'" Resolutions Proposed by the Board of Trustees of the Village of Mount Prospect, Cook County, Illinois, Authorizing and Directing the Purchase of Certain Real Property From Joseph A. lJebel'"' and Hargaret E. Heber. vlHEHEAS, negotiations have taken place v'lith Joseph A. Heber and Margaret E. Heber regarding the purchase of property by the Village of Mount Prospect for the purpose of furnishing off-street par~ing and for other municipal purposes, and i'lBEREAS, it is deemed advisable and desirable that the Village of Mount Prospect purchase the property hereinafter described and as part of the purchase price pay the taxes on said property for the years 1955 and 1956, said negotiations have continued for that period, and \"iHEREAS, the purchase of the property serves a much needed municipal purpose, NOltl, THEREFORE, BE IT RESOLVED: That the Village of Mount Prospect, Cook County, Illinois, is hereby authorized to purchase at a price of Twenty Thousand Dollars ($20,000.00) the folloVling described real estate, in the County of Cook and State of Illinois: Lots 2 through 9 inclusive, in J. A. Weber's Addition to Mount Prospect, being a subdivision of part of the East half of the Northwest quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, .. - 2 - from Joseph A. \'leber and r'1argaret E. liebeI' for the purpose at the present time of furnishing off-street parking facilities for the citizens, residents and visitors of the Village of Nount Prospect, Illinois, and for other municipal purposes. BE IT FURTHER RESOLVED: That the President and Village Clerk are hereby authorized and directed to execute on behalf of and in the name of the Village of Hount Prospect a certain real estate contract \.'Ii th the said Joseph A. liebeI' and r.Iargaret E. lileber (a copy of which is attached hereto and made a part of these minutes), ~Ihich contract provides for payment of the purchase price of $20,000.00 by the Village of Mount Prospect in in- stallments and for a deposit in escrow by the Village of Mount Prospect of a reconveyance deed of the above described property, which Hill be held by the named escrowee until final payment of the purchase price and vIill be recorded by the named escrovJee in the event of a default in payments by the Village of Mount Prospect. If a report on title is furnished, seller shall deliver such guarantee pp,licy' at the time of delivery of deed, but seller upon furnishing such report shall not be in default for failure to" furnish such policy until ten days after written demand therefor by purchaser. If the report on title or guarantee policy so required to be furnished by the seller discloses any defects in title (other than such usual objections contained in owners policies and the matters to which this sale is subject by the terms hereof), seller shall, upon tendering the same to purchaser or his agent within twenty days from the date hereof, have sixty days from the date which such report or guar- antee policy bears within which to cure such defects and to furnish such guarantee policy or a later report showing such defects cured or removed. Every guarantee policy or report on title furnished by the seller hereunder shall be c,onClusive evidence of good title as therein shown, subject only to the exceptions therein stated. If such defects in title be not cured within said sixty days, purchaser may terminate this contract or may, at his ~lection, take the title as it then is (with the right to deduct from the purchase price liens or encumbrances of a definite or ascertainable amount), upon giving to seller or his agent notice of such election and tendering performance on his part, and in default of such notice of election or tender of performance within ten days after written notice to purchaser or his agent of the inability of seller to cure such defects this contract thereupon shall, without further action by either party, become null and void. If this contract be terminated except for purchaser's default, said earnest money shall be returned to purchaser. If purchaser defaults hereunder, then, at the option of seller, said earnest money shall be forfeited as liquidated damages and this contract thereupon shall become null and void.
