November 6, 1962 garbage Trustee Bruhl explained that he inquired of Barrlngton Trucking Co. why garbage can lids were not replaced after the cans were emptied, and received a reply by letter signed by Peter Vender- veld, Vice President, that replacement of lids requires an extra hour per day, or 12 i/2% loss in efficiency, and would require additional costs to each homeowner in the amount of 16¢ per month. Further~ the lids blow away just as easily from an empty can as when placed on the ground. Mr. Vanderveld suggested attachment of spring type lid fastener which holds the lid tO the side of the can when removed. _ leu B u h ann Trustee Ekren broughtup the subject of hiring of Tech Search, gene a g m V . Mr. Appleby reported that Mr. Baughmann or ec earc . . ontract has met with Mr. McCoy of Brickman Builders and that Mr. Baughmann will be able to give a first report during the week of November lgth. Trustee Ekren then read a pomtlon of the contract between Mr. Baughmann and the Village: "...we respectfully propose to furnish the following services (re area east of Randhurst): 1. Feasibility studies relating to annexation. 2. Technical assistance for Judiciary Committee and Board of Trustees and correlation of technical matters with the guidance of the Village Attorney in the preparation of new zoning classifications and procedures for density zoning and bulk standards related to "planned development" characteristic of multiple family structures inherent with needs incidental to the Randhurst area. 3. Conferences with Village officials, attorney, and representatives of the land developers and property owners incidental to pre- annexation planning and zoning hearings. 4. If necessary~ the preparation of alternate design studies to set forth the general goals of both the Village officials and land developers. The services under items numbePed 1 to 3 inclusive above will be performed for a minimum fee of $1,500 and a maximum fee not to exceed $6,000 with said fee to be determined by the number of meetings and cost of services in accordance with standard hourly rates for members of the staff of our office, plus an allowance for overhead and expenses. (...estimate of time, between one and three months), "A retainer of $1,000 would be due and payable upon the billing of the Village within two weeks after the work has commenced, to cover the original costs of preliminary surveys and conferences and the remainder of the fee will be billed as the work proceeds in accordance with the work schedule. "In the event alternate designs are requlred u~der the provisions of Item 4 the fee for design services will be based upon number of acres involved and the Village will be given a general estimate of the fee required at the time the services are requested, "The above maximum cost estimates are based upon a general estimate of the amount of work required and in ~he event cost of services is lower than maximum amount, the Village will benefit from said lower figure, If, however, the services appear to exceed the maximum amount within two months from the date of authorization, the Village will be notified of the conditions warrnating additional fees at least one month in advance of said requirements." Trustee Ekren read the following report from the Zoning Board re Zoning Case 62-32: Zoning Case 62-32 R E P O R T Car wash as a Special Use November 1, 1962 in B-3 zoning To: Board of Trustees From: Board of Appeals Re: Case 62-32, heard October 26, 1962 Petitioner: Village of Mount Prospect The petition is for the amendment of Section 7.3 of the Zoning Ordinance Paragraph 3 to read as follows: 3. Retail business and retail service establi§hments, except uses 2 to 13 inclusive of Section 8 and except auto laundries, which shall be permitted as a special use only. There were no objectors present. The Zoning Board of Appeals voted 5-0 to approve the amendment to the Zoning Ordinance. E. F. Martin, Chairman M. G. Young, Acting Secretary Trustee Ekren, seconded by Trustee Gaw, moved that the Board concur with the recommendation of the Zoning Board to approve this amendment and that the Village Attorney be authorized to prepare the necessary ordinance. TrusTee Ekren read the following report re Case 62-29 as follows~ Zoning Case REPORT 62-29 Fred Maier October 9~ 1962 To: Board of Trustees From: Zoning Board of Appeals Re:Cass 62-29, heard September 28, 1962 Petitioner: Fred W. Maier The petition is for a rezoning from R-1 to B-2 of Lot 11 located on the northwest corner of Elmhurst and Golf Roads. Three legal objectors were present; two, owning lots 10 and 12, objected to the petition and the third property owner, owner of Lot 13, was in favor of the petition provided that petitioner improved the lot in question as petitioner so stated in the testimony, The Zoning Board voted 5-0 to approve petition. E. F. Martin, Chairman 2. E. Jacobsmeyer, Acting Sec'y Trustee Ekren then stated he desired to read the memorandum from the Zoning Board in this case ~o give better explanation of this approval. November 6, 1962 oning Case M E~M 0 R A N D U?~M' 62-29 Maier The property concerned in the petition is Lot 11 located on the northwest co~ner of Elmhurst and Golf Roads, consisting of approxi- mately 28,000 square feet, with 188 feet fronting on Elmhurst Road and 190 feet fronting on Golf Road. Property to north and west is occupied with single family residences; the property immediately to the east is vacant land (across Rte. 83) owned by the Village, followed by single family residences; property to south and southeast is commercial and is and/or will be gas stations and shopping centers. Petitioner, represented by counsel, stated that he wants to erect a one-story building of 5,376 square feet to be designed for a medical center with 10 suites; provide paved off-street parking to the north of the building of 8,800 sq, ft. for 25 cars; a fence to the north and west of the property; lighting that w~uld be adequate and reasonable; R-1 type setbacks with attractive landscaping. Petitioner presented an architect's rendering showing these improvements and entered into the record as Exhibit #2 and made an integral part of this petition. Petitioner presented a real estate broker and an architect to support his case. The property owner to the west,, a legal objector, objected to the rezoning for the following reasons:. This would be spot zoning; he is now bothered with the gas station to the s~th of his home; the lot in the petition could he used for the erection of a single family residence and is, in fact, large enough for two homes; there is only R-1 zoning on the north side of Golf Road for 2.1 miles. This would be the only deviation from R-1 for this stretch of 2.1 miles; this could mean parking problems on Ioka and affect his home; owner of lot in question could have built homes on this lot if he hadn't delayed. The property owner to the northwest, a legal objector, would be in favoror rezoning as proposed provided that assurance could be given that the improvements to the property would be made substantially as stated by the petitioner, his counsel and architect. The property owner to the north, a legal objector, objected to a zoning of this lot to anything other than R-1. The Zoning Board, in its discussion, realized that the passing of time has changed the usage of land in this area. The lot in question faces on two heavily traveled roads. Land directlyto the south and southeast is commercial and the two Southern corners at this intersection are now being used for gas stations. Possibly in 1963 or 1969 the vacant land now zoned commercial and directly to the south of the lot in question will be improved with the proposed shopping center and a petition at that time for a B-3 zoning would probably receive strong support from the courts. A gas station, at that time, or some other type of retail operation would be a logical and economic use of the land. The Zoning Board felt that, although the land could be used for a single family residence, it is highly improbable. Therefore, the problem facing the. abutting property owners, residents of the neighborhood and the Village is to have this land used for a development that would bemost desirable for the Village based upon the assumption that the land is not suitable for R-~; The presentation of the petitioner and his representations as to his planS, if his petition is favorably received, wasof considerable interest to the Zoning Board. The objections of the property owners were well presented and very carefully considered by the Board. However, in the opinion of the Board, the advantages of the proposal of the petitioner were sufficient in value to the residents and to the VillaKe that the Board voted 5-0 to approve the petition. Nover~er 6, 1962 The Zoning Board, however, wishes s copy of this report filed Zoning Case with the Building Department together with Exhibit #2 submitted by the 62-29 petitioner and suggests to the Buildng Department that they apprise Maier themselves of the representations of the petitioner, his counsel and architect as set forth in the co ~t Peporter's transcript in order that the Building Department can assure themselves and the Village and the residents that the improvements to this property will be constructed in accordance with the representations so stated by the petitioner, his counsel and architect. Trustee Ekren explained that the Judiciary Committee had met with the homeowners in this area and discussed the sit ~tion, and they were not overly opposed to the zoning. Trustee Ekren read the following letter from the Plan Commission: Street dedi- November 6, 1962 cation - 2 1/2' strip Gentlemen: on South Maple - Th~ Plan Commission to whom was referred the plat of dedication Boesche of 2 1/2' along the east side of Maple Street from Prospect Avenue south approximately 251', recommends that the plat of dedication be accepted. Appleby, Secretary PLAN COMMISSION Trustee Ekren, seconded by Trustee Phillips, moved that the President and Cterk be authorized to sign plat of dedication of 2'5" on South Maple Street, property belonging to Mr. Arthur Boesche. Upon roll call: Ayes: Phillips Ekren Gaw Bruhl Absent: Bickley g Casterline Motion carried. President Schlaver commended Mr. Boesche for his co-operation with the Village in ded~catzng this strip of land. Trustee Ekren read the following letter: Streez dedication around Lions Park November 6, 1962 Gentlemen: The Plan Commission to whom was referred the plat of dedication of streets around Lions Park recommends that the plat of dedication be accepted. Appleby, Secretary PLAN COMMISSION November 6, 1962 Street Trustee Ekren, seconded by Trustee Phillips, moved that the Board dedication approve plat of dedlc~fion of one half street by the Park Board Lions Park around Lions Park; the west half of School Street, north half of Shabonee, west half of William and s~uth half of Lincoln, and that the President and Clerk sign this plat on behalf of the Village. Upon roll call: Ayes: Bmnhl Ekren Gaw Phillips Absent: Bickley and Casterllne Motion carried. President Schlaver commended the Park District for this street dedi- cation, stating that it will be of great benefit to the Park District as well as the residents, and thanking the Park Board for taking the first step toward improvement of these streets. County Manager Appleby gave written report re County Zoning Docket 413 zoning in regard to addition to dog kennel. The Board decided to give no objection to this petition. Street salt Mr. Appleby reported that he checked on the prices of salt for other mumicipalities and found that all the towns, from Palatine to Park Ridge, were paying the same price as Mount Prospect. County Mr. Appleby reported he had received letter from the Bermant zoning Management (who built Mount Prospect Plaza Shopping Center at Rand Road and Central) asking the Board to object to zoning appeal for 23-acre shopping center near NoDthbrook. Inasmuch as this is outside the mile-and-a-half limit, the Board agreed that the Village had no authority to object. Colonial Hts. Trustee Gaw, seconded by Trustee Phillips, moved that appli- sewers cation for sewer connection by Colonial Heights Unit ~ to the Metropolitan Sanitary District system be signed. This motion carried by acclamation. This application is also signed by Neal Hun~er O~ ~-~ Colonial Heights and the Cook County Water Company. Colonial Hts. Trustee Ekren, seconded by Trustee Bruhl, moved that plat of 5th Add'n Colonial Heights Fifth Addition be referred to the Plan Commission for study and recmmmendation. This motion carried by acclamation. Presidents President Schlaver reported that the Library Addition was open report and in use; that Baskin's had opened a branch store in Randhurst, and that as Village President he had turned a shovel of earth in commemo- ration of the building of a 1500-seat theater next to Thunderbird Bowl~ on Rand Road. Attorney Hofert reported that the Village was now involved in Klein Bldrs a suit regarding the zoning of the Klein property in We Go Park on the We Go Park s~uth side of Central Road. This area is zoned residential and appeal for I-1 zoning was refused nearly two years ago. Trustee Bruhl, seconded by Trustee Gaw, moved that the Attorney be authorized to defend the village in the above-mentioned suit. Police Chief Whittenberg arose and reported that the Suburban Police display at Randhurst was very well attended during November 1, 2 and 3. Chief Haberkamp of the Fire Department stated that he had been approached to hold the same type of display for the PiPe Department some time after the first of the year. annexations Trustee Ekren reported that he has reque§ts for annexation Q~ several small plats that are not necessarily at this time contiguous to Village; it was his thought that the use of professional planning help for over-all plan might be of benefit to the Village. Trustee Ekren asked permission for the Judiciary Committee to investigate cost of such service and the President granted this request. Adjournment by acclcmation at 9:28 P.M. November 6, 1962
