RESOLUTION authorizing the filing of
a Petition to detach lands from the
WelleI Cl-eek Drainage District and the
Feehanville Drainage District within the
Village.
!,OHEREAS, the Village of Mount Prospect is exercising storm drainage
powers within its corporate boundaries; and
WHEREAS, the We Her Creek Drainage District and the Feehanville
Drainage Distrid are also and have been for many years last past, exercising
su~~h drainage powers within the Village limits; and
WHEREAS, it is pl'ovided in Section 8.15 of Article VIll of Chapter 42
of the Illinois Revised Sta.tuteB" 1955, that where municipal corporations shall
exercise storm drainage powers in the sar.:'le territory" lands so served may
be detached by the filing of a petition in the County Court; and
WHEREAS, it is desirable and for the best interests of the citizens of
the Village of Mount Prospect that itbavethe sole control of drainage problems;
NOW, THEREFORE, BE IT RESOLVED by the Preeident and Board of
Tl'ustees of the Village of Mount Prospect; Coo!t County, IBinoia:
SECTION 10 That th~ Village Attor17..~y and Howard B. Bryant as
Special Counael~ be and they are hereby authorized and directed to file the
necessary petitions and proceedings in the County Court of Cook County" Illinois
pursuant to the provisions of Section 8-15 jete,. Article VIII of Chapter 4l of
the Illinois Revised Statutes, 1955 to detach lands lying within the Village as
follows:
(a) All that part of Weller Creek Drainage District lying within
the corporate bounda.ri~s of the Village of Mount Prospect;
{b} All th?t part of the Feehanville Dra.inage District lying within
the corporate boun.daries of the Village of MOWlt Prospect,
SECTION l. That this Resolution shall be in full force and effect
forthwith upon its passa.ge and approval <i.ccol'ding to law.
