HomeMy WebLinkAboutRes 48-01 08/07/2001VWL 8/2/0 t RESOLUTION NO. 48-01 A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO ADOPT AN INTERGOVERNMENTAL AGREEMENT WITH SCHOOL DISTRICT 57 AND THE MOUNT PROSPECT PARK DISTRICT FOR THE TEMPORARY RELOCATION OF MOBILE CLASSROOMS WHEREAS, the corporate authorities of the Village of Mount Prospect (hereinafter referred to as "the Village") have determined that it would be in the best interest of the Village to enter into an intergovernmental agreement with School District 57 (hereinafter referred to as "District 57") and the Mount Prospect Park District (hereinafter referred to as "the Park District"), to alleviate a temporary problem of increased enrollment within District 57; and WHEREAS, it has been determined that it would be in the best interest of all concerned to enter into an agreement to allow the temporary placement of mobile classrooms on property owned by the Mount Prospect Park District, currently zoned C-R, Conservation Recreation; and WHEREAS, the Agreement and exhibits being the subject of this Resolution further specify the terms of the Agreement and locations at which such mobile classrooms shall be placed; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor is hereby authorized to sign and the Clerk is authorized to attest his signature on the Agreement between the Village of Mount Prospect, School District 57, and the Mount Prospect Park District, being the subject of this Resolution. A copy of said Agreement is attached hereto and hereby made a part hereof. istrict 57, Park District Page 2/2 SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. ATTEST: Village Clerk INTERGOVERNMENTAL AGREEMENT Preamble Mount Prospect School District 57 ("District 57") has a critical need for additional classroom space at its Lions Park Elementary School and Fairview Elementary School. It has elected to install temporary mobile classrooms on the sites in the form of trailer units. According to District 57, the most convenient location for the unit at Lion's Park is in a place where it will straddle a lot line and encroach onto Mount Prospect Park District property. The Park District has approved such an encroachment as evidenced by a letter attached as Exhibit A to this Intergovernmental Agreement. The Village of Mount Prospect ("the Village") has regulations that may be construed as prohibiting temporary structures and the encroachment over established lot lines. Both District 57 and the Village believe it to be in their best interests to resolve any issues associated with the placement of the temporary units. Therefore, in consideration of the mutual covenants contained in this Intergovernmental Agreement, District 57 and the Village agree as follows: 1. The temporary units shall be no larger than and have the general appearance as shown on Group Exhibit B that is attached to and made a part of the Intergovernmental Agreement. 2. The temporary units shall be located as set forth in Group Exhibits C and D, which are attached to and made a part of this Intergovernmental Agreement. Any fencing, paving or landscaping shall be accomplished in accordance with Group Exhibits C and D. 3. This Intergovernmental Agreement shall be effective until September 1, 2004 and the temporary unit shall be completely removed from the premises by that date unless such time is extended by written agreement of the parties.
