HomeMy WebLinkAboutRes 07-46 02/05/1946 F O : S 2 -5 -46 Thal x 4 A RESOLUTION TO FORECLOSE THE LIEN OF SPECIAL ASSESS- MENTS OF CERTAIN PROPERTIES IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS. — WHEREAS, ordinances have heretofore been adopted providing for the construction of certain water, sewer, sidewalk and paving improvements in portions of the Village of Mount Prospect, Cook County, Illinois; and WHEREAS, special assessments were levied to pay the cost of said work and pursuant to the statute applicable thereto said im- provements were constructed and the report of cost and completion was approved in manner and form provided by law; and WHEREAS, certain installments of said special assessments levied against individual lots have not been paid and are now past due and delinquent; and WHEREAS, the President and the Board of Trustees find that it will be for the best interests of the Village that said special lassessment liens be foreclosed; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of ;fount Prospect, Cook County, Illinois: Section 1. That the special assessment liens against the following described real estate, to -wit: Lots 16, 19 and 20 in Block 3 in Prospect Park Subdi- vision No. 1; in Section 12, Township 41 North, Range 11; Lot 11 in Block 4 in Busse & Wille's Resubdivision in Mount Prospect in Section 12, Township 41 North, Range 11; Lot 7 in the subdivision of that part of the South half of the East half of the Southwest quarter of the Southeast quarter lying West of the East 349.20 feet of Section 34, Township 42 North, Range 11 also Lot 11 in said Section 34, Township 42 North Range 11 as above described; and Lot 20 in Block 15, Prospect Manor being a subdividivision of art of the South Three quarters of the West half of the West Half of Section 34, Township 42 North, Range 11; all East of the 3rd Principal Meridian be foreclosed. Section 2. That the attorney for the Village of Mount ;Prospect be and he is hereby authorized and directed to prosecute said foreclosure suit as he may deem best, and to cooperate with r i t the States Attorney of Cook County in procuring the foreclosure of the lien of the general taxes on said lots if any there be, which this Board requests the States Attorney to foreclose; and to cooperate with the officials of the Weller Creek Drainage or any other district in procuring the foreclosure of the lien of drainage benefit assessments upon said lots•, if any there be, which this Board hereby requests said Drainage Districts to fore- close; that said attorney is hereby authorized to file suit for foreclosure or to join in any suit or suits to foreclose institu- ted by the States Attorney to foreclose the lien of general taxes and to take such other steps as he deems proper to procure the prompt sale of said property to satisfy said liens. Section 3. That all resolutions or parts of resolutions in conflict herewitl be and the same are hereby repealed. Section 4. That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 5th day of February, 1946.
