HomeMy WebLinkAbout08/23/1961 VB minutes MINUTES OF SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON AUGUST 23, 1961 President Schlaver called the meetin~ to order at 8:25 P.M. with the following trustees present: Bickley, Bruhl, Casterline roll call and Phillips. Absent, Trustee Ekren and Gaw. Trustee Bruhl, seconded by Trustee Casterline, moved that the minutes of the previous meeting of August 15 be approved as submitted, minutes The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline and Phillips. Whereupon the President declared the motion carried. In the absence of Trustee Ekren, Trustee Bickley gave the report of the Judiciary Committee. Trustee Bickley read the following report from the Board of Appeals re Zoning Case 61-23: Zoning Case REPORT 61-23 Village-owned To: Board of Trustees property to Re: Case #61-23 be bought for Petitioners: American National Bank & Trust Co. of Chicago, Jewel Tea Co. not individually but as Trustee U/T Agreement dated 9-15-52, known as Trust #9341 - by Charles L. Schrager Co. as Agent for the Beneficiaries of Trust #934l Lawrence E. Gailen, Secretary This was a request for rezoning from I-1 to B-B an area of land on the north side of Northwest Highway between Pine and Elmhurst Ave. The Zoning Board of Appeals voted 5-0 in favor of the rezoning, contin- gent upon the following items which were agreed to by the petitioners. 1. That the property lying along Elmhurst Ave. for 100 ft. south of Central Rd. to be zoned P-1. 2. That in the event there is not sufficient land dedicated for streets and sidewalks that this would be done. There were no objectors present. E. F. Martin, Chairman Dan Congreve, Acting Sec:y MEMORANDUM To: Board of Trustees Re: Case 61-23 Charles L. Schrager Co. This petition involves the land the Jewel Tea Co. now occupies on the Northwest Highway as well as the balance of the land between Pine and Elmhurst and extending North on Elmhurst to Central Road. Ail of this land is now zoned I-1 and the Jewel Tea Store is a non- conforming use. The petitioners state they will add approximately 29 ft. in frontage to the present store and the balance of this land will be used for parking. The Board of Appeals did not believe it wise to zone all of this land B-3 sin ce it is not needed and suggested to the petitioner that it might be better to zone the Southwest corner of Central and Elmhurst to P-1 parking paved. This the petitioner agreed to for a distance of 100 ft. south of Central Road. By doing this it would keep this corner Case 61-23 under the control of the Village and might eliminate some Jewel Tea Co. undesirable use in the future. Since there was not a survey available it was impossible to determine whether land had been dedicated for streets and side.- walks. The petitioner agreed to dedicate such land if not already done. The Board of Appeals after due consideration agreed that subject to the above changes the best use of the property should be B-3 and voted 5-0 in favor of the rezoning. E. F. Martin, Chairman Dan Congreve~ Acting_ Sec'y Mr. Hofert added that he had received s copy of the petition to zone 100 feet from Northwest Highway to Central Road to P-1 and that they will also take care .of the sidewalks. The Village Engineer said that since Elmhurst was a 20 ft. street he thought i~<~tro~id be a B1 ft. street. They have not agreed to this but will take it up. The decision would be in the hands of President Schlaver and he could veto the ordinance if they did not agree to it. Trustee Bickley, seconded by Trustee Phillips, moved that the Village Board concur in the recommendation of the Board of Appeals regarding the above case and directed the Village Attorney to prepare the necessary ordinance. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline, and Phillips. Whereupon the President declared the motion carried. Trustee Bickley, seconded by Trustee Casterline, moved for the passage of Ordinance ~781: Ord. ~781 Rezoning to B-3 AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT Jewel Tea Co. ZONING ORDINANCE AS TO CERTAIN PROPERTIES TO BE property USED BY THE JEWEL TEA CO. ON NORThwEST HIGHWAY AND ELMHURST AVENUE IN THE VILLAGE OF MOUNT PROSPECT The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline and Phillips. Whereupon the President declared the motion carried. Trustee Bickley referred to Cases 61-21 and 61-22 wherein the Board concurred in the recommendation of the Board of Appeals at the August 8th meeting. Trustee Bickley read Ord. ~782 and moved for its passage, and that the President and Clerk be authorized to sign same, seconded by Trustee Bruhl. Ord. #782 Busse-Wille AN ORDINANCE AMENDING THE ZONING ORDINANCE OF property MOUNT PROSPECT AS TO CERTAIN PROPERTY ON THE WEST SIDE OF MAPLE STREET RUNNING FOR 20 FT. NORTH OF LINCOLN AVENUE IMMEDIATELY ADJACENT TO PROPERTY PREVIOUSLY ZONED R-3 The President put the. question, the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline, and Phillips. Whereupon the President declared the motion carried. Ord. #783 Trustee Bickley read Ord. #783 and moved for its passage and School propertythat the President and Clerk be authorized to sign same, seconded by Trustee Phillips. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF MOUNT PROSPECT AS TO PROPERTY DIRECTLY SOUTH OF CENTRAL SCHOOL. This is an ordinance reclassifying from R-1 District, Residential, to P-3 District, Parking. The President put the question, the Clerk called the roll, with the following respqnse: Ayes, Trustees Bickley, Bruhl, Casterline and Phillips. Whereupon the President declared the motion carried. Angust 23~ 1961 317 President Schlaver stated that the Village Manager was President's vacationing and his report was enclosed with the agenda for the report meeting. It included the Use of the Radar Speed Timer Aug. 1-Aug. lB and the Poliee Department Tickets for Aug. ll-Aug, l?. President Schlaver gave his report stating that he had recently returned from a trip to White Sands, New Mexico and Colorado Springs, Colorado with the U. S. Army and Air Force. At a previous meeting Trustee Casterline suggested that the Trees Village give thought to a replanting program for trees removed because of Dutch Elm disease and President Schlaver stated that he endorsed and hoped that a program of substantial help be given. President Schlaver stated that as sole liquor commissioner Liquor he is empowered to name a committee to assist him in performing these duties, and he, therefore, has appointed the following to assist him: Joseph Sokal, President of Mt. Prospect Federal Savings and Loan Association 409 NaWa Ta Herbert Van Driel, druggist, South Pine Street Jack McHugh, former President of Northwest Home Owners Association, 401 No Eastwood President Schlaver stated that Arlington Heights this week Annexations completed annexation of all territory west of Busse Road to the toll road and Des Plaines is also considering annexation of the area west of 8B and south of Mt. Prospect, and this logically should be under our control. He is happy that members of this board are pursuing possible annexation south to the toll road. President Schlaver requested a return to the former procedure of four regular meetings a month except in the months of December Board meetings July and August, and asked that someone moved that the Village attorney draft the necessary change in the ordinance as revised last spring. Trustee Bickley, seconded by Trustee Phillips, moved that the Village Attorney be authorized to prepare an ordinance making the change to four meetings a month as reouested by President Schlaver. The President put' the question with the following response: Ayes, Trustees Bickley, Bruhl, Phillips and President Schlaver. Nays, Trustee Casterline. Whereupon the Presiden~ declared the motion carried. Trustee Bruhl gave a report on the meeting held with the three garbage other village for joint garbage service at which they complimented us for the idea but would not go along with us. Trustee Casterline made the following motion, seconded by Trustee Bruhl: ~That the Village Attorney be authorized and instructed to prepare an ordinance to provide for Fallout Shelters including the following: 1. All Fallout Shelters shall require a building permit prior to construction. 2. The minimum quality specifications be those shown in "The Family Fallout Shelter - MP 15" of the Office of Civil and Defense Mobilization Dated June 1959 (figures lB, 18, 19, 20, 21 Drawings SO-l, 5, 6 & Y. B. Such construction be within the building limits of each lot unless the locations or size of the current buildings on the property cause the owner a severe hardship by regulations according to the best judgement of the architectural committee. Hardship cases should be referred to the Village Board for a special variation ruling. Augusz 23, 1961 4.Satisfactory provision for drainage around the shelters, ventilation and structural strength. §. Waive any butlding permit fee. County The Village Attorney asked the Trustees to indicate what -- Zoning status they wanted him to take on County Zoning Dockets 246, 227, ~ and 208, 209, 210, 211, 212; whether to withdraw the objections or keep them in force. Trustee Phillips, seconded by Trustee Bickley, moved that the Village Attorney be instructed to withdraw the original objections to Case 208, 209, 210, 211 and 212, and the objection to the others should remain. The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline and Phillips. Whereupon the President declared the motion carried. Traffic Trustee Bickley reported that he had a request for a stop sign at Hi Lusi and Busse and the police committee recommended that it be denied. Trustee Bickley also reported on the request from the Sunset PTA for a stop light at Lonnquist and 83. The State would not allow this as there wasn't sufficient cross traffic and we do have a crossing guard there. Trustee Bickley, seconded by Trustee Phillips, moved that the Village Attorney be authorized to draw up the necessary ordin- ance for the erection of "No Parking at any Time" signs on the south side of Memory Lane between Dale and Forest Avenues. The President put the question, the Clerk called the roll, with the ~.~ following response: Ayes, Trustees Bdckley, Bruhl, Casterline and Phillips. With regard to the letter from the Northeast Home Owners Ass'n., copy of which all of the trustees received with the agenda, Trustee Bickley, seconded by Trustee Phillips, moved that the Village Attorney be authorized to revise the ordinance passed heretofore regarding Highland Avenue and now make it a 2-way street and for the erection of 4-way stop signs at the intersection of Highland Avenue and Maple Avenue. The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Bickley, Bruhl, Casterline and Phillips. Whereupon the President declared the motion carried. Trustee Bickley read the following letter: July 21, 1961 Village of Mount Prospect ll2 E. Northwest Highway Mount Prospect, Illinois Gentlemen: Re: Shopping Center on Judith Ann Drive I & Main Street~ Mt. Prospect, Ill. We hereby request permission to ~utilize for angular parking the south parkway of Judith Ann Drive adjacent to the property ~eferred to above. We feel this would help alleviate any congestion which may occur in this area. The space of a car which would normally park parallel to the curb exceeds the amount of ~verhang required by angular parking. The flow of traffic can be expedited by means of directional exit through shopping area. As indicated by the enclosed pla. ~ugust 23, 1951 e would appreciate you~ consideration of ~hismatter. Traffic Very truly yours, Phillip Gross & Associates, Inc. by - George Sorensen Trustee Bickley, seconded by Tra~tee Casterline, moved to approve the parking plan for the shopping center on Judith Ann Drive and Main Street subject to the following change, and asked the Village Clerk to so notify Phillip Gross & Associates. 1. The angle parking should be changed from 80° to BO° angles. 2. Four parkin~ spaces immediately west of the building should be marked for employees only. B. Two additional parking spaces should be created on the immediate northwest corner of the north- west parking lot. Trustee Bickley reported that they had created a police Police Dept. blotter typearrangement which is available to the press for all police cases with the exception of Juvenile cases. Trustee Bickleyread the following letter: THE INDEPENDENT August 23, 1961 Dear Mr. Bickley: Since you arechairman of the Police Commission I would like to take this opportunity to let you know of the fine cooperation I have received from our police and fire departments in gathering the news of the village. I realize that these are working departments and their main jobs have nothing to do with public relations. Occas~mally both Chief Haberkamp and Chief Whittenberg ha~e omitted items or news which would have been useful to me and which has been carried in other newspapers. I have never felt this was done deliberately, or with malice, but only under the press of business at hand. A reperter's job in a small community is rather touchy if he also lives there, especially when it comes to police news. I don't wish to know too much about my neighbor's squabbles, since they are hardly newswnrth. I am perfectly willing to leave the choice of items to Chief Whittenberg's discretion. His job is to protect the community, and if he feels keeping counsel on certain items is important, I will go along with him to any reasonable limit~ Any questions I have asked the Chief have always been answered courteously and in detail. Further, his men are always pleasant and cooperative and show signs of excellent discipline. If I happen to question them about an item they always refer me to him, which is only right. On the ether hand, I don't feel that I have enjoyed any special treatment since I ha~e been in the department when reporters from Chicago papers received the same courtesy and cooperation. I had assumed this was the way the department was run and ~ think you will find that it is.
