HomeMy WebLinkAboutRes 30-46 11/06/1946 FMO *AGH 1&4c 11/6/46 RESOLUTION TO FORECLOSE THE LIEN OF SPECIAL ASSESSMENTS No. 3o -4G # # * * # # WHEREAS, Ordinances have heretofore been adopted pro- viding for the construction of certain water, sewer, sidewalk and paving improvements in portions of the Village of Mount Prospect, Cook County, Illinois; and WHEREAS. special assessments were levied to pay the cost of said work and pursuant to the Statute applicable thereto said improvements were constructed and the report of cost and com- pletion was approved in manner and form provided by law; and WHEREAS. certain installments of said special assess- ments levied against individual lots have not been paid and are now past due and delinquent; and WHEREAS, the President and the Board of Trustees find that it will be fore the best interests of the Village that said special assessment liens be foreclosed; NOW. THEREFOR', BE IT RESOLVED by the - President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That the special assessment liens against the following described real estate, to -wit: Lot 17 in Block 10 of Busse Eastern Addition to Mount Prospect, a subdivision of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; be foreclosed. Section 2. That the Attorney for the Village of Mount i • . I II ' I • Prospect be and he is hereby authorized and directed to prosecute said foreclosure suit as he may deem best, and to cooperate with the State's Attorney of Cook County in procuring the foreclosure of the lien of general taxes on said lots, if any there be, and this Board requests the State's Attorney to foreclose and to cooperate with the officials of the Weller Creek Drainage or any other district in procuring the foreclosure of the lien of drain- ' age benefit assessments upon said lots, if any there be, and this Board hereby requests said Drainage Districts to foreclose; that said Attorney for the Village is hereby authorized to file suit for foreclosure or to join in any suit or suits to foreclose I instituted by the State's Attorney to foreclose the lien of gen- eral taxes and to take such other steps as he deems proper to procure the prompt sale of said property to satisfy said liens. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 4.
