M. roll call and npon roll call the following members answered Present: Bruhl Casterline Ekren flaw Phillips Absent: Bickley It' was moved by Trustee Ekren, seconded by Trustee Bruhl, that Village Manager Appleby act as Clerk Pro Tern for the meeting. The motion was carried by acclamation. Trustee Ekren moved, seconded by Trustee Caster!ine, that the minutes minutes of the Nay 8th meeting be appreved as submitted. Trustee Casterline ~epor~ed for the Building 'Oommittee on the signs request of Shopper* s World for a variation to permit the erectinn of a non-conforming sign at their business establishment 'on R~nd Road as follows: The application waa made November 13, 1961' prior" to the' adoption of the Sign Ordinance; the request ~as for a sign containing 900 sq. ft., 48 ft. high; the ordinance permits a height 'of 18 ft. ~ the ~ommittee and represen- tatives of Shopper's World-had given consideration to the height of the sign and its nuisance features. Trustee Casterline reported that Shopper's World had agreed to cut the sign down to 32 ft. high, that they were agreeable to abtding by the Vill~age's turn-off~ honr of 11 P.M. and not to having a ~flowing light" in the sign. It was moved 'my. Trustee Casterline and seconded by Trustee Bruhl that the variation of sign size be granted fora sign as shown on blue-print showing sign structure at 9639. $'. Cicero and further' identified as Job ~60-8 on condition ~hat the operation and maintenance of the sign will be in accordance with the Mt. Prospect Code; Upon roll call'. Trustee Casterline reported that the Building Committee is having conferences with a representative of Shopper' s World in regard to the fire fire requirements of the building. Nay 15, 1962 oning Case 62-9 Trustee Ekren reported that Zoning Board of Appeals Case 62-9, Petitioner Charlotte Jones, sole beneficiary of Trust 24221 La Salle Mati.onal Bank as Trustee, had been re- scheduled for' the May hearing. Zoning Case Zoning .Board of Appeals Case 62-10, Petitioner Illinois 62-10 'Range 0ompany, Central Road, report was included in the Ray 8th Illinois Range minutes and referred to the Judiciary Committee. Trustee ~.kren read the following memorandum: "This is a petition for variation to permit the addition of 25' x 113: to an existing building on West Central Road occupied by the petitioner and owned by .the petitioner. This variation, if granted, wuuld permit the petitioner to build within one foot of his property line rather than to stay. 25 feet from the line as now required by the zoning laws of the Village. This additional space would be used for offices and would be of glass and brick, the foundations able to accommodate a ~econd story if needed in the future.' "Petitioner pointed out that this company now employs 130-135 employees; expansion of business demands more space. Two business establishments directly to the east have built up to the line that the petitioner requests, which building took place prior to enact- ment of the present zoning law; this addition would enhance present building and. appearance of the area. The business establishment directly to the west is within the present zoning law. The chairman pointed out that the petitioner is .using 50% of present available area ~excIusive of the front yard, "The 'Zoning Beard was advised by Mr. Carney that he was not in favor of the variation and .that he understood the Architectural Committee agreed 'with his views. · The Zoning Board voted 4-3 to reject the variation as requested because petitioner did not present a hardship to the land. "The three members of the Zoning Board who voted for the variation did so because of the following facts: 1. This addition to the present building would bring 2~ into' line with buildings to the east. 2.This addit2on would enhance the attractiveness of~ the present 'building and the .area. 3.Petitioner. is a residemt of Mount Prospect; .- successful, and employs 130-135 people. 4. Petiti'oner 'had to furnish perking space for employees' cars and also"f'or the commercial trailers handling the pr~dubtS of' the company. 5. This addition-is neededf0r the successful operation 'of the.~USiness that has been in MoUnt Prospect since' 19,45. 6. The Village would- benefit indirectly and directly through the additional business that will probably accrue-, to the petitioner. ?. Zoning laws are for the improvement and betterment of the use of land and for the Village. and its residents. These three members felt that this variation, if granted, would satisfy the aims and ultimate goal of our zoning laws, according to the facts in this case. ~ ' E. F. Martin, Chairman O. E. May 15, 1962 Zoning Case Trustee Ekren announced that the Judiciary Comittee agreed 62-10 with the minority opinion of the Board of Appeals, and moved, seconded by Trustee Casterline, that' the Village Attorney prepare an ordinance to grant the variation as requested. Upon roll call: Ayes: Bruhl Ekren Castertine Gaw Phillips Absent: Bickley Motion carried. The Zoning Board of Appeals Case 62-11, petitioner, Henry Zonin~ Case and Christiana Blume report was .included in the May B, 1962 minutes. 62-11 Trustee Ekren read the following memorandum: =This petition asks for a rezoning to B-S, contingent upon annexation, of property consisting of 2½ acres (lO0, O00'square feet) located to the West of the Rand Read Shopping Center with 86?.6 .feet fronting on the South side of Rand R. oad~ 265.$ feet bordering on the Western edge of the Rand Road Shopping Center and 295 feet te the West adjoining Prospect Meadows. 'Petitioner intends to use 38% of the land for building, which will include a 2-story medical building, restaurant and other retail stores. 'The plan provides for the vacating of a dedicated street which is of no value to the Village. Egress and ingress to the shopping center will be only on Rand Road. · The Zoning Board of Appeals voted ?-0 te approve of the rezoning, contingent upon annexation, because this will be beneficial to the Village. Trustee Phillips reported on discussions of the Water polyphosphates Co~m~ittee and others in regard to the use of polyphosphates for..~ %he ~Control of iron in'~the wa~er supply. It was moved by Truste~ Phillips and seconded by Trustee Casterline that the Village Manager be authorized and directed to sign the aPPlication for ~arren"Chem{cal Company to get approval from the State t's'install equipment to introduce polyphosphates into the water supply to keep iron in' suspension and to purchase the necessary equipment from Warren Chemical Company for $1600- as well as a supply of chemical. Trustee Phillips read the following report in. regard to overflow at overflow' at .the storage tank on Highla~d Avenue: wells RE: OVERFLO~ PIPE -WELL #5 In recent weeks there have been some failures .in the automatics pump controls at the Well #5 station. Two cf these failures have resulted in damage being done, .both to our prupert~ on the east side of the reservoir and to the E~ickman apartments immediately adjacent to them. This .damage occurred when the automatic controls did not function properly. .So when the controls should have .shut the deep wells ~ff., instead there was a continuous pumpin~ action which resulted in the reservoir overflowing. The excess water then flowed down our overflow pipe onto the ground and from there followed the slope of the groun~ to the east. To the east 'of this ~'e~ervoir there is a']parking lot used by the inhabitants of the ~apTe Crest apartments for off-street parking. This parking lot has storm drains in it, but they ar~e inadequate to handle the excess drain 'of water from these we!la The excess then ~c~s i~t$ the g~ound-level basement windows ~aPartments and' has ~aused c~nsi~der~a~le damage to .the interiors.. has also tended to create ill feeling towards the village for these unfortunate incidents. Wells #5 and #6 ~oth pump into ~he. same reservoir and their combined pumpage now is approximately 280~ gal:Ions per minute. As any man- made machine is not infallible, there is a likelihood that these same controls may malfunc.tion again. At this time they. are functioning properly and it is. hoped they w~ll ~cOntinue to do so., However, in view of a pd~sibiltty, of a recurrence 9f this, it .is my recon~endation ' to install an OVer~low sewer to carry away the overflow water dirqCtly from the reservoir to the sewer on' Highland Avenue. As there ~ s at the present t~me no alarm system to let us knew when the tank is overflowing, it is my further ~ecommendation th.at this' tank overflow alarm be installed. The cost for this would be very nominal. Attached is a .copy of a letter from Consoer, Townsend & Associates, showing their estimated cost of providing a storm drain for the Highland Avenue reservoir. ~ .,~ i R~eSPectfutl~ submitted, David Cream.er, Superintendent Water ~epar.tment It was moved by Trustee Phillips, seconded by Trustee Gaw, that the Village Engineers prepare plans and specifications for a connection of the overflew pipe from the storage tank to the sewer, that prices be secured for construction of this connection, and that the Water Committee be empm*ered to act and select the most acceptable bid. Bittner, parking, BO0 West Mitburn Avenue, in regard to parking conditions to the t~ffic Police Committee~ This letter,~dated May 13th, was concerned with traffic at Elmhurst and Milburn Avenues. It was moved by Trustee Gaw and seconded by Trustee Elmhurst Ave. Casterline that the i~provement of Elmhurst Avenue between Ncrth- widening, paving west Highway and Central Road by widening 10' on the west side 18CS installing curb and gutter and water bound ~acadam base therein and re-surface the entire width of the pavement with 1,11 surfacing be ~" added to the 1962 ~FT Program, and that the Village Engineers be ~ authcriaed to prepare the necessary plans and papers therefor. Upon roll call: Ayes: BruhY, caSterline, Ekren, Gaw and Phillips Motion carried. Trustee Ekren reported on County Zoning Dockets #$?9, 393 and County 395, all of these cases requesting side yard variations and set-back Zoning variations. He reported that nc objections were entered in any cf the cases. It was moved by Trustee' Ekren and seconded by Trustee Phillips sidewalks that the Village approve' the request of Charles Bruning Co. Inc. dated W.Central May B, 1962 for permission to inetalt sidewalk along the Central Road side of their property entirely ~n Bruning property except at the ends, in accordance with the plan submitted with their letter. President 8chlaver announced that during the months of June, July and August he would be at the Village Hall only two Saturdays a month. Village Manager Appleby reported the folluwing letter had been received from Mr, L. W. Lentzner as required: May 10, 1962 insurance Mr. H. G. Our fire engineer, Mr. Wiser~ will. Continue to provide assistance and cooperation in working with you and the Illinois Inspection Bureau with regard to the public and institutional property forms and the ratings and necessary filings. ~ ~. Accident prevention services will be provided to reduce and eliminate hazardous conditions and practices and thereby reduce claim costs and insurance costs. This department is headed by Mr. Whiteside. Mr. Dugan is the servicing engineer. Claim service will be provided by our adjuster and claim department as outlined in claim manager Stuhr' s letter cf April 15, 1962. Mr. Van Egeren will be the adjuster. Our auditors will call to make payroll audits after expiration and will be available in the meantime in case you have any questions Along that line. Mr. Dufourd is manager of this department. Busse, and that he be authorized to reduce the width of easement required for construction of the drainage structure following conference with the Village ~ Engineers.
