MINUTES APPROVAL OF MINUTES Trustee Juracek, seconded by Trustee Polit, moved to approve the minutes of the regular Village Board meeting held July 20, 2010. APPROVE BILLS APPROVE BILLS Mayor Wilks stated the next item on the agenda, "APPROVE BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." MAYOR'S REPORT MAYOR'S REPORT Mayor Wilks presented a proclamation for LIVE UNITED Week, which is the week of PROCLAMATION September 20, 2010, to Jim Tansor, Vice President of Northwest Suburban United Way. LIVE UNITED WEEK AMEND CHAPTER An ordinance was presented for second reading to delete the Class "F -3" liquor license 13 (ALCOHOLIC (Restaurant with lounge license) issued to JNK Restaurants INC. d /b /a Michael's Steaks & LIQUORS) OF THE Seafood, 113 South Emerson Street. APPOINTMENTS APPOINTMENTS Mayor Wilks had no board or commission appointment recommendations. CITIZENS TO BE COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD HEARD Mr. Louis Goodman, 310 N. School asked the Board about the status of the sidewalk at 216 N. Elm Street. Assistant Village Manager, David Strahl, noted staff had gone out to inspect the situation and there were minor improvements. He would ask staff to return to the site for a follow up and to address any remaining issues. CONSENT AGENDA CONSENT AGENDA Trustee Matuszak, seconded by Trustee Juracek, moved to approve the following business items: 1. NEW BUSINESS NEW BUSINESS An ordinance was presented for first reading to grant a Conditional Use permit for a gymnastics school located at 550 Business Center Drive. Deputy Director of Community P &Z 09 -10 Development Brian Simmons explained that the gymnastic school has been operating for 550 BUSINESS several years, on what started out to be a temporary basis, through an agreement with the CENTER DRIVE River Trails Park District. Once the arrangement became permanent the petitioner started THE GYMNASTICS the process to ensure the business had met the necessary requirements to operate at this SHOP location. The Board asked questions regarding business license status; if proper insurance had been obtained and if there needed to be a change to the property's tax status. The petitioner, Julian Basler, was present and addressed the Board's concerns. Mr. Basler noted that he does have the necessary insurance and license to operate. Assistant Village Manager David Strahl noted that the property's tax status needed to be handled through the Park District. Minutes of the Regular Meeting Page 2 of 5 August 3, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect Trustee Zadel, seconded by Trustee Polit, moved for approval of Ordinance No. 5806: ORD 5806 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 550 BUSINESS CENTER DRIVE, THE GYMNASTICS SHOP Upon roll call: Ayes: Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. Community Development Deputy Director Brian Simmons, presented the next ordinance that TEXT was a text amendment for Chapters 8, 10, and 23. The changes to the Chapters were AMENDMENTS housekeeping in nature. Highlighted changes were: clarification of notices on rental CHAPTERS 8, 10 dwellings; clarify time limit for appeals of a license denial; and clarification on collecting AND 23 outstanding judgments. Trustee Juracek, seconded by Trustee Zadel, moved for approval of Ordinance No. 5807: ORD 5807 AN ORDINANCE AMENDING CHAPTERS 8, 10 AND 23 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS REGARDING HEARINGS, NOTICES AND PENALTIES RELATED TO LICENSES, LANDLORD — TENANT AND ADMINISTRATIVE ADJUDICATION Upon roll call: Ayes: Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. The next ordinance presented for a first reading repeals Articles V and VI of Chapter 19. The TEXT AMENDMENT changes would repeal public swimming pool and spa requirements to eliminate duplication of CHAPTER 19 services with the Cook County Department of Public Health. Trustee Zadel, seconded by Trustee Matuszak, moved to waive the rule requiring two readings of an ordinance. Upon roll call: Ayes: Korn, Matuszak, Polit, Zadel Nays: Juracek Motion carried. Trustee Zadel, seconded by Trustee Juracek, moved for approval of the ordinance. Trustee Juracek was concerned that the pools in Mount Prospect were not compliant with the federal drain protection standards. A recent newspaper article stated that only DuPage County is inspecting pools for this drain protection standard. Community Development Deputy Director Brian Simmons, stated that Mount Prospect public pools are currently compliant with the federal standard. Mr. Simmons also noted that there is a redundancy of services with the State, County and the Village making similar inspections to the pools. Other questions dealt with what governmental entity would handle the inspections and the records of the inspections; how often and when the inspections would be conducted; and if there was a fee charged. Minutes of the Regular Meeting Page 3 of 5 August 3, 2010 of the Mayor and Board of Trustees of the Village of Mount Prospect It was suggested that staff research the questions raised by the Board and revisit the ordinance at the August 17, 2010 Village Board meeting The motion and second to adopt the ordinance were withdrawn. The motion and second to waive the rule requiring two readings of an ordinance were also withdrawn. The ordinance repealing Articles V and VI of Chapter 19 in regard to public spas and swimming pools would be discussed at the Village Board meeting on August 17, 2010. Community Development Deputy Director, Brian Simmons, presented the next ordinance that was a text amendment for Chapter 8. This change would extend the time limit to file TEXT AMENDMENT liens for demolition from 60 days to 180 days which is the maximum permitted by State law. CHAPTER 8 Extending the time to file the lien allowed the Village more leeway in filing and recouping the costs incurred for demolition. Trustee Zadel, seconded by Trustee Matuszak, moved for approval of Ordinance No. 5808: ORD 5808 AN ORDINANCE AMENDING CHAPTER 8 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS LIEN FOR DEMOLITION Upon roll call: Ayes: Juracek, Korn, Matuszak, Polit, Zadel Nays: None Motion carried. An ordinance amending Chapter 21 and Appendix A division I of the Village Code was presented. This ordinance would establish regulations for demolition of structures and site TEXT AMENDMENT restoration activities. These modifications to the code include: requiring properties to be CHAPTER 21 & restored to natural condition after demolition if a building permit is not obtained to continue APPENDIX A development; requiring a security deposit to the Village equal to the value of all work associated with demolition; and requiring sediment and erosion control plans for commercial demolitions. There was discussion about how accessory structures would be handled; the process for asbestos removal and thoughts on clarification of wording in the ordinance. The ordinance amending Chapter 21 would be held for further discussion at the Village Board meeting on August 17, 2010. Fire Chief Mike Figolah explained that in November of 2009 the Village Board had authorized AMBULANCE 523 the purchase of two new ambulances from Foster Coach Sales to replace ambulances 520 SURPLUS and 523. At this time the Fire Department is requesting the Board's approval to declare ambulance 523 as surplus so it can be sold. Chief Figolah noted that Care On EMS of Van Buren, Arkansas has agreed to purchase ambulance 523 for $29,500. VILLAGE MANAGER'S REPORT Assistant Village Manager David Strahl, noted the following dates: MANAGER'S August 3: National Night Out, Woodland Trails Park - 1500 E Euclid Ave REPORT August 10: Joint Workshop with Village Board and Finance Commission OTHER BUSINESS Mayor Wilks noted that the Historical Society held a Stadtmitte History Crawl on July 30` that OTHER BUSINESS was quite successful. She informed the audience that Stadtmitte roughly translates to 'downtown'. Trustee Korn recently visited the Randhurst Village work site and commented on the progress at the site. He encouraged everyone to check out the site. It was noted that the Sports Authority would be opening their new location at Randhurst Village in August. Trustee Polit invited everyone to attend the Youth Commission meeting being held on August 4th at 7 p.m. at the Police and Fire Building.
