Upon roll call, the following answered Present: Trustees roll call Airey, Casterline, Gaw, Ekren, Norris and Schlaver. Absent, President Lams. Trustee Ekren, seconded by Trustee Gaw, moved that the minutes of the meeting of August 2nd be approved as submitted. Trustee Gaw, seconded by Trustee Casterline, moved to open bids on surfacing of streets in Northwest Meadows Subdivision° This carried. by acclamation and the Clerk opened the bi~s as follows: Milburn Bros. Bid- $15,343.33 Trustee Schlaver, seconded by Trustee Airey, moved to refer this to Wm. Cadigan, engineer for the Village. This was done after motion was carried by acclamation. Mr. Cadigan retired with the bids to study them and returned later in the meetinE with the following recommendation: That the lower bidder, Skokie Valley, being of good reputation, should be awarded the contract. Thereupon Trustee Ekren, seconded by Trustee Norris, moved that the Board accept the bid of Skokie ~alleyAsphalt Company in the amount of $15,343.33 for maintenance work in Northwest Meadows subject to State approval. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Ekren, Gaw, Casterline, Norris and Schlaver. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Airey~ moved that the Fences arour Village Manager secure bids for fences around the Village property on Village the west side of Pine Street and around the property at Well #5. Augus% 16, 19~0 Trustee Schlaver,. seconded by Trustee Gaw, moved that the sidewalk - Village Manager secure bids for sidewalk around the elevated water water tower storage tower. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Casterline, moved that Fire Dept. the Village Manager be authorized to have the necessary telephone telephones equipment installed for notifying volunteer firemen by phone rather than by the siren; the cost, as close as it could be estimated by the telephone company, being about $105 per month. The President put question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Ekren, moved that Well #6 expenditure of not over $1,000 be authorized for additional shooting of Well #6, based on the recommendation of the Village Engineers. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Ekren, moved that Truck because of the inability of the Iow bidder to supply truck specified Water Dept. from 1960 production, that bids received July 6, 1960 on a B/4 ton pick-up truck for the Water Department be rejected and the Village Manager directed to secure new sealed bids on a 1961 model before the next Board meeting. Trustee Schlaver gave rsport on his attendance at a meeting Fence erectionof the School Board wherein residents near the new Westbrook School at Weller requested that Weller Creek near the school be fenced and bridge over Creek and said creek be fenced on each side. The School Board agreed to fence Westbrook the east side of the Creek and asked if the Village would be willing School to fence the west side. President pro tem Norris appointed a committee of three to look into this; Trustee Casterline as chairman, with trustees Gaw and Schlaver. President pro tern Norris read letter from William Cadigan Alley b~hind regarding the cost of engineering reports on alley behind the DIMucci apt&. on duplexes on Hwy. 8B at Lincoln. Hwy. 8~ Di Muc~i July 27, 1960 Mr. H. G. Appleby, Manager Village Hall, Mount Prospect Dear Mr. Appleby: As requested by the Village, we have submitted our invoice in the amount of $157.60 to Mr. Salvatore Di Mucci for work in connection with the alley at the rear of his apartments on South Elmburst Road. Mr. Di Mucci has refused to pay this invoice and has sent us the enclosed letter. Not knowing what agreement on our services was made between the Village and Di Mucci, we would appreciate your advising us what our next step is in collecting this bill. Cadigan Consoer, Townsend & Associates August 16, 1960 rustee Norris, seconded by Trustee Oaw, moved that the Village Manager be instructed to write letter to Mr. Di Mucci, indicating that such expense is to be borne by Mr. Di Mucci; that we have instructed our engineers not to proceed until this bill has been paid and a letter received from Mr. Di Mucci guaratneeing payment of any further engineering expense for i~provemsnt of this alley. This motion carried by acclamation. Trustee Norris, seconded by Trustee Ekren, moved that Gregory Street west of Wille Street be repaired by the complete removal and Paving - replacement of existing base and surface course and replacement with 8" Gregory St waterbound base course and 2" bituminous surface course as an extension west of of the 15-CS project with motor fuel tax funds, and that the Village Wille Engineers be directed to take whatever steps are necessary to accomplish 15CS this action. Whereupon the President declared the motion carried. Trustee Norris, seconded by Trustee Airey, moved that the south side of Highland Avenue from Elm Street to the east line of Well #5 Paving - property be surfaced with 2" I-Il bituminous surface course as an E. Highland extension of the 15-CS project, with motor fuel tax funds, and that 15CS the Village Engineers be directed to take whatever steps are necessary to accomplish this action. T. & A. be requested to prepare the necessary plats of dedication E.Hi~hland Ave. for Highland Avenue and that the full width street be established now Dedication of so there Ebll be no future question as to easements for sewers and wa~er street next to mains located therein. This will also clear the way for an M.F.T. street improvement project and rehabilitation project to make Highland Avenue a full width improved street. Trustee Norris, seconded by Trustee Schlaver., moved that the Sidewalk Village Engineers be authorized to prepare plans and specifications Spec. Assess° for sidewalk special'assessment program for thenorth side of Central program Road from Arthur Avenue to the Northwest Highway for those locations where no sidewalks exist. Village Manager Appleby rea~ letter from Consoer, Townsend, Village Engineers, in which it was stated that inasmuch as the County Highway Traffic Department desired detailed drawings of traffic lights at Central and controls - Main for their approval before being moved to different location, the Central & cost would probably be in excess of the $500 allocated for this purpose Main at the last meeting. Mr. Cadigan said it would be impossible at this time to estimate the cost of the engineering. Trustee Schlaver, seconded by Trustee Norris, moved to rescind their motion regarding this at the previous meeting. This motion carried by acclamation. Trustee Ekren, seconded by Trustee Norris, then moved that the Board authorize the Village Manager to ask C. T. & A. to prepare the necessary plans and drawings for relocation of the traffic lights at Central and Main. August 16, 1960 Trustee Airey read the following report from the Board of Appeals re Case 60-12: Zoning Case 80-12 REPORT McIntosh & Berschet August 8, 1980 President & Board of Trustees Village of Mount Prospect Gentlemen: Case 80-12 - Hearing July 29, 19~0 Petitioners - A. T. McIntosh & Gertrude Berschet The petition concerns a request for rezoning from R-1 to B-B for Lots lB, 17, 18, 19, 20 and 21 between Dale and Evanson Streets on Northwest Highway. Because proof of ownership for Lot lB was not presented, the Board refused to hear any presentation with respect to Lot lB. The Board of Appeals voted 8-0 to deny the request. This case was referred to the Judiciary Committee for study and rec ommendat ion ~ Trustee Airey read the following report from the Board of Appeals re Case 80-lB: Zoning Case 60~3 REPORT BolGer AuGust 8, 1~50 President & Board of Trustees VillaGe of Mount Prospect Gentlemen: Case 60-lB, Hearing July 29, 1960 .Petitioner, John Bolder This petition is for the rezoning, from R-1 to R-B, of the property located at the northeast corner of Central Road and Main, The Board of Appeals voted B-O to grant the petition; one Board member disqualified himself and abstained from voting. Under the environmental circumstance which has developed, with a shopping center across the street, and fronting on a busy thoroughfare, it is the concensus of the Board that the rezoning for which Mr. Bolger has petitioned would be good zoning. Zoning Board of Appeals Re: Case 60-14, Joseph M. Munao Special Hearin~ July 15~ 1960 With reference to the above special meetin~ of the Board of Appeals, we are pleased to report that the entire case was settled without granting one variation. This was accomplished by reaching an agreement with the petitioner as follows: Relocate position of houses on Lots 39, 34, 32, 28 and 17 so as to build within all of the codes covered by zoning ordinance. As for the remainder of the lots, Nos. 1, 16, 18, 19 and B3, the Board of Appeals requested ~the petitioner to withdraw his request-for variations as the building plans were too extravagant for the lot dimensions. The question of variation when taken in groups of ten lots seemed to be warranted because of extreme hardship from the plot layout. H~wever, one member of the Board of Appeals insisted that each lot be studied individually, and the apparent hard~hip which seemed to have been a result of approved plot layout now showed up as self-imposed hardship. This, of course, does not warrant variations. We feel that this is important, because self-imposed hardships many times are concealed, and variations can easily be granted, with the ensuing result of weakening our codes. S/ N. L. Trapani President and Board of Trustees Village of Mount Prospect Gentlemen: Case 60-15 - Petitioner, Bennett Trapani This petition requests a variation to permit erection of a building for professional occupancy on property in the 200-block on West Prospect Avenue, which is zoned R-S. August 16, 1960 Trustee Airey read the following report from the Board of Appeals re Case 60-18: Zoning Case 60-16 REPORT Leo Delgado August 8, 1960 President and Board of Trustees Village of Mount Prospect Gentlemen: Case 60-16 - Hearing July 29th Petitioner - Leo R. Delgado This petition requests rezoning from R-1 to R-B of property on the south side of Prospect Avenue and the west side of Kenilworth between Thayer and Prospect Avenue. The Board voted 4-2 to grant this petition. There were mar~ objectors present. The property in question is bordered on the north by Prospect Avenue and the railroad; on the east by other property zoned R-S, and on the west by property zoned I-1. Kenilworth, presented supplement to a petition formerly presented protesting the rezoning of the property in question, in which it was stated that Kenilworth is not a fully paved street and could not handle the eEtra delivery traffic needed by such a home. NE. Delgado arose and said if the petition were granted he intended to pave this street. More protests were given vocally by homeowners in the area. President pro te~ Norris referred this ~atter to the Judiciary Committee for study and recommendation. Trustee Airey read the following report from the Board of Appeals re Case 60-1Y: Zoning Case 60-17 REPORT Wm. Wille August 15, 1960 President and Board of Trustees Village of Mount Prospect Gentlemen: Case 60-1Y - Eearin~ August 5, 1960 Petitioner: Wille Estate Representative: William A. Wille This petition involves property at 218. West Northwest Highway measurin~ approximately 1SO ft. frontage on the Highway and located to the northwest of the property now occupied by the Jewel Food Store. The area in question is now zoned I-1 Industrial, and at the present time is bein~ used as a trampoline installation catering to the public. The petition as publishe~ asks for a rezoning from I-1 to However, the petitioner changed from a request for rezoning to a request for variation upon present zoning. The Board therefore decide~ to consider the variation rather than the rezoning. The Board of Appeals vote~ 4-B to grant the variation. There were no objectors present at the meeting. If this variation is granted, it will not impair an adequate supply of light and air to adjacent property; increase the congestion in public streets unreasonably; increase the hazard of fire; endanger public safety; diminish or impair the values of property within surrounding areas, nor in any other espect impair the public health, safety, comforts, morals and welfare of the community. Trustee Gaw, seconded by Trustee Casterline, moved for the passage of proposed Ord. ~724: Ord. 724 AN ORDINANCE AUTHORIZING TP~ LEVY AND COLLECTION Tax levy OF TAXES FOR '~'H~ CORPORATE AND MUNICIPAL PURPOSES OF THE VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR BEGINNING MAY 1, 1960 AND ENDING APRII 30. 1961 The Board commended the Village Manager and Treasurer for their astute handling of funds, without resort to tax anticipation warrants during the period in which tax monies were held up. Whereupon the President pro tom declared the motion carried and Tax Levy Ordinance ~72~ passed° Trustee Norris read copy of letter from Consoer, Townsend & Associates to the Board of Education of High School District 214, in which it was stated that investigation of sewers in Randview Highlands Sewers showed heavy drainage from the school land to the west, overland into Randview Forest Avenue, and drainage from the football field tied into ;the Highlands Highland Avenue sewer. August ~, 1960 Board of Education Township High School District 214 Arlington Heights, Illinois As Village En~ineers for the Village of Mount Prospect, this office has recently been called on to make investi~atiuns into the recent basement floodin~ in the Ran~view Highland Subdivision which lies east of the Prospect High School. This Subdivisionwas developed by Brickman Home Builders and drains into the Highland Avenue trunk sewer, to which the High School made a connection for purposes of disposing of roof water and sanitary flow. At the time the sewer in Highland Avenue was designed by this office it was requested by your Body and your Architect that capacity ~n the sewer be provided for Ausust 1~, 1960 andview 2,000 gallons per minute for roof drainage and BOO gallons per Highlands minute for sanitary flow. It was agreed that any drainage from S~wers the 60-acre site, except roof water, would be conducted into the natural drainage outlet under Foundry Road at the north end of the property. These requirements and proposals by the School District were used as the basis of desi~nfor the Highland Avenue trunk sewer; that is, provisions for 2,000 gallons per minute of drainage and BOO gallons per minute for sanitary flow was made in establishing the size and capacity of the sewer in Highland Avenue. As a result of our investigations, we have found that the following situation now prevails with respect to drainage from your property: 1. The largest percentage of the southerly portion of the 80-acre tract has been graded in sucha way so that it drains overland into Forest Avenue without being intercepted bya sewer system and being conducted north as was originally proposed. This condition has caused a severe surface flooding condition in Forest Avenue in the vicinity of Highland Avenue. 2. It has been found that in addition to waters ~eaching the sewer from the High School ~oof that the drainage from the track and football field has been tied into this 21-inch sewer and is entering the Highland Avenue sewer. B. The present sewer from the High School is a 21-inch sewer laid at 0.90~ grade, which has an effective capacity of about ?,000 ~allons per minute, and far exceeds the original 2,BO0 gallons per minute figure used as the basis of design. As a result of the three factors described above, the sewer in Highland Avenue undergoes heavy overlo~ds durin~ periods of more than moderate rainfall, with resulting basement flooding, which has heretofore con- fined itself to homes in Forest Avenue, FairviewAvenue, Prospect Manor Avenue and Eastwood Avenue but could become a great deal more extensive if rainfalls heavier than those recently experienced occur. ~bser- rations of the sewer in Forest Avenue and Highland Avenue under even moderate rainfall conditions has revealed surcharge and overload occurring due to this excessive drainage. We have been request~dby the President and Board of Trustees of the Village of Mount Prospect to advise you of this very serious situation. In our opinion, it will be necessary to divert overland drainage from your tract out of the sewer in Highland Avenue and, further, to limit the discharge of the 21-inch sewer connection to the original design rate of 2,BO0 gallons per minute. We would be pleased to work with you and your Architect' to effect a solution to this problem. We are continuing to give study to this matter with views to possible solutions. We believe than an early meeting to discuss this matter would be advisable so that steps toward correction of this situation can be undertaken at the earliest date. Very truly yours~ S/William J. Country Club Trustee Norris read memo as follows: It now appears that the Terrace park area in Country Club Terrace has never formally been transferred 2nd Add'n to the Park District by. the ~illage. It is suggested that if it is Park Area the desire of the Board to do so, the Attorney be directed to pr~pare the necessary quit claim deed for the area, reserving the easement for the water main proposed to serve Country Club Terrace 2nd Addition. August 16, 1960 rustee Airey, seconded by Trustee Sch~aver, moved that the Village Country Club attorney be directed to prepare the necessary quit claim d~ed Terrace 2nd for the park area in question, reserving to the Village an easement Add'n for water main to serve Country Club Terrace Second Addition. Park Area Trustee Airey stated that it was the original intent that this area be used for park purposes and that it has been so maintained by the Park District from the time of its dedication. Whereupon the President pro tem declared the motion carried. Village Manager Appleby reported that a request had been made of the Oounty Zoning Board of Appeals on August 10th for a special use Count~ permitting a ~40.~acre trailer park on the east.si~e of Elmhurst Road Zouin~ about 1/4 mile north of Touhy (Docket ~7~) and that testimony indicated this world cause a serious problem for the schools. Furthermore, such a development could adversely affect the fire district. Trustee Schlaver, seconded by Trustee Airey, moved that the Board of Trustees file objection with the County Zonin~ Board.
