WHEREAS, the President and Board of Trustees of the ;Village of Mount Prospect, Cook County, Illinois, did pursuant Ito recommendation of the Board of Local Improvements of the Village of Mount Prospect duly adopt an Ordinance entitled "An Ordinance for the Improvement of Elmhurst Road, Russell Street !and other streets within the Village of Mount Prospect, Cook County, Illinois, by grading, curbing and paving, etc., includ- ing the cost of furnishing all labor, equipment and material. ", and pursuant to said Ordinance a petition for the special assess- !Sment of the cost of the improvement of Elmhurst Road, Russell Street and other streets within the Village by grading, curbing { an' paving, etc. , was filed in the County Court of Cook County, Illinois, on June 10, 1948, which said proceeding is known and !designated as "Mount Prospect Special Assessment No. 49 A "; and 3i WHEREAS a ludgment of confirmation was entered in said proceeding in the County Court of rook County, Illinois, on g A uguh t 26, 1948 and which said judgment is now in full force and effect; and fi WHEREAS the Board of Local Improvements after the entry fi k . { of the ludgment of confirmation advertised for bids three times; !that no bids were received or accepted and that no contract was ]..et or entered into for the making of said improvement within the time fixed by law for the letting of the contract and that no collection of such assessment had been made by the Village t ;;Collector- Treasurer; and that there are no unpaid claims or debts against said proceeding; and 1ERFAS,., it appears that because of the high costs of materials and the inability to market or sell special assessment bonds contemplated to be issued. in payment of the work under this proceeding and thereby being unable to procure bids for the con- struction of said improvement, it is found. necessary and desirable that said improvement be abandoned and the proceedings in the County Court dismissed. NOW, THEREFORE„ BE TT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT,, COOK COUNTY, ILLINOIS, TEAT: • SECTION ,,k The proceedings heretofore instituted under and by an ordinance entitled. That the Attorney for the Village be and he isa ,whereby authorized and directed to petition the County Court of Cook County, Illinois,, to annul and vacate the Judgment of confir- `mation heretofore entered in said cause on August 26, 1948 and for the dismissal of said proceedings in the matter of the petition of the Village of Mount prospect for the special assessment of the c' cost of improvement of Elmhurst Road, Russell Street and other t9 streets within the Village by grading, curbing and paving, etc., 9 a g { � g ` which said proceeding is designated as " Mount Prospect Special IA Assessment No. 49 A".
