Trustee Bruhi referred to item in the bills listing a Weller Creek payment to Bauer Engineering Co. for services rendered as con- sultant in conjunction with the SanitaryDistrict,.exp!aining tha: this service did not necessarily mean hiring of the Bauer fi~m, and asked for separate appravat. T~ustee Bruhi, seconded by Trustee Ekren, moved for approval of payment of $81.53 to Bauer Engineering Company for services rendered. Elk Ridge Elk Ridge Villa Uni: 6 which had just been submitted by Salvatore Villa Unit 6 Di Mucci and asked that it be rpferred to the Plan Commission for their study and recommendation at their nex: meeting of January 20th~ at which time the proper layout of streets be considered in view of the future school sites. Januai~y 7, 1964 945 Trustee Ek~en, seconded by Trustee Bickley, moved that this plat be referred to the Plan Commission for their study and recommendation. This motion carried by acclamation. Water Dept. Trustee Bickley, seconded by Trustee Casterline, chlorine moved tO open bids for sale of chlorine to Water Department. This motion carried by acclamation and the bids were read as follows: 1. Acid Products, Chicago $12.25 per CWT 2. Jones Chemicals, Inc. 12.50 per CWT 3. Rusch Chemical Co. 9.00 per CWT 4. Big Ben! Chemicals & Solvents 12.50 per CWT 5. Diamond Alkali Co. 13.00 per CWT T~ustee Casterline, seconded by Trustee Bergen, moved to refer above bids to the Water Superintendent for his recommendation to the Water Committee, their recommendation to be received the following week. Trustee Bruhl, seconded by T~ustee Ekren, moved that Garbage the Clerk be authorized to arrange for printing and distribution Health Dept.. of form to be used by business and industrial users of garbage service, which form had been approved by2the Board of Health. This motion carried by acclamation. Trustee Bruhl, seconded by Trustee Bergen, moved to Finance amend contract with Paul D. Speer re date of employment, drop- ping specified date and allowing for six months' notice before termination, directing the President to sign this contract and the Clerk~to attest the signature. Trustee Bruhl, Seconded by Trustee Bergen, moved that Finance the Village Board accept the audit report (No. 19) from the Department of Public Works & Buildings as submitted for period of January 1 th~u Dec. 31, 1962. This motion carried by accla- mation. The problem of selection of an auditor for Village Finance books for the coming year was referred to the Finance Committee for their recommendation. Trustee Bruhl ~eported that the residents near the Street island at Prospect Avenue and Elmhurst had requested that island paving be curbed. Trustee Casterline agreed to take this into consi- deration with his committee. Trustee Ekren read the following report re Zoning Case Zoning 65-21 re W-G Sales Corp.: Case 63-21 W-G Sales Heard July 26, 1963 - Reviewed Oct. l, 1963 Heard Nov. 29, 1963 - Reviewed Dec. 9, Dec. 20, !963 & Jan. 3, 1964. This case involves property at .415 E. P~dspect Ave. eo~- slating of 35,693 sq. ft., with 205 ft. fronting on E. P~ospect Ave. and 203 ft. in depth. The petitioner is asking for a rezoning from I-1 to R-4. Petitioner is occupying an office building di- rectly and contiguous to the West. There weme no objectors present at either of the public hearings. January 7, 1964 946 The Zoning Board of Appeals on Jan. 3, 1964 voted 6-1 to approve of 'the rezoning based upon a plan titled, "P~oposed 24-Unit Apartment Project"~ by RobertBabbin Associates, providing for a building of 7,125 sq. ft. (20%); 15,485 sq. ft. of paving for parking and roadway (43%); and 13~085 sq. ft. for landscaping E.F. Martin~ Chairman G.E. Jacobsmeyer, Acting Sec'y Trustee Ekren, seconded by Trustee Bickiey, moved to concur with the opinion of the Zoning Board of Appeals to approve the request as submitted, and that the Village Attorney be di- rected to draft ordinance granting rezoning. Trustee Ekren read petition for annexation signed by Annexation the legal representatives of the Church of the Nazarene, no Church of the electors on property, of property on Linneman Road north of Nazarene Dempster, legal description as follows: The west 477.89 feet as measured on the north line thereof of that part of the southwest quarter of the southeast quar- ter of Section 14, Township 41 North, Range i1 East of the Third Principal Meridian lying north of the northerly line of the right of way of the Common- wealth Edison Company, being a line described as beginning at a point in the east line of said southwest quarter of the southeast quarter which is t00.21' feet south of the northeast corner thereof, and running thence southwesterly 1344.38 feet to a point on the west line Df said south- west quarter of the southeast quarter which is 1010.48 feet north of the south line of said Section 14 (as measu~ad along said west line of said southwest quarter of the southeast quarter) in Cook County, Trustee Ekren, seconded by Trustee Bruhl, moved that the Village Attorney prepare ordinance of annexation for above t~act. Upon roll call: Ayes: Bickley Bruhl Bergen Ekren Casterline Absent: Phillips Motion carried. : Trustee Ekren referred to Case 63-10, Trendel and re- Zoning Case read report of the Zoning Board as shown in minutes of May 7, 63-10 1963 stating that decision in favor of rezoning from R-1 to R-4 was 4-2; and also referred to minutes of June 11, 1963 showing motion of Board to concur with the opinion of the Zoning Board to grant the annexation and rezoning, authorizing the Village Attorney to draft the necessary ordinances of annexation and rezoningo Januamy 7, 1964 9~7 Zoning Trustee Ekren then explained that the Village Board felt that the R-4 requirements were too loose and with the advices of Mr. Baughmann of %ech Search intended to change the ar~are- quirements of small apartments. With this in mind, the Judiciary Committee met with the developer, who agreed to reduce the planned number of~ apartments on this plat from, 390 to 305, or 25%. After-discussion, the Board made the following motion: ?-~ Trustee Bickley, seconded by Trustee Casterline, moved that : Mr. Baughmann be asked to prepare an amendment to the text of the existing z6ning ordinance regarding R-4 a~ea require- ments as soon as possible. One of the representatives of the Trendel interests, Mr. Petrolito~ stated that he would be willing to speak for the partners and accept a restriction of 2000 square feet, or 283 apartments for this tract if his firm could be allowed to go ahead as quickly as possible and start to build. The Board warned Mr. Petrolito that this would take at least a month, as hearing would have to be held before the. Zoning Board. Trustee Ek~en, seconded by Tmustee Bruhl, moved that above-men- tioned restriction be allowed for tract legally described in Case 63-10, and that further the attorney be directed to prepare :-- a pre-annexation agreement for submission to the Zoning Board and owners of title of the property in question. Trustee Ekren, seconded by Trustee Bruhl, moved for Ord. 947 the passage of Ord. 947: Annexation South Side Fire AN ORDINANCE ANNEXING CERTAIN VILLAGE-OWNED Station property PROPERTY TO THE V!LLAGE~ WHICH PROPERTY IS LOCATED NEAR THE INTERSECTION OF GOLF AND BUSSE ROADS AND WHICH IS COMMONLY REFERRED TOTAS PART OF THE SOUTH SIDE FIRE STATION SITE. The parcel consists of 168 feet in depth with 522 feet fronting on Church (Linneman) Road. "There were seven of several in attendance that voiced their ob- jections. One person mentionedthat'he represented a civic as- sociation. Mr. Frank Hines, aTtorney for School District #59 ('one of two legal objectors) mentioned' that he was representing this school district and listed some facts to support their objection to the proposed rezoning. Trustee Bickley reported that one of the Village Police ~-~ Dept. sergeants was now in attendance at Crime Lab in Chicago; re- Traffic, minded the Board that T~affic Survey hearing will be held at 8:00 Police P.M. Jansary 9th and that Mark Motors was the low bidder for the last two police cams. Trustee Ek~en, seconded by T~ustee Bruhl, moved that Waterworks plans and specifications for Water Works Impmovements Division E Div. e at Well #7 covering masonmy and pmefab metal well house, a deep well turbine pumpand motor, electrical ventilation and miscella- neous appurtenant work be appmoved and the Village Clemk be di- rected to advertise for bids thereon, said bids to be received February 4, 1964. Hatlen Trustee Ekren, seconded by Trustee Bruhl, moved that the Well 8 Village Manager be authorized and directed to secure bids for the sale of a 20,000 gallong pneumatic tank no longer used at Well #8 (Hatlen)o This motion carried by acclamation. Trustee Ekren read report from Mr. Eugene Baughmann dated Zoning - January 7 recommending that land used fo~ certain amusement put- Amusements poses be put into the Special Use category. This applies to any noisy outdoor type with glare lighting (skating rinks, etc.). Trustee Ekren, seconded by Trustee Casterline, moved that the Vil- lage Attorney be authmnized to draft tentative amendment to the Zoning Ordinance incorporating the suggestions outlined in Mr. Baughmann's letter of JanSary 7th. Zoning - Trustee Bickley, seconded by T~ustee Bergen, moved to R-4 Require- direct the Village Attorney to prepare zoning ordinance amendment ments changing the R-4 requirements from 1400 to 2000 sq. ft., this ten- tative ordinance to be submitted to the Zoning Board after pub- lished notice of public hearing. Trustee Ekren, seconded by Trustee Casterline, moved that Architect - the President be authorized and directed to sign the standard fo~m Fire House of agreement between Architect and Owner. for the services of Robert C. Swanson, who was previously hired to prepare plans for the new fire station. This morion carried by acclamation. County Zoning County Zoning Dockets 421, 422 and 423 were referred to the Judiciary Committee and. Village Attorney. Village Manager A~pl~by reported that in accordance with Water the authority.delegated, the auto crane was purchased from Hilsman and the truck from Des Plaines Motors Chevrolet. Both were low bidders. Water - Trustee Ekren reported that Citizens Utility Company had Ill. Commerce asked the Illinois Commerce Commission for increase in water rates. Commission Trustee Ekren, seconded by Trustee Bergen, moved that the Village Attorney be directed to send letter of protest to the Commerce Com- mission asking for hearing to be held in this regard. January 7, 1964 950 Trustee Ekren, seconded by Trustee Bruhl, moved to Well 7 authorize Mr. Appleby to approve Contract Supplement #1 with J. P. Miller Artesian Well Company for lower settings in Well 7, and asked that the president and clerk be authorized to sign Contract Supplement No. 1. Upon roll call: Ayes: Bruhl Bergen Bickley Ek~en Casterline Absent: Phillips Motion carried. The Board asked Mn. Appleby to attend County Zoning County Zoning hearing, Docket 687~ F~ank Vivirito, who is asking for busi- ness zoning on the north side of Rand Road near Foundry. Mr. James Hardy, 7 West Berkshire, appeared before Zoning, the Board, explaining that his zoning variation appeal had Case 63-29 been heard by the Zoning Board (Case 63-29) and had been turned do,fa. As this ease falls within the sole jurisdiction of the Zoning Board, the Trustees explained that it was not in their power to reverse the finding of the Zoning Board but that the Judiciary Co~mittee would take this matter under advisement.
