HomeMy WebLinkAbout02/07/1961 VB minutes MINUTES OF REGULAR MEETING OF THE BOARD OF TRUSTEES HELD IN THE MUNICIPAL BUILDING ON FEBRUARY 7, 1961 President Lams called the meeting to order at 8:21 P.M. with roll call the following trustees present: Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Trustee Casterline, seconded by Trustee Norris, moved that the minutes minutes of the previous meeting of january 24th be approved as submitted. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Mr. Douglas Carney, superintendent of the Building Department, Bldg. Dept. was awarded a certificate by Mr. Appleby for completion of Techniques D. Carney of Mun~ipal Administration course offered by I.C.M.A. The Board gave recognition to this achievement. Trustee Gaw, seconded by Trustee Ekren, moved that the following bills for the week of February ?th be approved as follows: General $21,279.01 bills Garbage 5,796.82 Park. System Revenue 919.05 Library 763.83 Water, operation a,928.16 Water, bond & interest 99?.50 $34,684.07 The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Trustee Gaw, seconded by Trustee Casterline, moved to advance temporarily the amount of $54.45 from the General Fund to Memory Lan~ advance and other streets special assessment for payment of the following funds invoices: Ability Ad Co. Whereupon the President declared the motion carried. Trustee Airey announced that Zoning Case 61-1, petition for Zoning Case car wash on East Prospect Avenue, had been withdrawn at the request 61-1 of the petitioner. Trustee Airey reported that Zoning Case 61-3, Doyno, the Zoning Case petitioner had not been able to appear but would appear at the next 61-3 Zoning Board meeting. Trustee Airey read the following report from the Zoning Board Zoning Case re Case 61-4, Zenith Radio Corp.~ heard January 2?th: 61-4 REPORT Feb. 1, 1961 Board of Trustees Village of Mount Prospect Gentlemen: Re: Case 61-4 - Zenith Radio Corp. Rand & C_~entral Rds~_- January 27, 1961 Through its attorney~ G. F. Slett~land, the petitioner requested a rezoning from R-1 to B-3 of property at Central and Rand Roads. This property is now occupied by a single-family residence and the radio towers. February 7, 1961 Zon~n~RCase 61-4 Zenith There were no objectors pressflt. The Board of Appeals voted 6-0 to deny the petition. Eugene F. Martin, Chairman Malcolm G. Young, Acting Sec. This case was referred to the Judiciary Committee. Trustee Airey read the following report from the Zoning Zoning Case Board re Case 61-5, petition of Village to'delete watchman's quarters 61-5 from Industrial Zoning: Zoning Ord. REPORT February 1, 1961 Board of Trustees Village of Mount Prospect Gentleme~ Re: Case 61-5 - Village.of Mount Prospect Hearing held on January 27, 1961 This petition refers to amending the present Zoning Ordinance to exclude residential units within the Industrial Classification. There were no objectors present. The Board of Appeals voted 6-0 to grant the petition. Eugene F. Martin, Chairman Malcolm G. Young, Acting Sec'y Trustee Airey, seconded by Trustee Ekren, moved that the Board of Trustees concur in the recommendation of the Board of Appeals and that the Village Attorney be authorized to prepare the necessary documents. The President put the question, the Clerk called the roll, ~- with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Morris and Schlaver. Whereupon the President declared the motion carried. Trustee Airey read the followim~ report from the Zoning Board Zoning Case re Case 61-6, petition of Village to delete certain commercial 61-6 residential uses from R zoning and te insert same into B zoning. Zoning ord. REPORT Feb. 1, 1961 Board of Trustees 'Village of Mount Prospect Gentlemen: Re: Case 61-6 - Village of Mount Prospect Hearing held on January 27~ 1961 This petition is in regard to an amendment to the Village Zoning Ordinance to delete certain classifications of use from the R-B District and to add such classifications to the B-2 District. There were no objectors present. The Board of~Appeats voted 6-0 to deny the petition. Eugene F. Martin, Chairman Malcolm G. Young, Acting Sec'~ Trustee Airey then read the accompanying memo: MEMORANDUM Feb. 1, 1961 To: Board of Trustees Re: Case 61-6 - Village of Mount Prospect This case involves an amendment to the Zoning Ordinance to delete from the R-3 District certain classifications of use, such as hospitals, orphanages, old peoples' homes, etc., and to add such classi- fications to the B-2 District. February ?, 1961 The conse~us of the Board of Appeals may be represented Zoning Case as follows: 61-6 1. This Boa~md strongly endorses the proposal to delete from the H-$ District the~lassificaticns of use described. Such deletion should serve to preserve properly the character of the R-B District. 2. The Zoning Ordinance has lately been amended to exclude residential use from "B" and "I" districts. Because the use classifi- cations described in the first paragraph can be claimed to have aspects of residential use, it now seems most incongruous to add them to classification. B. This Board feels that~the presence of such uses in "B" District would eventually affect the "B" district in an adverse manner, by changing its intended character. The above considerations have prompted this Board to propose the creation of a new district for uses of the nature described. Such a district conceivably, could be so located as to run as a Buffer zone without unduly affecting the character of abutting districts. Because of such thinking, the Board decided to vote 6-0 to deny the petition. Eugene F. Martin, Chairman Malcolm G. Young, Acting Sec'y This matter was referred to the Judiciary Committee. Trustee Airey, seconded by Trustee Norris, moved that Chapter III, Paragraph 5 of the Building Code should be amended to read as follows (additions are underlined): Building Code changes "No permits shall be issued for the erection of buildings ~'- for habitation on any lot or parcel of land within the Village of Mount Prospect unless a highway, road, or street or way for public service facilities improved with ~aaVemen~, water mains and sanitary sewers meeting. Village tigns is provided to serve said lot or parcel of land." and that the Village Attorney be authorized to prepare the necessary amendment. The President put the quest~n, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Trustee Casterline gave Chief Whittenberg's recommendation re proposed Yield Right-of-Way sign at Milburn and Emerson (min. of Jan.lO) Traffic "In my opinion we do not need Yield Right-ofWay signs at this intersection. Vehicle on the left should yield automatically to vehicle on the right, the same as at other unmarked intersections." Trustee Casterline, seconded by Trustee Gaw, then moved that the Village Manager inform Mr. John Courselle, 117 South Maple, that the Board concurred in Chief Whittenbeng's recommendation and that it was the feeling of the Committee that no signs should be erected unless absolutely necessary. This motion carried by acclamation. Trustee Casterline referred to letter from Mr. Tuthill of the Traffic Highway Division regarding !proposed 4-way stop signs at Northwest Highway and Mount Prospect Road, in which Mr. Tuthill stated that "In view of the heavy traffic on Northwest Highway, it is impossible for this Department to agree to your request for the installation of 4-way stop control at this location". The Board directed Mr. Appleby to request clarification of this view from Mr. Tuthill in light of the fact that stop signs were erected at Northwest Highway and Central Road before electric signals were installed. MOUNT~R~SPECT COMMUNITY ACHIEVEMENT ASSOCIATION - (Representatives of Mount P~ospect Civic Organizations) Beautification of Village January 21, 1961 Mr. Theodore A. Lams, Village President Mount Prospect, Illinois Dear Mr. Lame: As you know, the Mt. Prospect Community Achievement Asso- ciation hasbegun work on the cleaning up and beautification of Mt. Prospect. With the co-oPe~ation of various Girl Scout Tro~ps and Campfire Groups weeds were pulled, flowers planted, and some debris cleared out. The Association is now interested in establishing a Home Clean-up Week early in May. We would like to include the clean up of all vacant lots in this'project. We would like the Village to be responsible for the collecting and disposing of all the debris put out fromthe homes and the vacant lots. The Association has been working with Charles Klehm & Son Nursery to establish a good working plan for the beautification of Mt. Prospect. We feel that a workable plan has been achieved. It is the thought of Mr. Klehm and the Association tb~t it would be prudent at this time to establish a certain planting for which Mt. Prospect could become well known. In the opinion of the planning ffroup the Washington Hawthorne tree could be used for this purpose. The financing of this project would be by the Mount Prospect Community Achievement Association. However, after the planting was accomplished the Association would like to turn this over to the Village to be maintained by the Village. Charles Klehm & Son Nursery has given us the following proposal: "We propose to furnish and plant in the Village of Mount Prospect the follow~ng material with a full 1-year guarantee of gr~th, provided it is not damaged by ~ehicles or other forces outside of our control, such as storms, etc., and provided the plants are not disturbed or pulled out by other individuals: B Red leaft plum, 5-6', placed near telephone poles on parkway at railroad station. B Barberry replacement in hedge along highway. Move some barberry southeast corner of Main at Northwest Hwy. 16 Pfitzers 48" lefthand side parking area off 83 & Main near RR tracks. Spray Triox around rear set of control posts. Plant polygonum (ground cover~ in area 200 ft. long and l0 ft. wide with 2 ft. spacing. 25 Spirea Frobelli planted back of control box. Landscape with Euonymous around B fences of bhe depot. 24 Flowering crab on south side of tracks, Main to Pine, 6-7' size. lB2 Washington Hawthorne planted from Central Road to Mt. Prospect Road spaced approximately 2 between each pair of telephor~ posts." The ~ssociation would again plant petunias on the parkway as was done last spring. February 7, 1961 We would appreciate your co-operation on these projects. Village We hope that after studying them you will be able to sanction these Beautification projects as we have outlined them to you. We weuld appreciate hearing cont'd from you very soon, since it is imperative that we put these projects into motion very soon if they are to be accomplished this spring. Very sincerely, s/ Mrs. Newell Esmond, Chairman Trustee Gaw then gave the following report from the 'l~blic Buildilngs & Grounds Committee regarding the foregoing proposal: REPORT January 31, 1981 To: The Village Board From: Arthur J. Gaw, Lloyd Norris, Richard Airey Mrs. Newell Esmond's request for permission to plant trees along the Northwest Highway was discussed by the committee on public buildings and grounds. The following is the result of our discussion: On the south side, the railroad right-of-way comes to the curb; on the north side, the railroad right-of-way meets the state highway right-of-way. The Village has no jurisdiction in either of these areas. It might be suggested that as a part of their project they should assign this to a committee of two or three to contact the railroad for approval and recommendation. At the Northwestern Railroad is the division engineer, Mr. Smith, and he is locatedin Milwaukee, Wisconsin. J. P. Tuthill in the State Highway Department is located at l~0'UNorth LaSalle Street, Chicago. It is recommended~ that they use their available funds for the project and develop it as money is available. We can only maintain these portions of the railroad right-of- way which are under lease to the Village. In accordance with an agreement made last sprin~ we have no objection to the planting of flowers in the public right-of-way. The weeding must be provided by their association. The wells around the trees must be preserved. The Village spring and fall clean-up has been carried out for the past three years through Barrington Trucking Company. We have every intention of continuing this program. At the time of the regular village spring clean-up we will welcome any organization's co-operation. The Village will be glad to pick up any debris accumulated if placed at the curb during the cleanup week. It was decided that the Board of Trustees sho~d send a letterto the Association giving their support~ to this project and providing cabbon copies of the letter for Mr. Smith of the Northwestern Railway in Milwaukee and Mr. Tuthill of the State Highway Department. Trustee Schlaver, Seconded by Trustee Ekren, moved for the passage of Ordinance ~744: Ord. ~744 Fire Ordinan c~ AN ORDINANCE TO REPEAL ARTICLES IV and V OF CHAPTER 24 OF THE MUNICIPAL CODE OF MOUNT PROSPECT of 1957 AS AMENDED AND TO ADOPT A NEW ARTICLE IV, Fire Prevention Code, OF CHAPTER 24 Miscellaneous Regulations The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gmw, Norris February 7, 1981 and Schlaver. Add'n to Village Hall Bonds AN ORDINANCE PROVIDNG FOR BORROWING MONEY AND ISSUING BONDS OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, TO TME AMOUNT OF $195,000 FOR THE PURPOSE OF PAYING THE COST OF CONSTRUcT111G AN ADDITION TO THE PRESENT MUNICIPAL BUILDING COMMONLY KNOWN AS THE "MOUNT PROSPECT VILLAGE HALL" AND PROVIDING FOR THE LEVY AND COLLECTION OF A DIRECT ANNUAL TAX FOR THE PAYMENT OF THE PRINCIPAL AND INTEREST OF SAID BONDS. Trustee Norris stated that he expected the contracts for iSTREET Improve-the 1981 street improvement program to be let before May l, thus iment program - 1981 allowing the whole construction season for the work; the State MFT Highway Department has approved the MFT program and the plans and specs will be ready by March. Trustee Ekren reported that a meeting was held with attorneys Permit fees for the Village and representatives of Brickman Home Builders, Mr. Airey, Randview Mr. Appleby, Mr. King and himself ~egardlng refund of permit fees to Highlands Brickman. We trust that the assignment of this amoun~ to the permit fee will enable you to release the remaining funds in onr deposit account. Mott To the Honorable Trustees of Water Commissior the Village of Mount Prospect Gentlemen: The term of William T. Mott as Commissioner for this Village on the Board of Commissions of Des Plaines, Mt. Prospect, Arlington Heights and Palatine Water Commission expires on February 16, 1961. I take pleasure in appointing as the commissioner for this Village on said Commission for the slx year term commen~i~g February 16, 1961, Mr. William T. Mott, 15 South George Street (to succeed himself). Mr. Mott being an elector of this Village is duly qualified for said appointment. s/ Theodore A. President Lams read letter from the Kroger Company asking if Liquor the Board would reconsider allowing a liquor license for their store Licenses at Mt. Prospect Plaza, where they wish to sell wine and beer. It was the consensus of the Board that the present two liquor licenses in Mt. Prospect~ Plaza were sufficient and that they did not care at this time to amend the liquor ordinance to allow a classification for sale of beer and wine only. Trustee Norris, seconded by Trustee Schlaver, moved that the Fire followin~ recommendations of the Village Manager and Fire Chief regarding Dept. uniform atlowancas~ for the Fire Department be accepted and approved: Uniform allowances 1. The Village supply "turn out" clothes, i.e., helmet, boots, bunker pants and coat, two badges and two cap shields, all to be returned by member when leaving the department. 2. The individual fireman supply his original dress uniform consisting of cap, coat, pants, re~fer overcoat, shirts and tie, meeting specifications approved by the Village Manager immediately after appointment to the Department. 3. The Village supply replacements to dress uniforms, except shirts, as authorized by the Fire Chief after inspection. February 7, 1961 5'6 Upon being informed that the Village has until February 10 County Zoning to make any statement to the County Clerk and County Zoning Board re DiMucci Docket ll?, Di Mucci's property at the southwest corner of Gclf and Busse, Trustee Airey~ seconded by Trustee Casterline, made the followin~ motion: "That the Village Clerk be authorized and directed to file objection with the Cook County Zoning Board of Appeals and the County Clerk outlining the following: 1. The proper applica~on of a "planned ~development" use. 2. The petitioner's legal right to so zone and develop this area. B. Proper drainage control of sewer and storm water over lands lying within the Village limits and affecting Weller Creek. Treasurers Mr. Appleby read a letter from Chapman & Cutler compli- office menting the Finance Depahtment on its statements in support of special assessment bonds. Sidewalk The following letter was read from Attorney Downing in along Elmhurstregard to the question of Sidewalk along the east side of Elmhurst at Central directly north of Central Road (see statements of Mr. Mokate in (Mokate) previous minutes).: February 2, 1961 H. G. Appleby, Village Manager Village of Mount Prospect 112 East Northwest Highway Mount Prospect, Illinois Dear Mr. Appleby: Reference is made to your letter of November 2, 1960 concerning Elmhurst Road between Central and the north line of the cemetery. Attention has been given to your inquiry regarding the ownership of property so as to construct sidewalks on Elmhurst Road from Central Avenue to the northern boundary of the cemetery. Assuming that the eastern half of Etmhurst must be BB ft. in width to accomplish this, it appears from the records of the County Recorder there is a justifiable question as to the extent of land dedicated for public It appears from an examination of County records that the interest of the Village in this portion of street is not presently exter~ive enough to include all the land needed to com~truct such sidewalks. Before any sidewalk plans are processed with possible legal action to secure t~tle, it would be prudent for the Village to determine from Chicago ~i~le & Trust Company what interest such company would be willing to insure in the Village now and what objections it will require the Village to have removed in order to insure the full amount of land in question. If the West half of Elmhurst Road is also required to be B3 feet in width, similar problems will have to be solved for the strip of land between Central Avenue and Henry Street. Sincerely, Robert J. Sidewalk The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Mrs. Vavra asked the Board if anything further was going Atwood proper~ to be done regarding the excavation on the Atwood property on Foundry. excavation The section of the code that applies to this case was specified by the Village Attorney, who stated that a summons must then be issued by the Justice of the Peace giving notification of violation. The Board requested the Attorney to represent the Village at this hearing. Mr~ Constantine Stamis thanked the Village Manager for his help in having the apportionment of expense for paving the alley alley south of Prospect Avenue between Pine and Wille worked out, but paving explained that one owner is holdiug out, stating that the paving of the alley would be of no benefit to him and that he desired to sell. The owner in question is Mr. Albert Besander, who owns vacant land adjoining thetalley. Mr. Stamis suggested that inasmuch as this area would be a good parking lot, the Village might be interested in leasing or purchasing it. The Board assured him they would consider it.
