Trustee Phillips, seconded by Trustee Casterline, moved that Street Dep~ the Village enter into a rental purchase agreement with Dahl Equipment trucks Co. for an Oliver 770 Gas Tractor equipped with Parsons 15' backhoe and 24" bucket and an L M self-leveling loader, and with torque converter and power shift clutches, for a period of 30 months at $268 per month, it being understood thatshould the Village exercise its purchase option before the end of 30 months it will be entitled to a rebate of interest on all outstanding lease payments at the time of purchase. Police Trustee Bickley save report for the Police Department, thanking Dept. the newspapers for their co-operation and the policemen~for their volunteer patrolling on off-duty hours; stating that there were seven burglaries in November and only Two so far this month. Trustee Bickley also reported that the p~lice trainln~ lectures hsve been very well attended, that the next one will be given on January 21st by the County Sheriff. Further, that the auxiliary police of Elk Grove Village have asked permission To attend; President Schlaver said that this group is eligible and welcome. December 18, 1962 Trustee Bickley, seconded by Trustee Bruhl, moved that ordinance amendment be drafted by the Village Attorney to set a traffic 2-hour limit on parking on South Maple Street between Prospect and Parking on Lincoln Avenues. This motion camrled by acclamation. So Maple TrusTee Bickley read the test scores of three candidates for Police - lieutenant, stating that all were vemy close; Sgts. Fred Hedlund, tests fdr Newell Esmond and John Homola. He further explained that if these lieutenant candidates cared to have their military service points added to their scores, they could be used once. The Board of Trustees does not select the officers, this is done by the Police & Fire Commission. Trustee Ekren, seconded by Trustee Bicktey, moved for the passage of Ord. 886: Ord. #886 Rezoning of REZONING OF DI gUCCI PROPERTY IN ELK GROVE Di Mucci's TOWNSHIP AS RA, B-8, and R-4 AS SET. Trustee Ekren, seconded by Trustee Bickley, moved for the passage of Ord. #887: Ord. #887 Rezoning to AN ORDINANCE REZONING PROPERTY AT THE SOUTHWEST R-4 CORNER OF PROSPECT g WILLIAM STREET FROM Case 62-34 I-1 TO R-4, This refers to Zoning Case 62-34. Upon roll call: Ayes: Bruhl Bickley Ekren Casterline Phillips Absent: Gaw Motion carried. Trustee Ek~en read .the following report from the Board of Appeals: Zoning Re: Case 62-38g heard November 30, 1962. Case 62-38 Petitioner: Trade Service Publications, Inc. Trade Service This petition is for a variation to allow a 10-foot rear yard Publication setback of a parcel of I-1 property on the southwest corner of Edward and Prospect Avenue. The zoning ordinance allows a 10-foot rear yard setback except where it abuts residential property, and then it must be 30 feet. The rear of this property is against a 20-foot public alley, and on the other side ~f the slley are apartments. The Zoning Board of Appeals found: 1.That a hardship exists due to the angular shape of the lot. 2. To use this property without this variation is impractical. 3.The variation will not alter the characteristics of the neighborhood. 4.The variation will not contradict the intent of the zoning ordinance. There were no objectors present. The Zoning Board voted 5-0 to recommend the granting of this variation with the following conditions: 1. Construction must be started within one year. December 18,~ 1962 2. Plans used for building permit and location of the building must be the same as introduced in testi- mony before the Board of Appeals. E. P. Martin~ Chairman Daniel Congreve, Acting Secretary Trustee Ekre~ then read the following memo from the Board of Appeals Zoning re Zoning Case 62-38: Case 62-38 The requested variation is for.a ten-foot rear yard setback instead~of the required 30 feet, of a parcel of I-1 land on the south- west corner of Edward and Prospect. The ordinance states that rear yard setback of I-1 property must be 10 feet except where it abuts residential properTy~ when it must be 30 feet. In this case~ there is still a $0-foot separation because of the 20-foot alley behind this property. There were no objectors to this petition presenT. The Board voted 5-0 to recommend the variation. Martin~ Chairman Daniel Congreve~ Acting Sec'y Trustee Ekren~ seconded by Trustee Bickley, moved that the Board of Trustees concur ~n the recommendation of the Zoning Board and that the Village Attorney be directed to prepare ordinance allowing this variation. Manager Appleby reported that sales tax revenue for Sales Tax September showed a considerable increase over previous average; $25,786,96 for September. Finance Director King stated that several firms had failed to repomt their Mount Prospect portion of sales but that we would be getting their figures shortly. Mm. Appleby also Civil reported that on December 6th, Mount Prospect was re-accredited by the Defense Civil Defense Agency. Village Manager Appleby reported regarding the County County Zoning hearin~ of December 12th, explaining that the application for Zonin~ cocktail lounge at Church Road and Demp~s~er had been withdrawn in the face of objections from United Aim Lines and others. The petitioner requested permission To change his application ~o R-6 zoning (apamtments). Attmm~y Hofert also explained that this change in application had been agreed upon by the attorneys rom United Air Lines and for the petitioner, and was not known until brought out in the hearing. The attorney for ArlingTon Heights objected to multiple housing; we pesemved judgement until the ma,%er was explained at this meeting; further~ theme is some question under the Illinois law as to whether the mile and a half ~urisdiction applies to any municipality within the limit or only the neares~ one. The Board decided To consider this mat~em and ~ive opinion early in January. Trustee Ekmen~ seconded by Trustee Casterline, moved that Annexation the Village President and Clerk be authorized to Sign the plats of plats annexation accompanying Ordinances 882 and 883 annexed on December ~th. December 18~ 1962 Trustee Ekren read letter of December 18th from Mr. Allan $erafine Bloch, attorney for the Serafine interests, and indicated that property agreements would 'be drawn up regarding water, sewer, paving, etc. satisfactory to both parties. R~garding property north of Central Rd. along Westgate Road. Zonin~ Trustee Ekren, seconded by Trustee Bruhl, moved that the Village Case 62-22 Attorney be directed to prepare an ordinance rezoning property described in Zoning Case 62-22 fro~ B-1 to R-4~ and that all covenants be incorporated into this ordinance. President Schlaver read letter of December 18th sent to the Weller Creek Metropolitan Sanitary District, duplicated at the end of these minutes, in regard to the Weller Creak Flood and Pollution Problem. President Schlaver made proclamation regarding Christmas Holiday Safety Campaign, duplicated at the end of these minutes. Trustee Casterline, seconded by Trustee Bruhl, moved that the Signs Village Attorney be authorized and directed to prepare code amendments under Chap. 21, Art. IV, ~7, under "B" of 21.401 and Sign Section 9.301 of the Code, to provide that it shall be unlawful to erect a sign structure or equipment within 8 feet in any direction of any line con- ductors, service drops or power lines; further, that this shall not restrict the furnishing of electricity ro users. This motion carried by acclamation. President Schlaver thanked the Board and people attending the regular Board meetings for their co-opemation of the past year. Trustee Phillips, seconded by Trustee Bruhl, moved that the next meeting of the Board be held on Wednesday, January 2nd, inasmuch as New Years Day falls on a Tuesday. This motion carried by acclamation. The Board adjourned the meeting by acclamation at 9:37 P.M. Respectfully submitted, Village Clerk ~RES~DENT'S PROCLAMATION FOR 1962 CHRISTMAS HOLIDAY SAFETY CAMPAIGN Proclamation Safety WHEREAS the Natlon~l Safety Council is conducting a campaign to Campaign reduce the annual Christmas season accident toll which last year reached a total of 180 lives lost and 9169 injured during the month of December in Illinois, and WHEREAS the National Committee of Religious Leaders for Safety has asked all religious and civic leaders to co-operate in an all-out campaign to pmevent tragedy on the highways and in the homes of our country, and WHEREAS Illinois will conduct a Christmas campaign, which will demonstrate that man is literally his brother's keeper; THEREFORE, as President of this Village, I do hereby, on behalf of the citizenry of Mount Prospect, declare enthusiastic participation in the 1962 Christmas Holiday Safety Campaign and wish to call upon the people of our Village To join in the effort to meduce accidents during this year's Christmas - New Year's holidays. December 18, 1962 I therefore urge every citizen to be especially thougtful of the rights of his neighbor, and on the Streets and highways, to drive by the golden rule, to set a good example for other drlvers~ to observe all traffic laws~ and not to drive after drinking during the holiday season. Schlaver Village President Letter from President Schlaver to Sanitary, pi~tF~ct,,r~, Weller Creek December 18, 1962 President and Board of Trustees Metropolitan Sanitar~ District of Greater Chicago 100 East Erie Street Chicago, Illinois Attention: Mr. Frank Chesrow, President Gentlemen: Re: Weller Creek Flood and Pollution Problem ~D t~e..y~in~tz pi Mount Prosaic? The Village of Mount Prospect respectfully requests that the President and Board of Trustees of the Metropolitan Sanitary District of Greater Chicago hold a public hearing on the question of the effect of the proposed additional ten by ten foot Storm sewer dbaln planned by Arlington Heights on the residents of the Village and nearby areas. The Village has submitted to the engineers of the Sanitary District an engineering Study prepared by the firm of Greeley & Hansen, which sh6wssthat the proposed ten foot sewer will flood portions of Mount Prospect and other land of its downstream neighbor City of Des Plaines. The seriousness of this problem is know~n to Trustee Walter Baltis and Sanitary District Engineers. Sanitary District Trustee Baltis has repreatedly warned all parties concerned that flooding will ensue whe~ this new sewer has been completed. We recommend that his conclusions on the Weller Creek problem be reviewed and that action be takRn to improve Weller Creek so that it can accept the additional flooding. It is well known to the engineers that the Arlington Heights engineering plans was predicated on the projected size of Weller Creek as contemplated by the Waterways Department of the State of. Illinois~ and not on the present size. Until the contemplated plan is completely executed~ flooding will of necessity mesult. It is not the purpose of the Village of Mount Prospect to block the Arlington Heights project, since we are sympathetic with the problems which they have, but rather to seek an ultimate solution to the overall problem. We should not jeopardize the homes of hundres of people and their health unless and until a complete and thorough exploration of the problem has been made. Delay at this critical juncture until an overall solution can be worked out is what is required. Further, the Metropollt~n Sanitary District or. Greater Chicago, as owner of the sanitary sewers in Mount' Prospect, will suffer serious criticism along with the elected officlats when flooding of these homes occur. The Sanltary District must also bear in mind that the health and public safety of the citizens i~olved may be endangered because during storm periods sanitary effluent is mixed with storm water. Neither the Sanitary District nor the officials of Mount Prospect and Des Plaines can stand by now when our engineers Greeley 6 Hansen have warned us of the dangers and have given us proof through an engineering survey that these dangers exist.
