HomeMy WebLinkAboutRes 11-45 10/12/1945 No. 11-45 RESOLUTION PERTAINING TO FORECLOSURE OF THE LIE.1 OF SPECIAL ASSESSMENTS ON VACANT AND UNIMPROVED PROPERTY. WHEREA , hundreds of vacant and unimproved lots, parcels and tracts of land within the corporate limits of the village of Mount Prospect are burdened with delinquent and forfeited general taxes, delinquent and forfeited special assessments and delinquent and forfeited drainage benefit assessments; and WHEREAS, the said burden of delinquent and forfeited general taxes, special assessments and drainage benefit assessments make such vacant real estate unavailable for use; and WHEREAS, the amounts of delinquent and forfeited general taxes, special assessments and drainage benefit assessments are in excess of the value of said land thereby impeding the progress, develop - ment and well being of the village at large; and WHEREAS, every effort to collect said delinquent and forfeited assessments has been without avail; and WHEREAS, Article 84 -56 of Chapter 24 of the Illinois Revised Statutes, among other things, provides that the village may, at any time, file a bill to foreclose the lien of special assessments as an additional method of collecting delinquent special assess - ments; and WHEREAS, it is desirable, and for the best interests of the Village that the liens of delinquent and forfeited special assess - ments be discharged by forclosure proceedings, thereby making said land available fo r use and returning it to the tax rolls; now, therefore; BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1. That the Village of Mount Prospect hereby adopts the foreclosure of the lien of delinquent and forfeited special assessments as an additional method to enforce the collection of delinquent and forfeited special assessments on vacant and unim- proved real estate. Section 2. That it will consider all applications filed with a committee to be designated by the President and Board of Trustees when the applicant will :(1) produce satisfactory evidence that the lien of the general taxes will also be foreclosed; (2) indemnify and hold harmless the village of Mount Prospect for any costs, ex- penses and legal fees in prosecuting such action; and (3) will guarantee to make an acceptable minimum bid at the public sale which may be ordered by the court in which such action may be in- stituted, to save the village from prosecuting a fruitless cause of action. Section 3. That all actions for the foreclosure of delinquent and forfeited special assessment liens shall be brought in the name of the Village of Mount Prospect by and through its attorney and shall be filed separately from any action for the foreclosure of general taxes; provided, however, that joint action with any of the drainage districts effected hereby may be filed in the discre- tion and judgment of the attorney for the village. Section 4. That the States Attorney of Cook County and the officials and attorneys for the Drainage Districts effected are hereby invited to participate and cooperate in this method of clearing up said tax and assessment delinquencies. Section 5. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 6. That this resolution shall be in full force and effect forthwith upon its passage and adoption. PASSED this 12th day of October, A.D. 1945. APPROVED this 12th day of Octobe I__ __A,4D. 1945.
