Present: Bickley Absent: Casterline Bruhl Ekren Pres. Schlaver Caw Phillips Trustee Casterline, seconded by Trustee Bickley, moved that Pres. pro tom Parker Ekren act as President pro tem for the duration of the meeting. This motion carried by acglamaticn. Trustee Gaw, seconded by Trustee Casterline, moved that the minutes motion re S.A. ~62, min. of Sept. 12th be corrected, changing the amount of expenditure. (Minutes of Sept. 12th are shown as corrected). Phillips Trustee Gaw, seconded by Trustee Casterline, moved to accept and place on file financial report by the Treasurer for the month of August August, 1961. Phillips Mr. Fisher cf the Civil Defense Committee reported on the activities of his committee since their appointment. Mr. Harry Doane Civ~ Defense of the Committee also spoke, stating that date had been set up for meeting with Colonel Mawrence and interest parties from Mount Prospect to receive instruction. Also, Dr. Levinson from the Village of Northbrook will speak regarding Civil Defense at the Westbreok School on October 10th. September 19, 1961 rainage, Discussion was held by the Board with citizens in the floods aud~ence'who came to report flood damage on the south side near Weller Creek the Creek. Mr. Irving Ross of 901West Milburn spoke of lack of drainage in the WeGo Park and Alfini Subdivision area. Mr. Wm. Cadigan of Consoer, Townsend & Associates said that this had been investigated a year ago and the excess water was due to the fact that builders had connected the Window wells, etc. to the sewer drains instead of rumning ~tormwater into the storm drains. Trustee Gaw stated that estimate had been received from Consoer, Townsend re cost for running parallel line down See GWun across the Lincoln School Field to connect into the Lincoln Avenue drain, which would take care of this matter. Meeting has been set up with the Sanitary District to see about release of funds for this project. Discussion regarding flooded basements'around Tower Lane, South Owen, etc. continued. Mr. Cadigan said the final asnwer to the complete problem was to dredge Weller Creek deeper. Names and addresses of all homeowners With flooded basements were listed and steps willbe taken to see if it ispossible to alleviate the problem. D.A.M.P. Mr. Wm. Mott, Chairman of Water Commission D.A.N.P. reported that this Commission had written to Attorney General for the State of Illinois William G. Clarke regarding the outcome of the lawsuit for lake diversion; Mr. Clarke replied that the matter will not be brought up again until spring, when it will be brought before the Supreme Court. Mr. Mort stated that the Commission is now only meeting periodically instead of the previous twice per month until litigation is settled. Trustee Bickley suggested that all the suburban towns co-operateto ask that request for line for drinking water be removed from Chicago's Lake Diversion suit, as hefelt that the cases were not really related. Mr. Mort replied that the Tree Towns had previously turned down all offers of help but in view of the fact that their case was now mired down might welcome aid from suburban towns who are seeking the same end. Trustee Ekren read the following report re Zoning Cases 61-28 Zoning and 61-29: Cases 61-28 + 61-29 Stanton Addition R E P 0 R T To: Beard of Trustees Re: CASE 61-28, Heard September 15, 1~61 Petitioners: Edward and Annette P. Stanton The petition is for'the rezoning from R-1 to B-3 contingent upon annexation of property comprising more than three acres lying between Foundry and Rand Roads, east of Rand and south of Foundry. There were no objectors present. The Boardof Appeals voted ?-0 to recommend that the property be rezoned as petitioned, if annexed. s/ Eugene F. Martin, Chairman Malcolm G. *oung, Acting Sec'y REPORT To: Board of Trustees Re: CASE 61-29, Heard September 15, 1~61 Petitioners: Edward and Annette P. Stanton The petition is for a variation to permit the constr~ction of a building higher than the maximum number of feet permitted by the 'Code. The proposed building would be erected on Parcel B of property between Foundry and Rand Reads as stated in Case 61-28,~nwhich the petition asks for rezoning from R~i to B-3 upon annexation. The plan presented by the petitioners shewed that Parcel B has an area of 71,641.5 square feet and that the proposed building would occupy 11,000 square feet of the parcel. In addition, the plan shows the building to be approximately 40 feet in height, although during the heearing the petitioners stated the exterior height of September 19, 1961 he building would be 42 feet. · Subject to the granting, of the petition for variation, the petitioners agreed to record a covenant on the land which would restrict the area of the building or buildings to ll,O00 square feet. There were no objectors present. The Board of Appeals found that the granting of the petition will not: 1. ImPair an adequate supply of light and air to adjacent 'property., 2. Increase unreasonably congestion in the streets. B. Increase hazard of fire. 4. EndanEer public safety. 5. Diminish or impair property values in the surrounding areas. 6.~ Impair public health, safety, comfort, morals and the welfare of the community. The Board of Appeals voted ?-0 to recommend granting of the petition for variation subject to the following conditions: 1. A covenant running with the land must be recorded restricting to 11,000 squ~e feet, ef the 71,641.5 squ~re feet of Parcel B, the area of Parcel B to be occupied by buildings or structures of any kind whatsoever. 2. The building setbacks shown in the plans presented at the hearing must be the setbacks to be observed in any building construction. s/ Eugene F. Martin, Chairman Malcolm G. Trustee Ekren, seconded by Trustee Phillips, moved for the passage of Ord. #?85: Ord. #?88 Rezoning to B-2 AN ORDINANCE AMENDING THE ZGNING ORDINANCE REIATING TO PROPERTY LOCATED ON THE SOUTH SIDE OF WALNUT STREET ON THE WEST SIDE OF RIDGE AVENDE AT THE CORNER. This ordinance rezones property in Case 61-27 to B-2. Upon roll call: Ayes: Bickley Casterline Ekren Gaw Absent: Bruhl Phillips Motion carried. Trustee Ekren, seconded by Trustee Casterline, moved for the Ord. passage of Ord. #789: #789 R-a zoning AN ORDINANCE AMENDING THE ZONING ORDINANCE Bolger Sub. RELATING TO PROPERTY LOCATED AT THE NORTHEAST CORNER OF CENTRAL ROAD AND MAIN STREET. This ordinance resones property in Case 61-25 to R-4, efficiency apartments. Upon roll call: Ayes: Bickley Casterline Ekren Caw ~bsent: Bruhl Phillips Motiun carried. September 19, 1981 338 Zoning Case 61-24 Trustee Ekren referred to report and memo re Case 61-24 Caltagirone inserted in the minutes of. September 5th, and stated that the Judiciary Committee recommended concurrence ~th the Zoning Board in this matter. Trustee Ekren, seconded by Trustee Bickley, moved that the Board of Trustees concur with the Board of Ap~als in regard to Case 61-24, Paul Caltagirone, petition for variation to allow enclosed patio closer to building line than permitted in the Code - - that this appeal be disallowed. Upon roll call: Ayes: Bickley Casterline Ekren Gaw Motimuearried. Phillips Absent: Bruhl Trustee Bickley, seconded by Trustee Gaw, moved that the Village Attorney be instructed to take whatever appropriate action he deems necessary to remove this variance which is in violation of our Building Code as described in Zoning Case 61-24. Phillips Absent: Bruhl The following letter was read from the Plan Cemmiasion: Bluett's Third Addition September 13, 1961 Village President and Board of Trustees Village of Mount Prospect Gentlemen: The Plan Commission to whmm the plat of 3rd Addition to Bluett's Fairview Gardens was referred for study and recommendation, recommends that the plat be approved. Respectfully submitted, Plan Commission A. C. Dresser, Chairman H. G. Appleby, Secretary Trustee Bickley, seconded by Trustee Casterline, moved to concur in the recommendation ef the Plan Commis~ion to approve plat of Bluett's 3rd Addition to Fairview Gardens, reouesting the President and Clerk to sign said plat. Motion carried by acclamation. Traffic The Board asked the Police Department to remove the Ste~ sign at the northeast corner of Emerson and Shabonee Trail and to put up two more One-Way signs with arrows pointing to east in front of the driveways at the church parking lot.
