INVOCATION INVOCATION Trustee Zadel gave the Invocation. MINUTES APPROVAL OF MINUTES Trustee Hoefert, seconded by Trustee Korn, moved to approve the minutes of the regular Village Board meeting held September 7, 2010. Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. FINANCIAL REPORT FINANCIAL REPORT AND APPROVE BILLS AND APPROVE Mayor Wilks stated the next item on the agenda, "FINANCIAL REPORT AND APPROVE BILLS BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." MAYOR'S REPORT MAYOR'S REPORT Mayor Wilks presented two (2) proclamations: DOMESTIC Domestic Violence Month, October 2009 VIOLENCE MONTH State Representative Mark Walker, representing the Northwest Suburban Alliance on Domestic Violence, accepted the proclamation and thanked the Village for helping to raise community awareness in the prevention of domestic violence. NATIONAL National Childhood Obesity Awareness Month, September 2010 CHILDHOOD Mr. Mike Giblin, Mount Prospect Lions Club,was in attendance for the reading of the OBESITY proclamation. The Lions Club and Northwest Community Hospital are partnering to promote AWARENESS healthy food choices for kids at the September 26 "Kids Day" at the Farmers' Market. Mr. MONTH Giblin thanked the Village Board for the opportunity to promote this important health issue. Mayor Wilks will present the proclamation to the Lions Club and Northwest Community Hospital at the September 26 Farmers' Market. OATH OF OFFICE Mayor Wilks stated the oath of office would be administered to three (3) members of the Mount Prospect Police Department who were recently promoted. Police Chief John Dahlberg provided background information on each of the officers; highlighting their exemplary performance and dedication to the community and Police Department. EMPLOYEE The following employees are celebrating quinquennial anniversaries with the Village this RECOGNITION year. CITIZENS TO BE COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD HEARD Mr. Jerry Boldt 300 North School Street In referencing the September 13, 2010 Daily Herald on -line article, Mr. Boldt stated the status of the personnel issue at Westbrook School should be a matter open to the public. Mayor Wilks stated this matter was under the jurisdiction of School District Board #57 not the Village Board of Mount Prospect; Mr. Boldt was encouraged to attend the School Board meeting. CONSENT AGENDA CONSENT AGENDA Trustee Korn, seconded by Trustee Juracek, moved to approve the following business items: MONTHLY REPORT 1. Monthly Financial Report — August 2010 & APPROVE BILLS 2. Bills dated September 1 to September 15, 2010 3. Minutes of the Regular Meeting Page 2 of 5 September 21, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect NEW BUSINESS NEW BUSINESS Mayor Wilks presented reconsideration of Ordinance 5812; an ordinance amending Chapter RECONSIDER. ORD 21 (Building Code) and Appendix A, Division I. The Village Board approved Trustee 5812; AN Matuszak's request for reconsideration of ORD 5812 by a vote of 6 -0 at the August 17, 2010. ORDINANCE WENDING Trustee Matuszak stated his request for reconsideration of the ordinance was specific to CHAPTER 21 Section 21.205 "Demolition of Buildings," of Article II, General Provisions, of Chapter 21 of (BUILDING CODE) the Village Code. As adopted the Village Code requires a demolition permit for accessory OF THE VILLAGE structures (Le. shed). Trustee Matuszak recommended the ordinance be amended to exempt CODE any residential accessory structures which are Tess than two hundred (200) square feet size from requiring a demolition permit for the removal of the structure. [Homeowners wishing to demolish an accessory structure under 200 square feet would not be required to obtain a permit.] Trustee Matuszak, seconded by Trustee Polit, moved to waive the rule requiring two (2) readings of an ordinance: Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried In response to questions from the Village Board, Community Development Director William Cooney, provided the following: • Exemption is only for free standing accessory structures under 200 square feet • Concrete pad from demolished shed can be used to build new shed; otherwise concrete pad should be removed. Village Board Comments • Fully support amendment to ordinance; removes unnecessary requirement for homeowners. Trustee Hoefert, seconded by Trustee Polit, moved for approval of Ordinance No. 5816: ORD 5816 AN ORDINANCE AMENDING ORDINANCE 5812, "AN ORDINANCE ORDINANCE AMENDING CHAPTER 21 (BUILDING CODE) AND APPENDIX A, DIVISION I Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. AUTHORIZE THE Mayor Wilks presented for a first (1 reading an ordinance authorizing the sale of certain SALE CERTAIN personal property owned by the Village of Mount Prospect. This ordinance allows the Village PERSONAL to sell its surplus items using one (1) of two (2) options; live public auction or GovDeals PROPERTY OWNED internet auction. BY THE VILLAGE OF MOUNT Trustee Hoefert, seconded by Trustee Korn, moved to waive the rule requiring two (2) PROSPECT readings of an ordinance: Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. Trustee Hoefert, seconded by Trustee Zadel, moved for approval of Ordinance No. 5817: ORD 5817 AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PERSONAL PROPERTY OWNED BY THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. Minutes of the Regular Meeting Page 3 of 5 September 21, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect RESOLUTION Mayor Wilks presented a resolution opposing the borrowing of Motor Fuel Tax distributions in OPPOSING THE exchange for the release of capital bill funding. Mayor Wilks provided background information BORROWING OF regarding the State's proposal and the Village's united opposition to the proposal with the MFT members of the Northwest Municipal Conference (NWMC). DISTRIBUTIONS IN The Village Board expressed their full and united support in opposition to the State's EXCHANGE FOR proposal; THE RELEASE OF CAPITAL BILL • Important to do resolutions of this nature — need to do more frequently to send message FUNIDNG to the State of Illinois from local level. • Send copy of resolution to legislators. • State penalizing municipalities that rely on this funding; cannot rely on reserve fund for municipal projects. • Important to educate residents as to how dependent local government is on State funds. • Another example of State attempting to erode power of Home Rule municipalities. • State not fulfilling its obligation to citizens; residents need to let State know this has to stop. • State's proposal — very bad funding proposal. • State owes municipalities both MFT and capital funds. • Failure to distribute funds owed to the Village adds to the Village's deficit. • NWMC — appreciate their efforts; solidarity among municipal members. In response to questions regarding distributive funds, Finance Director Dave Erb stated the Village is down about 25 %; per capita income tax. Trustee Hoefert, seconded by Trustee Polit, moved for approval of Resolution No. 32 -10: RES 32 -10 A RESOLUTION OPPOSING THE BORROWING OF MOTOR FUEL TAX DISTRIBUTIONS IN EXCHANGE FOR THE RELEASE OF CAPITAL BILL FUNDING Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. MANAGER'S VILLAGE MANAGER'S REPORT REPORT None. OTHER BUSINESS OTHER BUSINESS Trustee Korn stated Sunday, September 26 was Kid's Day at the Mount Prospect Lions Club Farmers' Market. In support of the Village's food pantry, which is in need of donations, the Lions Club will be accepting donations at the Market. Trustee Polit and Trustee Korn provided updates of the construction progress at the Randhurst site. CLOSED SESSION CLOSED SESSION Mayor Wilks asked for a motion to enter Closed to discuss: PERSONNEL 5 ILCS 120/2 (c) (1) -The appointment, employment, compensation, discipline performance, or dismissal of specific employees of the public body, including hearing testimony on a complaint lodged against an employee to determine its validity. PERSONNEL 5 ILCS 120/2 (c) (2) - Collective negotiating matters between the public body and its employees or their representatives, or deliberations concerning salary schedules for one or more classes or employees. Trustee Juracek, seconded by Trustee Polit, moved to meet in Closed Session to discuss PERSONNEL 5ILCS 120/2 (c) (1) and PERSONNEL 5 ILCS 120/2 (c) (2).
