CA / ORDINANCE NO. 4088 AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT FOR PROPERTY COMMONLY KNOW AS 100 SOUTH SCHOOL STREET WHEREAS, St. Paul Evangelical Lutheran Congregation of Mount Prospect (hereinafter referred to as Petitioner) has requested modifications from the Development Code (Chapter 16) of the Village of Mount for property commonly known as 100 South School Street and legally described as follows; and Lots 4, 5, 6, 7 and 8 in Busse's Subdivision being a Subdivision of Block 7 (except the south 196 feet thereof) in Busse and Wille's Resubdivision in Mount Prospect, in the West Half of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, also, the south 196 feet of Block 7, Lot "A" (except the south 255 feet) "A" Block 8 in Busse and Wille's Resubdivision in Mount Prospect in the West Half of Section 12, Town 41 North, Range 11, East of the Third Principal Meridian. and WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the following modifications from the Development Code: To construct a carriage walk 2 feet wide within the public parkways on Busse Avenue and School Street; To allow the existing Commonwealth Edison wood pole street light in lieu of Village of Mount Prospect lighting requirements; 3. To delete the requirement for curbing around the existing parking lot; 4e To retain the existing parking lot for a period of one year after occupancy of the new school. The parking lot shall then be reconstructed to Village standards. WHEREAS, the Plan Commission has forwarded its recommendations relative to the modifications requested herein to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have determined that the best interests of the Village would be served in granting the modifications requested herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That modifications from the Development Code (Chapter t. Paul's School Chapter 16 Page 2 of 2 16) are hereby granted to the Subject Property as follows: To construct a carriage walk 2 feet wide within the public parkways on Busse Avenue and School Street; To allow the existing Commonwealth Edison wood pole street light in lieu of Village of Mount Prospect lighting requirements; To delete the requirement for curbing around the existing parking lot; To retain the existing parking lot for a period of one year after the occupancy of the new school. SECTION THREE: The modifications granted herein are subject to construction of a new 2 story school building, as indicated on the site plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION FOUR: Except for the modifications from the Development Code granted herein, all other requirements of said Development Code shall apply to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
