Ehard, Villa ge Clerk. Dear Sir: You are hereby directed to call a special meeting of . the Village Board, for the purpose of considering contract with the - Public Service Company for street lighting. Said meeting tobe held Monday evening, July 1'7th, 1922, at 7:00 o'clock P.1. at the usual place. Yours very truly, Signed William Busse. Village :"'resident" The President called the meeting to order. The Clerk called the roll all trustees excepting trustees Gosch and Haas responding present. Thereupon the clerk read the ollowing contract for street lighting submitted by the Public Service Comp any of Northern Illinois. STREET LIGHTING CONTRACT between , PUBLIC SERVICE COMPANY OF NORTHERN IILIIYGIS and the VILLAGE OF ;OUT 2ROSPECT THIS AGREEMENT, entered into this _._7th day of July A.D.1922 by and between 'U13LIC SERVICE COMPANY OP NORTHERN ERIV ILLI OIS, an Illinois Corporation .(hereinafter commonly referred o as the "Company") and the VILLAGE Oi' ...OUITT PROSPECT, a Municipal Corporation situated in the County of Cook and State of Illinois (hereinafter commonly refereed to as the "Municipality") witnesseth that : SECTION 1. Said Company agrees to install a system of poles, wires and inoandeseent lamps, (such lamps to be arranged in "Single Units" as hereinafter described) and to furnish all energy required by said in- candescent lamps, $'ir lighting the streets of said Village of Mount Prospect, commencing on the 1st day of August A.D.1922, and .. continuing for a period of ten (10) years, and after the expiration of said period until thirty (30) days after receipt by either party frcr- she other, of written notice to discontinue service, and the Municipality agrees to use anL pay for such Single units.at the rate and in the manner here- - inafter provided, it being understood and agreed that said Single Units, poles, wires, etc., remain the property of the Company. SECTION 2. Sadi Company shall furnish'under this agreement Single Units for the approximate candle power hereinafter designated and equip - pea in the maniacr hereinafter soecified as follows:- UEIT "A" One type "C" Mazda lamp consuming ap roximately 71 watts of , energy andgiving approximately 100 candle power, equipped withradial wave reflector and. suspended by an iron bracket (not to exceed five (5) feet in lengthkattached to the Company' poles. SECTIOa 3. Said Company agrees to furnish said Municipality all of the Single Units which it may require, at the following prices per lamp per year, payable in equal monthly installments: UNITS "A" - 100 C.P. PRICE PER N0. O LAMPS INSTALLED LAMP 2: Z YEAR 1 to 49 lamps X27.36 50 to 69 lames 27.08 70 to 99 lamps 26.79 SECTION 4. Saia Company agrees tc care for, supply and attend to all of said Single Units, replacing any that may become destroyed crworn out and to furnish at its own cost all fixtures, wires, poles and any other material that may be necessary to operate said Single Units in a proper anu efficient manner each and every night from DUSK UNTIL DANN, during the life of thin contract. SECTION 5. Said Company agrees that should said Municipality require auditional Single Units, to be operated in accordance with the terms of this contract, it will furnish same when so requested by the Municipality at any time prior to the let day of August A.D.1931, and said Municipality agrees to use and pay for such addition l Single Units, so ordered during the remainder of the life of this contract,. at the ari:;e per Sin;`le Unit per year as hereinbefcre specified in Sec- tion three, it being understood anu, agreed twat the avera. e distance betweei any twc conaecative aduitional Single Units and between the first c_: any series of such additional Units and any Sina:le Units al- , ready located, shall not exceed Pour Hundred (400) feet. SECTION 6. Said Company agrees that the properly authorized agent of the Municipality shallhave the right prior to the 1st day of August A.D.19a1, to order changes in the location of any Single Unit. ana that the same Shall ee changed within thirty (30) days after re- ceipt of written order requeating; provided, however, that no Single Unit shall be ordered cr.angeG from any location until the,same has been in operation at trait point for six (6) consecutive months, ana that an extension of not mere han four hundred (400) feet shall be required for any Single unit. 3E0TIOE 7. Said Company agrees' treat in the event of any inter- ruption in the operation f said Single units, during the hours of ser- vice herein provieea for, a pro -rata reduction in - trio monthly payment may be made toccver the Uefi:ienoy in the amount of light furnished caused by such interruption, provided that in case such interruption is caused by breakage of lamps, damage from storm or any other act of God, said Company shah be allowed a space of forty -eight (48) hours from the time cf such damage for the repair of said system, without any deduction from the contract price; but, notwithstanding such time allowance, said Company shall use all due diligence in making such repairs and shall make such re pairs in a p:romp nand reasonable manner. SECTION 9. Said Municipality aarees that, provided the bills for street lighting are resented by said Company three (3) days be- fore any regular meetin it will allow saiG bills at said meeting and pay the same within ten (10) days after Gate cf said allowance. Ili TESTIMONY L ': :0P, said Company has caused this contract to be signed by its Vice - President attested by its ;.secretary and • its Corporate Seal to be hereunte affixed; and said Municipality has caused this contract to be signed by its President, attested by its Village Clerk and its Corporate Seal to be hereunto affixed on the day and year first above written. Roll Call,. Ayes: Clausing, Heide, Jahncke, Mecklenburg. Nays: None. Motion carried ayes 4, nays none. • Thereupon it was duly moved by trustee Jahncke and seconded by trustee Heide that the ;ublic Service Company of Northern Illinois be ordered to install twenty -six (26) 100 candle Power Street Lights at the various places indicated on blue print submitted by them.
