th day of October, 1989, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 19th day of September, 1989; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed Special Use to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given further consideration to the requests herein and have determined that the same meets the standards of the Village and that the granting of the proposed Special Use would be in the best interest of the public. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Property a Special Use to permit a 3-ca~ garage, which Special Use is granted in conjunction with the variations being the subject of Ordinance No. 4104 SECTION THREE: With the exception of the Special Use granted herein and the variations granted in Ordinance No. 4104 , the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and regulations pertaining thereto.
