Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION MARCH 9, 2004 The Closed Session was called to order at 8:01 p.m., by Mayor Farley, in the Boardroom of the Central Community Center, 1000 West Central Road. The purpose of the Closed Session was to discuss Litigation, Property Acquisition and Personnel. Present were: Trustees Timothy Corcoran, Paul Hoefert, Michaele Skowron, Irvana Wilks and Michael Zadel. Absent from the Closed Session was Trustee Richard Lohrstorfer. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Village Attorney Everette Hill. Minutes Motion made by Trustee Wilks and Seconded by Trustee Zadel to approve the Minutes of January 27, 2004. Minutes were approved. Trustee Skowron abstained. Motion made by Trustee Zadel and Seconded by Trustee Corcoran to approve the Minutes of February 3, 2004. Minutes were approved. Trustee Wilks abstained. Litigation Cunningham vs. Village of Mount Prospect Village Manager Janonis provided some details to the Board regarding the recent decision from the d Summary Judgment regarding Cunningham vs. Village of Mount Prospect case. He stated that even though the Summary Judgment was in favor of the Village, the Plaintiff has a 30 -day refilling period which will conclude in early April. u' Garcia vs. Mount Prospect Police Pension Fund Q The Garcia vs. Mount Prospect Police Pension Fund Case was affirmed by the Seventh Circuit. Therefore, the Case is now concluded. a Addison Court De Annexation Suit CE The Addison Court De Annexation Suit has been dismissed by the Judge and the Case has now been concluded. G=n Attorney Hill stated that the Cunningham Case might be appealed, however, there are very few considerations for Appeal that would be possible. The Statute of Limitations issues were clearly addressed in the Summary Judgment. The summary of litigation was for status only and required no action by the Village Board. Village Attorney Hill left at 8:19 p.m. - G1 nnnnn ( u . LS n L.7 Personnel 0 Police Union Village Manager Janonis stated that the Police Arbitration took place last week and the Village received reasonable economic terms including a four -year agreement from the Arbitrator. Additional Arbitration dates are yet to come regarding the shift selection procedure but the economic package can be implemented in the near future. Assistant Village Manager Strahl provided additional details regarding the Arbitration information that r was imposed upon the Police and the Village by the Arbitrator. Fire Department Negotiations ] Q Village Manager Janonis provided a summary of the process to date and stated that the promotional OE Cr process discussion is still the major focus of the negotiations. He stated now that the Police Q c Department has an economic package in place, it would be very difficult for the Fire to demand anything beyond that package through Arbitration. Public Works Union Status There is an additional meeting scheduled for next week. To date, there have been no new discussions regarding their demands. There was a discussion among Village Board members regarding status of retroactivity pay for Public Works employees. Consensus of the Village Board was to consider full retroactivity based on the manner in which the employees have handled themselves during this negotiation process. 06 I Non -Union Employees CS Village Manager Janonis requested the Board authorize him to increase wages by one -half percent ,d which would bring them in line with the recent Police Arbitration award of 3.5%. ( Ll r - Consensus of the Village Board was to direct staff to increase non -union wages from 3% to 3.5% effective January 1, 2004. There being no further discussion, the Closed Session returned to open session at 8:50 p.m. and the Closed Session adjourned with no further business at 8:52 p.m. 2
