Trustee Ekren, seconded by Trustee Schlaver, moved that the minutes minutes of the meeting of August 16th be approved as submitted. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, No~-~-is and Schlaver. Whereupon the President declares the motion carried. Additional Well ~ shooting heretofore authorized by the Board is included as the lump sum of $677.40. Traffic on Trustee Casterline submitted~the Police Department Report for Forest Ave. the month of August,and made the following motion, seconded by Trustee I way north Schlaver: That the Village Attorney be authori~.ed s~d directed to prepare an ordinance providing for one.w~y traffic on Forest Avenue to run north between Memory Lane and Highland Avenue. The President put the question, the Clerk called the roll, with the following response Ayes, Trustee Airey, Casterliue, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion csrried. Weller Creek Trustee Casterline gave his report as chairman of the committee fence at appointed August 16th by President pro tern Norris to look into the Westbrook matter ef fencing around Weller Creek at the new Westbrook School. School Trustee Casterline stated that his committee had met with representatives of the School Board, at another meeting ~-lth representatives of the East.Westbrook School Parents Safety Committee, and were also present at another meeting of the latter. Trustee Casterline, seconded by Trustee Schlaver, made the following motion: In the interests of public safety and for the protection ~f public property, I move that the provisions of the Village,s Building ~ode be waived to permit the erection of a 6-foot chain link fence around Westbrook School and along the westerly edge of Weller Lane from Central Road to approximately the southerly line of Cle~en Avenue, at a cost not to exceed $6,000. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. The following is Trustee Casterline,s report regardd~g the fencing of Weller Creek: ,,Each of the committee members have visited the Creek site bordering the Westbrook School a number of times as have other members of the Village Boa~d. Each of us feel that we have a thorough understanding of (1) condition of the Creek bed, (2) condition of the banks and propertyJimmediate2~v adjacent to them, (3) the contents of the Creeks flowage both at normal dry flow level snd at the peak loads which occttr after heavy rsins, (~) the access routes to and from the Westbrook School which ~rlll be traveled by 200 to 300 Mt. Prospect children of age 5 to ll years. FINDiNgS 1. In spite of normal dry flow being only a few inches deep, we must regard the Creek bed banks, and immediately abutting property, as unsafe for child play. This condition exists along~ Weller Creek, almost without exception, along its entire course through the South side of our Village. 2. Mt. This action was taken by this cm,~ittee in the interest of expedience in fencing construction since the opening of school was scheduled prior to the next regularly scheduled Board meeting. The contract with Milburn Bros. was therefore ex-tended to cover the additional distance to the previously described point south of Cle=en. The Committee unanimously agreed on: ~l) Fence construction should be the same as that ordered for use between the school playground and the creek. (2) A right angle safety wing of fencing should be con- structed from the l~ne of fencing-~as near as possible to the top edge of the creek bank. (3) Provision for a gate se that the legal access to the Creek will be available for such purposes as may be required in the future. (4) The Police Department via the Village Manager has been requested te maint~iu as of now particularly close watch prior~ tb ~choot~eurs,~ during neen~re~ss,~d~mmediately after school hours to discourage I~estbrook Schoo2 chitdern from using the west side of Weller Lane er approacking the Creek. Also, they should supervise and assist t~e parent patrol volunteered by the East.Westbrook S~chool Parents Safety Co~ttee. This duty is in addition to provision for a crossing guard at Central Road and Weller Lane. We are aware that other requests have been made from other areas in our Village to have Village employees work on ~eller Creek,s banks and to have the Village government finance and erect fencing along the Creek right.of. way audat over.creek access bridges. Tour Village government has favorably responded to each of these requests which present an emergency situation or merely extend a responsibility traditionally assumed by the Village. The fencing along We!ler Lane is a simple extension of the traditionally. accepted responsibility shared with the School Board for m~utaJ_ning safe access routes for school chitdern ~o and from their school. Crossing guards will continue to be appointed and supervised by our police Department. This fencing will serve as a continuous guard along this school route and provide a measure of safety, as does our crossing ? program. A member of the East.~estbreok Parents Safety C~ittee arose and commended the Co~.~ttee from the Village Board for their thorough and prompt action on behalf of this problem: he lauded the Village Board for their interest and quick decision in this matter. Trustee Gaw, seconded by Trustee No~-~-is, moved that the Village Audit Repo~ Board accept the audit report ~f Ernst & Ernst for Village of Mount Ernst & Ernst September 6, 1960 Prospect financial statement as of April~, 1960, their Water Fund report ~ as of April?~, !960~, and their Special ASsessment FUnd rePort, and place them on file. ~The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline~ Ekren, ~Ga~, Norris and Schlaver. Trustee Schlaver, seconded by Trustee GaY, moved that the low Water bid of Lattof Meter Sales, Arlington Heights, be accepted fer the Dept. purchase of a 1961 Chevrolet C2534 for the Water Department, in the truck amount of $1,949.67, and that the order be placed immediately. No shrubs Trustee Schlaver, seconded by Trustee Norris, moved that the near hydrantsVillage Attorney be authorized to amend Article V, Chapter 9 of the Village Code as follows: ,,It shall be unla~wful to plant ct permit any tree and/or shrub to grow within 6 feet of an~ fire hydrant. ,, The President put the question, the Clerk Called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Craw, Norris and Schla~er. Curbs, etc. Village Manager Appleby read letter from Public School District at Fairview #57 asking perr~ssion to construct curbing,~ drainage structures and School sidewa]_ks on Isabella and on Gregory Street adjacent to Fairv-lew School at their own expense in accordance with plans prepared by Village Engineers. __ After short discussion, Trustee Norris, seconded by Trustee Ekren, moved that pez~Lssion be granted to the School Board of District #57 to construct this improvement at their e~pense. Whereupon the President declared the motion carried. Mr. Nolle Benedetti of 4 North Edward arose and complained that Serafine's his street has been unpaved for years. It developed that the builder, 2nd Add'n Mr. Serafine, has neglected to finish certain requirements of the Villa~ e before approval for paving is to be ~iven. The consensus of the Board was to notify the bondin~ company of Mr. Serafine's failure to keep his end of the agreement. Village Clerk Reynolds reported to the Board that he received a copy of the followir~ letter from Albert M. Dear Mr. Goodman: May we request an injunction ot~ court order to prevent Sal Df Mucci from completing buildin~s on the west side of Busse Road, 175 ft. north of Golf Road., in Elk Grove Township, underthe jurisdiction of Mt. Prospect VillaEe, Illinois.- We also request that the existing foundations be leveled and soil placed to original grade. This request is based on the following: Violation of existing. covenant of 40,000 sq. ft. per lot till year of 198B, less than the 50 ft. setback from street or property line has been violated. The Village of Mt. Prospect has no record of this, proposed, commercial zoning, as it is now zoned residential, and that no plat was submitted for approval for commercial use. September 6, 1980 That the existing Mobiloil Service Station on the northwest corner of Golf & Busse Roads, also owned by Mr. Di Mucci, is in violation of the 75 ft. building setback from Golf Road. That a Mr. Feroni issued a Certificate of Zoning from the Cook County Zoning Commission to the Building Department for a permit to build under B-4 zoning (10,000 sq. ft.) --- 40,000 sq. ft. is the minimum requirement in this area. Document ~S14127 reads in part: Restrictions until January 1, 196S, as to use, cost, location, type of construction of buildilngs to b~ erected on the foregoin~ premises -- also refer to Document #978~/59 and Document ~841B91 and Case No. 56-C-7801, dated June 12, 1959, filed in Circuit Court of CCI, affecting this property. Recent zoning plat of this area shows R-4 zoning, pointing to the fact that possibly there is a variation or zoning prior to printin~ of the map to allow non-conforming use. Re Case 60-19, zoning appeal of Louis Klein, a petition of Zoning Case protest from the adjoining property owners (SO) was received and placed 60-19, Klein on file. President Lame read letter from residents living in the southeast section of the Village as follows: RR Crossing TO THE PRESIDENT AND MEMFERS OF THE MOUNT PROSPECT Mt. Prospect R VILLAGE BOARD, PRESENTED THIS DAY, SEPTEMBER 6, 1960. & Hwy. 14 We, the citizeus and taxpayers of the Village of Mount Prospect, County of Cook, State of Illinois, reouest the Mount~ Prospect Village Council to contact the Superin%endent of Highways and the officers of the Northwest Railway to investi~ate the traffic hazard at Mount Prospect Road (County Road) and Northwest Highway, Route 14 (State Highway) and to relieve this condition in a proper and speedy fashion. As traffic records will show, the correction of this situation is long overdue. For the safety of our citizens and children and for the use of the facilities given us by local businessmen, physicians and hospitals all located north of Northwest Railway, we would suggest these improvements: 1.STOP AND GO LIGHTS AT NORTHWEST HIGHWAY - ROUTE 14 (STATE ROAD) AND MOUNT PROSPECT ROAD (COUNTY ROAD) A. To enable pedestrians to cross without danger to use business facilities north of the railway. B. To allow school children to cross to and from school. C. To allow local automobile traffic to cross to shopping center and proposed shopping center at Mount Prospect and Rand Roads. D. To make emergency crossings (fire, ambulance, police) possible. E. To prevent speeding between Graceland Avenue to Des Plaines, Tllinois and Emerson Avenue in Mount Prospect, Illinois. September 6, 1960 2. GUARD RAILS TO BE INSTALLED ON THE NORTHWEST RAILROAD CROSSING A.To eliminate the nuisance of train whistles in the residential area. B.To eliminate automobiles from standing on the tracks waiting forcrossing. 3. TO MEET WITH RAILWAY OFFICIALS TO SOLVE THE NUISANCE OF PARKED ~, FREIGHT CARS AT MOUNT PROSPECT ROAD ON WEEK-ENDS AND TO PREVENT SWITCHING OF CARS RESULTING IN EXTENSIVE DELAYS FOR BOTH LOCAL AUTOMOBILE AND PEDESTRIAN TRAFFIC AND THE S~ITCHING OF THE CARS THROUGHOUT THE NIGHT. After proper procedures are taken to eliminate these hazards, what further steps can be taken by us, as taxpayers and local citizens, to insure greatest expediency in this matter? (Signatures of homeowners) Discussion followed; the Board is agreeable to co-operation with Des plaines. The Village Manager will look into this and notify Mr. Elmer Jorn, 50~ South Albert. Bri~kmafl Manor Trustee Airey, seconded by TrUstee Ekren, moved to refer plats iSub, ~Utside of units 4 and 5, Brickman Manor Subdivision, between Foundry & Euclid Tillage limits eastward toward WoIf Road to the Plan Commission for study and recom- mendation. This motion carried by acclamation. Trustee Airey, seconded by Trustee Ekren, moved for the ' passage of proposed Ord. 725: ors; 725 Ca~e 60-13 AN ORDINANCE AMENDING THE VILLAGE OF Bolger MT. PROSPECT ZONING ORDINANCE AS AMENDED --' ' This ordinance refers to Zoning Case 60-13, Bolger, allowing a change . of zoning from R-1 to R-3 at the northeast corner of Main and Central. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Trustee Airey, seconded by Trustee Norris, moved for the passage of proposed Ord. 726: i O~d. 726 AN ORDINANCE GRANTING A VARIATION FROM THE case 60-15 VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE Trapani AS AMENDED This ordinance refers to Zoning Case 60,15, Trapani, allowinM erection of professional building in R-3 district. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Mr. William Cadigan of Consoer, Townsend reported that Sewers there should be no additional action re back yard drainage problem in the 500-block on Elmhurst Avenue until the Public school sewer drain situation is resolved. --' The Board authorized the Village Clerk to write letter of : Police Dept. appreciation and congratulations to Officer Gerald Glascock, who was Officer awarded a Citizens Traffic Safety Board scholarship representing a Glascock paid-up tuition of $165- for the Accident Investigation Administration & Techniques course to be held at Northwestern University Traffic Institute. Repair curbs Trustee Norris, seconded by Trustee Casterline, moved that N. Maple St. the Village Manager be authorized to enter into agreement with Milburn Bros. for the repairand correction of curbs on North Maple Street for a sum not to exceed $500-. September 6, 1960 Village Manager Appleby displayed quit claim deed from the VillaEe to the Park District which deeds area reserved in Country Country Club Club Terrace for park use, and allows easement for water mains. Sub. 2nd Add'n Trustee Airey, seconded by Trustee Casterline, moved that sAdd Park area auit claim deed be approved and authorized the President and Clerk to sign same on behalf of the Village of Mount Prospect.
