HomeMy WebLinkAbout04/24/1946 VB minutes • MINUTES OF AN ADJOURNED REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES, HELD IN THE VILLAGE HALL, MOUNT PROSPECT, ILLINOIS, ON THE 24TH DAY OF APRIL, 1946 A.D. President Pendleton called the meeting to order at 8:15 P.M., and upon calling of the roll, the following Trustees responded: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. ' The following appointment by the President was then. read: Honorable Board of Trustees Village of Mount Prospect, Mount Prospect, I11. Gentlemen: AL To fill the vacancy in the office of Village Treasurer and Collector occasioned by the resignation of Mr. Fred Wille, I hereby appoint Mr. Dougald L. Gilbert, 303 S. Wille St. as Village Treasurer and Collector for a period of one year starting May first, 1946, at a salary of $210.00 dollars per month, and respectfully request the concurrence of this honorable board in this appointment. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax, ani Walsh_ No naves. n 24. 194E Revised plans for water main extensions in Lonnquist Gardens 5 were referred to the water committee on a motion by Trustee Welsh and second of Trustee Lams. Motion carried. A motion was made by Trustee Wax and seconded by Trustee Welsh that plans and specifications for sewer extensions in Castle Heights lst- Addition, to be constructed by Briar -Crest Homes, Inc. be referred to the Health and Drainage Committee. Motion carried. The following agreement was then read: A G R E E M E N T e , This agreement made and entered into this 24th day of April, A.D. 1946, by and between THE VILLAGE OF MOUNT PROSPECT, a municipal corporation, party of the first part and hereinafter referred to as the "Village ", and SOFT WATER SERVICE, INC., an Illinois corporation, party of the second part, hereinafter referred to as "Corporation ", WITNESSETH: WHEREAS the said corporation has made application to the Village for a supply of water, not exceeding 500,000 gallons per month, to be used in its business and has indicated a desire to copperate with the Village in that regard and has agreed to abide by all applicable ordinances; and WHEREAS the Village is willing to furnish water to said corporation in an amount not exceeding 500,000 gallons per month, at rates as set forth in the ordinances of said Village; now, therefore; 1 . In consideration of the sum of One Dollar in hand paid by each to the other and in further consideration of the covenants and agreements and -.- premises herein, it is agreed as follows: .cr' 1. The Village of Mt. Prospect hereby agrees to furnish water service to the Soft Water Service, Inc., in an amount not exceeding 500,000 gallons per month as needed at rates designated by the ordinances of the Village, insofar as it will not jeopardize the residents of the Village during any emergency, as hereinafter stated. PPm 2. The Soft Water Service, Inc. agrees to buy and pay for water service in an amount not exceeding 500,000 gallons per month at such rates and upon such terms and conditions as set forth in the ordinances of the Village of Mt. Prospect. 3. It is mutually agreed that the Village may discontinue and cut- off water service during the period when, (a) for any reason, the new well is not operative; (b) in the opinion of the Fire Chief, a fire requires the use of all available water supply; and (c) by a resolution of a majority of the Village Board during any emergency which would jeopardize the health and welfare of the residents of the Village of Mt. Prospect. 4. The Soft Water Service, Inc., hereby agrees to hold harmless the Village of Mt. Prospect for the discontinuance of water supply ocassioned by any or all of the foregoing conditions hereinabove set forth; and under- stands and agrees to the execution of this contract subject to such pro- visions. . IN WITNESS WHEREOF the Village of Mount Prospect, a municipal cor- poration, has caused these presents to be signed by its President and attested to by its Clerk who affixes hereto the official seal; and the Soft Water Service, Inc., an Illinois corporation, has caused these presents to be signed by its President and attested to by its Secretary who affixes the corporate seal hereto, all on the day and year first above written. c! ..,, VILLAGE OF MOUNT PROSPECT, a Attest: municipal corporation _ By Clerk President . Attest: BY Secretary President ` THIS AGREEMENT EXECUTED IN DUPLICATE It was moved by Trustee Wax and seconded by Trustee Kirchhoff that the Presi- dent and Clerk be authorized to enter into the above agreement. Ayes: Hartwig, Kirchhoff; Lams, Mott, Wax and Welsh. No nayes. Appil 24, 1946 It was moved by Trustee Mott, seconded by Trustee Wax that Mr. Albert L. Roderick be hired to make the audit of the Village books and records for the year ending April 30, 1946, as per his proposal dated April 1, 1946. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. A motion was made by Trustee Welsh and seconded by Trustee Lams that Moehling'sPlat of Pleasantdale Subdivision be referred to the Plan Commission for recommendation. Motion carried. A petition to change the name of Hi -Lusi Avenue from Elmhurst Street to Ma -Na -Wa Trail in the South end of the Prospect Park Country Club Subdivision,to Hiawatha Trail,was referred to the Plan Commission on a motion made by Trustee Welsh and second of Trustee Wax. Motion carried. A "RESOLUTION TO FORECLOSE THE LIEN OF SPECIAL ASSESSMENTS NO. 11 -46" was then read. It was moved by Trustee Welsh, seconded by Trustee Lams that the resolution be passed. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. There being no further business to come before this meeting, it was moved by Trustee Welsh, and seconded by Trustee Mott that the meeting be adjourned. Motion carried. • '^ _
