This motion carried by acclamation. Trustee Casterline, seconded by Trustee Phillips, moved that the minutes of the previous meeting of April 10th be approved as submitted, minutes This mOtion carried by acclamation. Trustee Brmhl, seconded by Trustee Gaw, moved for approval of the bills due as of April lYth as follows: 0 General $12,566.89 ~ Library 2,564.90 bills ~ Library Bidg. Trustee Casterline referred to letter of April 10th signed by J. W. Viger, included in the minutes of April 10th, and read the following recommendation of the Architectural Committee: "A masonry chimney is required as this is being built under a variation Bldg. Dept. in an R-B district. Prefab. chimney "The plans as originally submitted were approved subject to being (Starck) corrected to show a masonry chimney. This correction was noted and agreed to by Robert W. Starck as indicated by his signature on the Building Depart- ment check sheet. · To build something other than agreed to at the time the permit was issued is a violation and the Building Inspector is entirely correct in stopping this work. The correction should be made as agreed." Signed a ArChitectural Committee Jim Was, Lloyd Johnsen, R. Jackson Trustee Casterline, seconded by Trustee Gaw, moved that the Board concur in the recommendation of the Architectural Committee that no variation be granted to use a prefabricated chimney in the professional building at 109 South Hi Lusi. Upon roll call: Ayes: Bickley Bruhl Casterline Ekren Gaw Phillips Motion carried. Trustee Casterline referred to request from John D. Sutton of fence 500 So. Candota for permission to erect a white cedar shake fence 60 inches Sutton high, stating that he further intended to shrub this fence as he felt it was necessary for security in the summer when setting up his children' s play pool. This matter was referred to the Building Committee. Trustee Bruhl, seconded by Trustee Casterline, moved that the Financial Financial Report for the month ef March, 1962 be accepted, and filed Report fcr audit. This motion carried by acclamation. April 17, 1962 Trustee Bickley read the following report from the Zoning Board of Appeals re Zoning Case 62-7: Zontng Case 62-? R E P 0 R T April 16, 1962 To: Board of Trustees Re: ZONING CASE ~2-7 Petitioner: Village of Mount Prospect Representative: Mr. Edward Hofert, Village Attorney The petition is for approval of a more definitive and d~tailed ~-~ explanation of the term "Shopping Center" as it applies to the Zoning i I Ordinance of the Village ef~ Mount Prospect. This more definitive ]_ language would give technical amendments with no change in usage and with no adverse effect. The language as requested by the .Village is as follows: "Shopping Center. A business development containing four (4) or more offices or indoor retail stores, connected by party w~lls, developed under one ownership, with an integrated building arrangement, having an aggregate floor area of more than twenty tho~and (20,000) square feet, which development shall be considered as a single unit. The minimum area occupied by a Shopping Center and its accessory off-street parkingfacilltiek shall be not less than two and one-half (2 res TH½) ac . . e term Shopping Center shall not include drive-~ ins and/or automotive servi~e type or sale facilities." The Zoning Board of Appeals voted 6-0 to approve of the request of the Village as outlined in the preceding paragraph. E. F. Martin, Chairman Geo. E. Jacobsmeyer, Acting Secretary Trustee Bickley, seconded by Trustee Phillips, moved that. the -- Board of Trustees concur in the' recommendation of the Zoning Board that detailed definition of "Shopping Center" be added to the Zoning Ordinance. Trustee Bickley, seconded by Trustee Brmhl, moved for passage of Ord. #822 as follows: Ord. #822 Definition of AN ORDINANCE AMENDING SECTION 17 of the Shopping Center MOUNT PROSPECT ZONING ORD/NANCES BY ADDING THERETO A~BEEINITION OF SHOPPING CENTER Upon roll call: Ayes: Bickley Bruhl Ekren Caw Phillips Casterline Mo~on carried. Trustee Bickley read the following report from the Zoning Zoning Board re Case 62a8: Case 62-8 Zoning Map R E P 0 R T April 16, 1962 To: Board of Trustees Re: Zoning Case 62-8 ~ Heard on April 31, 19~2 Representative: M~. Edward Hofert, Village 'Attorney - The petition is for approval by the Zoning Board of Appeals of a zoning map up-to-date as ef December B1, 1961, consisting of forty maps bound in a folder, entitled, VILLAGE OF MOUNT PROSPECT, ILLILNOIS, CO,NTT OF COOK, ZONING MAP AS OF DECEMBER B1, 1961", with such maps preceded by an index of the individual maps, and these maps show the present zoning of all property located within the boundaries of the Village of Mount Prospect.. These maps make ne changes in present z~ninE but were prepare d April 17, 1962 489_ to present a more legible and quick reference for the present zoning of the property located within the boundaries of the Village. The Zoning Board of Appeals has been assured that the preparation and printing of these maps were very carefully checked, and are accurate and correct. The Zoning Board of Appeals voted 6-0 to 'approve ~f the Zoning Map as of December B1, 1961 as above outlined, and recommends that it be adopted by the Board of Trustees of the Village. E. F. Trustee Bickley read the following report from the Zoning Board re Case 62-1: Zoning LO R E P 0 R T Case 62-1 ~ April 16, 1962 ~ To: Board of Trustees ~ Re: ~ONING CASE 62-1, John A. Patton The petition is for a variation in land use re property zoned R-3 and loaated on Y/est Prospect Avenue between Elmhuret and Pine, to permit the erection of a building for professional occupancy. The petitioner's attorney explained during the hearing that the petitioner proposed to include in such occupancy a pharmacy. The request for a pharmacy did not appear in the published notice and therefore it cannot be considered. The municipal ordinance specifically excludes from R-3 "Commercial Enterprises" Section 4, Paragraph 4, such as a pharmacy and the petitioner's attorney was so infor~ed. The Board of Appeals voted 7-0 to recommend d~nial of the petition. There were three objectors present. E. F. ~artin, Chairman M. G. Young, Acting Secretary This matter was referred to the Judiciary Committee. President Pro Tern Ekren repbrted on a bus tour conducted by Annexation the Village, wherein trustees, Village personnel and other interested plans people inspected about 900 acres of unincorporated areas surrounding Meunt Prospect, such as Hatlen Heights, Colonial Heights, Elk Ridge Villa, the United Air Lines properties and other industrial properties south of the Village. Also included was the Riverhurst area north of the Village. He stated that it was a very worthwhile and educational trip. Trustee Phillips, seconded by Trustee Bickley, moved that a 'special committee be created of resident engineers in the village for the purpose Village of selecting a ~ivit engineer as .village engineer, such a committee to do Engineer necessary advertising directing applicants to apply te the president and Board of Trustees, to screen the applications, to set up job qualifications and make recommendations for approval of the-Village Board. President Pro Tern Ekren read letter of appointment from President Schlaver as follows: April 16, 1962 Appointment Members of the Board Engineering Village of Mo~t Prospect Committee Gentlemen: It is my pleasure to ask your concurrence in the appointment of the following three engineers residing in the village, men of high standing in their profession and qualified to act as a citizens' committee for the purpose of setting up Job qualifications and serving as a screening committee to assist in the selection of a civil engineer to serve as April 17, 1962 Cont~d Mount ProspectUs Village Engineer. This group would proceed at Appointment once in its duties. Engineering Committee These nominees are: Joseph Vavra, 502 N. Proepect~Ave., ' Universal Oil ProdUcts Co. Chemical and professional engineer R. S. Fountain, 604 South Elm St. Portland Cement Co. ~-~ Civil engineer. Bernard Hemmeter, 112' So. ~School St. Structural and professional engineer Independent contractor. Trustee Bickley, seconded by Trustee Phillips, moved that the Board of Trustees concur in the appointment of the President's settup up the above-mentiuned Engineering Committee. Upon roll call: Ayes: Bickley Bruhl Casterline 6aw Ekren Phillips Motion carried. Trnstee Casterline stated that he had had no previous knowledge of this committee appointment; that h~ personally knew two of the gentle. men and knew of the other, therefore voted for their appointment~ but asked that in the future all trustees be apprised of intended appoint- ments ahead of time. Trustee PhilliPs, seconded by Trustee Bickley, moved that the Water mains Village accept plans and specifications of installation of water main for new on Isabella Street from Dale Avenue to Northwest Highway to serve park Northwest Park and authorize the Park District to proceed with the installation, with the understanding that it will be done under the construction supervision of Consoer, Townsend & Associates, Village Engineers, and the chlorination will be under the supervision of Water Superintendent Creamer, the Village to install hydrants along Isabella Street at a later date as necessary. Proclamation Trustee Phillips read proclamation from President Schlaver proclaiming the week of April 23-28 as JUNIOR HIGH STdDgNT COUNCIL WEEK, copies of same to be sent to Lincoln and Central J~nior High Schools. Trees - Funk' s Trustee Caw of the Street Committee reported that Manager Mt. P. Gardens Appleby in company with Nels Johnson, tree expert, inspected the trees offered by bid from different nurseries, reported that they considered National Landscaping Company to carry the best trees for the money, and recommended the thornless honey locust at $~2.00 each to be installed in the parkways in Funk' s Mount Prospect Gardens. Trustee Caw, seconded by Trustee Casterline, then moved to accept the bid of National Landscaping Company, purchasin~ §B honey locust trees for the sum of $901.00 for placement in Funk's Mount Prospect Gardens, and that one tree also be placed in the parkway of 806 Dresser Drive. Upon roll call: Ayes: Bickley Brnhl ERren Phillips Caw Casterline Motion carried. Trustee Caw explained that the developers of Rusenthal's Resub. Sewer - agreed to install an 18-inch sewer running down Maple Street; and that Rosenthal's Resub. inasmuch as there is a drainage problem developing in the near and vicinity vicinity (around Emerson and Prospect) the engineers have advised enlarging and extending this sewer. April 17, 1962 Trustee Oaw, seconded by Trustee Casterline, moved that Sewer on Maple the Board approve the expenditure of $2,004.0~ to 'increase the (cent' d) diameter of the sewer line in Maple Street from 18" to 24", and extend the sewer 150' farther north than called for in the original plans for Rusenthal's Resubdivision, this work to be completed by Pietro Scalsetti Company. Trustee Gaw, seconded by Trustee Casterline, moved that the sum of $8,500 be aLTowed for in the 1g~2-~3 budget for extension for 24~ sewer on Maple Street to Prospect Avenue and Emerson Street. Upon. roll call: Ayes: Bickley Bruhl Ekren Gaw Phillips Casterline Motion carried. Trustee Gaw explained that there is a 'low-lying strip of land Village o~e¢ 75 feet wide at 1101 West Lincoln which ~eeds draining and landscaping; property at consideration is being given to selling this property to adjoining W. Lincoln St property o~ers. This ~atter was referred to the Street Committee. Trustee Bickley brought up the matter of possible installation Sidewalks of sidewalks along East Prospect Avenue from Maple Street to Mount Prospect Road. This was referred to the Street Committee. Trustee Ekren read letter from Prospect Auxiliary Post #lBS7 Poppy Day asking to sell poppies on May 24th from 6:00 A.M. to 6:00 P.M. Trustee Br~hl, seconded by Trustee Casterline, moved to approve the sale of poppies by the American Legion Post A~iliary on May 24th. This motion carried by acclamation. Trustee Ekren as head of the Judiciary Committee brought up Liquor licens report and recommendation regarding issuance of liquor license to Thunderbird Bowl on Rand Road as requested on Page 4~4~m~utes of April 10. Upon Trustee Ekren' s request, Mr. Daniel Welch of th* Th~derbird Bowl came forward and explained the plans for this property (previously examined by the Judiciary Committee), stating, that the Quaker Oats Company, licensees, would run the Paneake House on the portion fronting Rand Road and a snack bar in the bowling alley, an adjoining structure. The bowling alley would have S6 lanes, cocktail lounge and snack bar. The following citizens arose and expressed their views regarding liquor license as follows: E. H. Nixon, 501 Go Wando: There is a trend arising; the corporate image must reflect the position of the Board accurately. Melvin Fisher, 100 S. William: ~hat plan will be followed in the future as to the issuance of liquor licenses? Trustee Bickley: Each case will have to be considered on its own merits. Gilbert Liebenow, 400 N. Main: Our children are our biggest investment; their interests should be protected. Stores should be policed carefully to make sure they comply with all details of the liquor law. gonstantine Stamis, 101 S. Pine: I also l~ve my children, but you cannot enclose children in glass towers. If their parents bring liquor into the house, they will find it. This is a real world and they must live in it. Rev. l¢orman Herbert, Presbyterian Community Church: gould we have a stated policy in issuance, with perhaps revocation in case of misuse. April 17~ lg82 Attorney H~fert: An expression of. policy has no legal significance; Liquor, cont'd only moral. We do not know of any such action ever before hawing been taken by a eo~nunity. FormerrPresident Theodore Lams: When the question Sf issuing license to Thunderbird Bowl came up before the old Board in 1980 they were faced with the fact t~t this was contingent upon annexation; this property was not obliged to annex and could if they wished remain in the County or perhaps annex to Des Plaines, who would be glad to have them. It is better to have them in the Village limits where we can exercise control. Trustee Gaw suggested that notice of request for liquor license should be henceforth printed in the local paper. This will be considered by the Judiciary Committee. Trustee Casterline, seconded by Trustee Gaw, moved that Attorney Hofert be asked to see that all requirements of liquor licensee held by Mell& Paul' s Restaurant are met and that building permit issuance be held up until after the Village Attorney' s report can be submitted to the Board. Trustee Bickley, .seconded by Trustee Phillips, moved that the Village Attorney prepare an ordinance increasing the number of Clms B liquor licenses by erie te permit sale of liquor at the Thunderbird Bowl on Rand Road. Upon roll call: Ayes: Bickley Gaw Phillips Casterline Ekren -- Nays: Bruhl Motion carried. Chester Busse Chester Busse of lib East Prospect Avenue arose and asked that car wash he be granted car wash for which he had applied some time before and had been refused.
