DRAFT MINUTES 10/05/2010 MINUTES OF THE REGULAR MEETING OF THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT October 5, 2010 CALL TO ORDER Mayor Wilks called the meeting to order at 7:10 p.m. ROLL CALL Present: Mayor Irvana Wilks Trustee Paul Hoefert Trustee Arlene Juracek Trustee John Korn Trustee John Matuszak Trustee Steven Polit Absent: Trustee Michael Zadel PLEDGE PLEDGE OF ALLEGIANCE Mayor Wilks led the Pledge of Allegiance. INVOCATION INVOCATION Trustee Korn gave the Invocation. MINUTES APPROVAL OF MINUTES Trustee Matuszak, seconded by Trustee Juracek, moved to approve the minutes of the regular Village Board meeting held September 21, 2010. Trustee Polit stated his last name was misspelled in the last paragraph of page 4. The minutes were approved as corrected on page 4 with the following vote: Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. APPROVE BILLS APPROVE BILLS Mayor Wilks stated the next item on the agenda, "APPROVE BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." Trustee Matuszak requested vendor number 00108, on page 5 of the list of bills dated September 16, 2010 to September 29, 2010 be removed from the Consent Agenda for separate discussion: Illinois Department of Revenue - $53,744.91. Trustee Matuszak stated it is interesting that the Village is required to pay the State of Illinois while the State does not have to pay the Village the money it is owed. He indicated it may be appropriate for the Village to consider withholding payment to the State. The State's failure to give money due the Village is not healthy for our community. Village Manager Janonis stated this payment is for Village employee's portion of their state income tax. And, while the State does remain in arrears in its payments to the Village, the Village risks being penalized by the State if we withhold payments. Village Board Comments • Ironic the same money the State is withholding from the Village, we have to pay because we could be penalized. Yet, the State cannot be penalized for failure to make payments owed municipalities. • Encouraged residents to contact State representatives, urging the State to make timely payments of funds due to municipalities. Make representatives know how important these funds are to municipalities. Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. MAYOR'S REPORT MAYOR'S REPORT Mayor Wilks presented two (2) proclamations: FIRE PREVENTION Fire Prevention Week, October 3 - 9 2010 WEEK, OCTOBER 3- Acting Fire Marshal Bryan Loomis accepted the proclamation. Mr. Loomis thanked the 9, 2010 Village for their support and highlighted the annual fire safety poster and essay contest; the 2010 theme is "Smoke Alarms: A Sound You Can Live With." The contest winners will be recognized at the October 19, 2010 Village Board meeting. NATIONAL BREAST National Breast Cancer Awareness Month, October 2010 CANCER Mayor Wilks presented the proclamation to the following individuals who have contributed AWARENESS significantly to local efforts to generate public awareness and funding for this cause. MONTH, Ms. Cathy Bratu — Police Department OCTOBER 2010 Coordinates the "Save Lids,To Save Lives, Yoplait "pink" lid collection for all Village departments and this year expanded her efforts to the community. Collection locations — Public Safety Building and Village Hall. Fire Chief Mike Figolah - Fire Department Each year the Fire Department supports the Susan G. Komen 3 -Day walk. Fire personnel, donning pink shirts, cheer on participants providing moral support to the participants as they walk through Mount Prospect. Ms. Rosie Beile — Breast Cancer Survivor and participant in Susan G. Komen walk. Ms. Beile made a video of this year's walk through Mount Prospect which illustrated the unified community support afforded the Susan G. Komen participants. She thanked Mayor Wilks, the Trustees, Police and Fire Departments and the residents of Mount Prospect for their incredible show of support. The following employees are celebrating quinquennial anniversaries with the Village this EMPLOYEE year. Mayor Wilks and Police Chief Dahlberg recognized those in attendance and presented RECOGNITION each with a plaque or certificate. Mayor Wilks and Village Manager Janonis recognized and POLICE thanked Police Chief John Dahlberg for his 25 years of service to the community. CITIZENS TO BE COMMUNICATIONS AND PETITIONS — CITIZENS TO BE HEARD HEARD Mayor Wilks introduced Mr. Will Beiersdorf, Co- Founder of Salute, Inc. Mr. Beiersdorf provided an overview of the organization and the Heroes Helping Heroes fundraising event. Heroes Helping Heroes is an annual one day fundraising event to assist wounded soldiers and their families. Mr. Beiersdorf stated personnel from the Mount Prospect Fire and Police Departments volunteered their time soliciting donations; over $2,000 was collected in this year's event. Minutes of the Regular Meeting Page 2 of 5 October 5, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect Officer Tom Hoskinson was recognized for taking the lead in organizing and recruiting volunteers for Mount Prospect. Officer Hoskinson also accepted the travelling trophy on behalf of the Police and Fire Departments for raising the most money in this year's event. In addition, Mr. Beiersdorf presented the organization's "Hustle Award" to Fire Chief Mike Figolah and Police Chief John Dahlberg for their support and dedication to the mission of helping military personnel, veterans and their families. CONSENT AGENDA CONSENT AGENDA Trustee Korn, seconded by Trustee Polit, moved to approve the following business items: RES 33 -10 1. A RESOLUTION APPROVING THE DESTRUCTION OF CERTAIN CLOSED SESSION AUDIOTAPES OF THE VILLAGE OF MOUNT PROSPECT CREEK CLEANING 2. Request Village Board approval to accept bid for creek cleaning and tree trimming in AND TREE an amount not to exceed $14,000. TRIMMING Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. OLD BUSINESS OLD BUSINESS None. NEW BUSINESS NEW BUSINESS Mayor Wilks presented for a first (1 reading an ordinance granting a variation for exterior PZ- 12 -10, side yard setback at 1 South William Street. This ordinance grants a variation to allow a VARIATION FOR 12.19 foot exterior side yard setback along the north lot line for the subject property. The EXTERIOR SIDE Planning and Zoning Commission recommended approval of the request by a 5 -0 vote. YARD SETBACK, 1 SOUTH WILLIAM Community Development Director William Cooney provided background information stating STREET the petitioner proposes to demolish the existing sunroom and construct a two (2) story buildling addition to the rear of the home The addition would be setback 12.19 feet from the exterior side yard, encroaching 7.8 feet into the required yard. The Planning and Zoning Commission recommended approval of the request for a Variation subject to two (2) conditions: 1) the subject property be platted as one (1) lot and 2) the curb cut on Central Road be removed and improved appropriately. Mr. Andrew Venamore, Petitioner and Mr. Patrick Syzska, property owner addressed the Village Board. Mr. Venamore asked the Village Board to consider removing the second (2 "d ) condition attached to approval of the Variation; removal of curb cut on Central Road. He stated the cost to do the curb according to IDOT standards as well as the permitting process for IDOT approval would add substantial costs to the project. Trustee Korn asked if the condition could be amended to require only removal of the apron; leave curb cut as is. Mr. Cooney stated removal of the apron would be acceptable if that is what the Village Board approved. The curb work could be done at a later when IDOT is doing other road repairs on Central Road. Village Board Comments Discussion • Will removal of apron create water flow issues [Village Manager Janonis indicated there are other remnants of depressed curbs in this area along Central — doesn't anticipate removal will impact drainage] • Support removal of apron but leave curb cut. Minutes of the Regular Meeting Page 3 of 5 October 5, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect The Village Board indicated a general consensus to amend the ordinance by removing the requirement for removal of the curb cut on Central Road. The second (2 " condition attached to the ordinance to read; 2) The apron of the abandoned driveway along Central Road shall be removed and restored to its natural condition. Public Comment Mr. Louis Goodman 310 North School Street Mr. Goodman questioned jurisdiction of property between the curb and sidewalk at this location. Village Manager Janonis stated the Village did not need the State's approval for removal of the apron; Village has jurisdiction. However, if curb was to be added, IDOT approval is required. Trustee Korn, seconded by Trustee Polit, moved to waive the rule requiring two (2) readings of an ordinance: Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried Trustee Korn, seconded Trustee Hoefert, moved for approval of Ordinance No.5818 as amended: ORD 5818 AN ORDINANCE GRANTING A VARIATION FOR EXTERIOR SIDE YARD SETBACK AT 1 SOUTH WILLIAM STREET Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. MANAGER'S VILLAGE MANAGER'S REPORT REPORT Village Manager Janonis announced the following community meetings /events: • Coffee with Council — October 9 9:00 am — 11:00 am Village Hall Community Center • Fall Festival /Oktoberfest — October 16 4:00 pm — 10:00 pm OTHER BUSINESS OTHER BUSINESS Trustee Korn stated he was recently cited by the Village for site obstruction; private property bushes. Despite having his bushes recently, as well as routinely landscaped he was found to be in violation of the Village code. He shared this information so residents would know Village officials do not receive special treatment when it comes to Village regulations and policies. Trustee Matuszak stated Cook County recently filed a lawsuit in response to the City of Bridgeview's feral cat ordinance; he recommended the Village closely monitor the proceedings of that action. Mayor Wilks stated RES 32 -10; A Resolution Opposing the Borrowing of MFT funds was mailed with a cover letter to the Governor, the Secretary of Transportation and all State representatives. CLOSED SESSION CLOSED SESSION Mayor Wilks asked for a motion to enter Closed Session to discuss: PERSONNEL 5 ILCS 120/2 (c) (1) -The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body, including hearing testimony on a complaint lodged against an employee to determine its validity. LITIGATION 5 ILCS 120/2 (c) (11) - Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting. Trustee Juracek, seconded by Trustee Polit, moved to meet in Closed Session to discuss PERSONNEL 5 ILCS 120/2 (c) (1), PERSONNEL 5 ILCS 120/2 (c) (2) and LITIGATION 5 ILCS 120/2 (c) (11). Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried.
