QUILICI, et al. vs.VILLAGE OF ,MOUNT PROSPECT BE IT RESOLVED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: That the Village Attorney of the Village of Mount Pros- pect, Cook County, Illinois, be and he is hereby authorized and directed to prosecute an appeal to the Supreme Court of the State of Illinois on the judgment rendered by the Honorable Harry M. Fisher, Judge of the Circuit Court of Cook County, Illinois in the matter entitled "George L. Quiliai and Virginia I. Quilici vs. Village of Mount Prospect, an Incorporated Village" Circuit Court of Cook County case No. 47 C 2731. PASSED: this loth day of June, A.D. 1947. Gentlemen* The Zoning Commission met oa June 9 1947 to consider the recent Court ruling on the rezoning of Tots 39,40,41 in Block 22 of Busse's Eastern Addition (Befng the North west corner of Edward and Northwest Highway) The ruling went against the town, making It obligatory to revise the existing ordinance. The property in question was conveyed in 1927 with the real estate operator's assurance that business zoning would continue on that property until 1975. It is questionable whether such assurances can be binding on a town. The property in question is unimproved. Based on that fact, confiscation is mot involved in the re— zoning. The Court's opinion appears to give legality to spot zoning. It also to deny forever the right of anyone to rezone any property. w is5 it further appears that the town's case prepared. The Zoning Commission is of the unanimous opinion that the Court ruling should be appealed. •
