Trustee Bruhl, seconded by Trustee Gaw, moved that the Moody report treasurer be permitted toobtain assistance from the auditing firm of wa%er bonds Ernst 6 Ernst up to the sum of S500 for necessary preparation of Moody reports in order to obtain a favorable water bond rating. Hickey ~eptember 17, 1962 To: Board of Trustees From: Zoning Board of Rppeals Re: Case 62-26, heard Sept. 7, 1962 Petitioner: George E. Hickey The petition ia a request for a variation of the B-3 zoning of property located at the southwest corner of Main and Busse, Mount Prospect, to eliminate the parking requirement. The President of the North Central Businesamen's Association, Inc. September 18. 1962 presented in behalfof the Association a written protest to the granting of the variation, which was supported by the signed authorization of 28 members. The protest and authorization accompany this report. There were no other o~jectors. The Zoning Board voted 4-2 to recommend the requested variation; the majority of the Zoning Board agreeing that the variation if granted will not: 1. Impair an adequate s~ly of light and air to adjacent property. 2, Increase congestion in public streets unreasonably. -- 3. Increase hazard of fire. 4. Endanger public safety. 5. Diminish or impair values of property within the surrounding area. 6. In any other way impair public health, safety~ comfort, morals and welfare of the community. With this report are (1) letter dated September 7, 1962, from the North Central Businessmen's Association,and (2) the authorizations signed by 28 members of the Association. Eugene F. Trustee Gaw read the following report of the Zoning Board re Case 62-27: Zoning Case 62-27 R E P 0 R T RA DISTRICT to be added to September 17, 1962 Zoning Re: Zoning Case 62~27, heard Sept. 14, 1962 Code Petitioner: Village of Mount Prospect The petition is a request for consideration of an amendment of the text of the Village of Mount Prospect Zoning Ordinance as follows: (1) Section 3.01 (a) Addition of an RA district including bulk regulations. (b) Amendment of the bulk regulations relating to the R-1 district. (2) Section 3. (a) Insertion of "RA District Single Family Residences." (~) Paragraph 1, Section 4 (R-1 District) (a) Amendment of lot areas and widths. (4) Addition of Section 4.1 (a) Lot areas and widths in RA district. (b) Uses permitted in RA district. (c) Uses excluded fn RA district. With respect to Paragraph 1, Sec. a (R-1 District~) the Zoning Board respectfully recommends addition to the proposed wording the following phrase: ",.., or, a smaller lot only if of public record on the adoption date of this ordinance." September 18~ 1962 Trustee Bickley, explaining that the Plan Commission had previously studied this plat, read the following letter from them: Street dedi- September 18, 1962 cation - Gentlemen: Gregory School The Plan Commission, To whom was referred the plat of dedi= cation of the north half of East Gregory Street from 1/2 block east of Elm Street To Rand Road and the southwest half of Rand Road from Gregory Street northwesterly to the north line of the school property for study and recommendation, recommend that the plat of dedication be accepted and approved upon its correction to show the correct corporate limits of the Village of Mount P~ospect. Plan Commission A. C. Dresser, Chairman H. G.-Appleby, Secretary Trustee Bickley, seconded by Trustee Bruhl, moved that the Village concur in the recommendation of the Plan Commission as given above. Trustee Ekren read the following letter from Courshon g White: COURSHON g WHITE 120 South La Salle St. Golfhurst Chicago, Illinois Subdivision August 22, 1982 vacatib~°f Mr. C. O. Schlaver, Village President road easement Village of Mount Prospect, Illinois Dear Mr. Schlaver: Pursuant to our conversation the other day, I have checked the records and find that when the Village of Mount Prospect annexed the Golfhurst Subdivision, consisting of the property described in the plat of annexation, a copy of which I am attaching to this letter, it included the east 25 feet of Lot Three (3) in Owner's Subdivision of Section 13, Township ~1 North, Range 11, East of the 8rd P.M. according to plat of said Golfhurst registered in the Office of the Registrar of Titles of Cook County, Illinois, on December 3, 1958 as document No. 1832876. The Torrens records indicated that this property is subject To ~ 25-f~. publi~ roadway along the east line of Lot Three (3) in Owner's Subdivision as shown on plat recorded as Doc. 823~08~. As you know, the. easement for public roadway extends north and south of Golf Road. The extension north of Golf Road runs from Golf Road To the creek, but this has never been used for public roadway purposes, and as you are no doubt aware, there is no bridge across the creek which would enable the use of this 25 ft. easement for public roadway purposes; and that north of the creek there is no ingress and egress right of way should'this public roadway have been extended north of the creek. The net result is that this roadway has never been used, but still remains on the plat as a roadway easement and affects, of course, all of the lots of the Golfhurst Subdivision that border on the east side of this subdivision. Since the Village annexed the entire Golfhurst Subdivision, I am asking that the Village Trustees pass a resolution vacating this public roadway easement. A resolution of the Board to that effect will then enable me to clear off this title defect on all the lots on the east side of our subdivision. Will you please be good enough To let me know what, if anything, we must do in connection with getting this easement vacated, it being under- stood, of course, that whatever expense you are put to will be paid by Golfhurst, Inc. Courshon September 18, 1962 Trustee Gaw, seconded by Trustee Bickley, moved to instruct the Village Attorney to draft the appropriate resolution which ~ould have as its effect the granting back of an easement or vacating the area designated as a street as mentioned in letter of August 22nd of Courshon g White inserted hereinbefore. Trustee Bickley reported from the Police Committee, Police commending the Police Department on a job well done in rounding up juvenile auto theft ring. Consideration of parking around St. Paul's Lutheran Church was referred to the Police Committee. Trustee Bickley, seconded hy Trustee Bruhl, moved that bid from Litsinger Motors.for 1963 police cars be accepted that that this firm be given a contract.in the amount bid of $6,292.00. ~ Police cars Upon roll call: Ayes: Bickley Bruhl Ekren Casterline Gaw Absent: Phillips Motin carried. ~ Board of Health Trustee Gaw of the Health Committee commended Mr. Wm. Yost on his thorough report of sanitary conditions in restaurants within the Village limits. Trustee Gaw, seconded by Trustee Casterline, mo~ed for adoption of Res. 18-62: Res. 18-62 L0nnquist paving A SUPPLEMENZAL RESOLUTION FOR IMPROVEMNNT OF LONNQUIST BETWEEN SEE GWUN AND WE GO TRAIL UNDER MFT. Charities VillageManager Appleby reported that request had been received from the Kiwanis Club of Des Plaines to hold peanut sale in parking lot of Randhurst, on September 28th. The Board observed that Randhurst had already given permission, and instructed the manager merely To acknowledge, the letter. Trustee Bickley, seconded by Trustee Casterline, moved that Street authorization be given toPublic Service Company To install 20 - lights 7000-lumen mercury vapor lights in Hatlen Heights Subdivision and two Hatlen Hts. 20,000 lumen lights on Central Road at the entrances to Hatten Heights. Upon roll call: Ayes: Bickley Bruhl Ekren Casterllne Gaw Absent: Phillips Motion carried. Mr. Appleby reported on County Zoning Hearing. Re Dockets County 421, 422 an~ 423, these cases have all been continued to an indefinite Zoning time. Docket 421 concerns establishment of restaurant and cocktail lounge on the northeas~ corner of Linneman Road and Dempster, near public school property and United Air Lines training school. Mr. Appleby stated that United Air Lines is against this zoning, and that the Village is entering objection. Board of Health Mr. Appleby reported that the animal hospital in town had been checked out, given a favorable report, and had taken out business license and was in a B-3 district, which is correct for this Type of business. September 18, 1962 Trustee Bickley, seconded by Trustee Bruhl, moved that Colonial Heights indicative vote be taken to show intent of the Board in regard to Sub. annex annexation of Colonial Heights Subdivision, asking those in favor to say aye. Upon roll call: Ayes: Bickley Casterline Gaw Ekren Bruhl Absent: Phillips ~ Motinn carried. The Board.discussed County Zoning Dockets 408, 434 and County Re Docket 434, concerning 45 acres at Busse Road and Rte. S2, wherein Zoning Petitioner asks for high density multi-family zoning= Trustee Casterline seconded by Trustee Bruhl, moved to authorize the Village Manager to file objection to Docket 434 on behalf of the Village for reasons of high density and failure of petitioner to show adequate solutions for drainage problems arising as the reset of the proposed use. Upon roll call: Ayes: Bickley Casterline Gaw Ekren Bruhl Absent: Phillips Motion carried. No objection was offered by the Board to uses proposed in Docket 446 for a concrete batch plant on York Road near the end of the airport runway. Trustee Casterline read letter from the advisory committee Village regarding hiring of Village Engineer dated September 14th, wherein the Engineer committee gave their recommendations, stating that this now completed their work. Trustee Casterline, seconded by Trustee Gaw, moved that the Special Engineer Advisory Committee be commended for their work and well- prepared report on the following assignment: 1. Formation of the job classification for position of Village Engineer for the Village of Mount Prospect. 2. Screening for proposed employment of qualified appli- cants for the position of Village Engineer, recommending the four best qualified men for selection by the Village Board. Further, that the advisory committeets report be accepted and concurred in by the Board and that the Village Attorney be auffah'orized to prepare an ordinance creating the post of Village Engineer. Trustee Ekren spoke of contemplated purchase of Cook County Cook County Water & Sewer Company by the Village, explaining that because there was Water not a full complement of the Board present no ~ote could be taken on the decision to buy this utility. Mr. Miller, representative of the firm, asked for an indication by vote before a~reelng to extend his price offer for a week. Attorney Hofert laid the facts before the public body as follows: Quite a while back the question arose as to whether or not the Village of Mount Prospect should acquire the properties of the Cook County Water ~ Sewer Company, the ownership of which is in the hands of a syndicate of men, among them Mr. Miller. This utility serves Hatlen Heights presently and has agreements to serve Colonial Heights. The Village received two reports from two different engineering firms making estimates of the value of the equipment. The final price asked by Mr. Miller is $425,000 after continuous negotiations over a peril several months. All our negotiations have been on the premise that production and distribution facilities are the property September 18, 1962 f the Cook County WateP ~ SeweP Company, and if they ape found not to he, this offe~ would be changed in accordance with that finding.
