HomeMy WebLinkAboutRes 25-01 04/17/2001 Resolution No. 25-01 A RESOLUTION OPPOSING ILLINOIS SENATE BILL 356 WHEREAS, the Village of Mount Prospect, with a population of 56,265, is a founding member of the Solid Waste Agency of Northern Cook County (SWANCC) along with 22 sister municipalities representing over 800.000 northwest suburban residents; and WHEREAS. the Village of Mount Prospect, through SWANCC, has worked to develop a safe, environmentally sensitive solid waste disposal facility in Cook County as a local solution to the region's waste management needs; and WHEREAS, for the last 15 years. SWANCC has worked to comply with all local, state and federal rules and regulations governing the development of a sanitary belefitl; and WHEREAS, the Illinois Environmental Pmtaction Agency (IEPA) found the site suitable and issued a permit to SWANCC to operate the balefill in accordance with strict IEPA requirements; and WHEREAS, after ten (10) years of litigation, the Illinois Supreme Court and United States Supreme Court have, in effect, given their approval to the balefill by ruling there is no legal reason to stop it; and WHEREAS, Senate Bill 356 (SB-356) was recently introduced in the Illinois Legislature as a blatant political attempt to deny SWANCC. and the 800.000 citizens it represents, the right to legally implement this much- needed regional facility; and WHEREAS, SB-356 would invalidate the permits and approvals legally issued to SWANCC on the basis that construction was not started within ten (10) years of the initial approvals even though the delay was caused by litigation brought by third parties; and WHEREAS, adoption of SB-356 at this time. and under the current cimumstances, would be completely disingenuous and reduce the State Legislative process to a mockery. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OP MOUNT PROSPECT, COOK COUNTY, ILLINOIS; SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby make known their strong opposition to Senate Bill 356 because it denies the rights of Mount Prospect and SWANCC to develop the balefill in accordance with applicable environmental rules and regulations. SECTION TWO: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby call on the House of Representatives to defeat Senate Bill 356 and preserve the right of Home Rule Municipalities to work together to develop an environmentally safe solution to a critical regional need for solid waste disposal facilities. SECTION THREE: That this Resolution be spread upon the Minutes of the Board of Trustees of the Village of Mount Prospect and that a copy hereof be immediately forwarded fo appropriate members of the State Legislature. SECTION FOUR: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: Timothy J. Corcoran, Paul Wm. Hoefert, Dennis G.
