HomeMy WebLinkAboutRes 15-57 07/23/1957 RESOLUTION NO. 4t~ ~7 RESOLUTION OF THE PRESIDENT AND BOARD OF TRUSTEES OF TEE VILLAGE OF MOUNT PROSPECT COOK COUNTY, ILLINOIS WHEREAS, in the interest of, and to promote and protect the general safety of the citi~ens and the Village of Mount Prospect, and to promote their general welfare it is deemed desirable by the president and Board of Trustees of the Village of Mount Prospect that a policy be established with respect to the installation of sidewalks in residential districts within said Village; and WHEREAS, in furtherance of the general welfare and safety of the residents of the Village it is the opinion of the President and members of the Board of Trustees, after careful study and analysis of various problems relating thereto that in residential property presently developed when public sidewalks have not as yet been installed, where con- ditions permit and are practicable, sidewalks of the parkway type should be located not more than one (1) foot from the property line and shall be not less than five (5) feet wide, and that in addition to the reasons hereinabove set forth, it is the opinion of the President and Board of Trustees of the Village that said location of sidewalks will also, during the winter season, facilitate the removal of snow from the sidewalks and streets, and also promote and protect safety of small children playing on said sidewalks as contrasted with curb-type sidewalks which are located immediately adjacent to the street; and WHEREAS, it is recognized that physical conditions prevailing in certain blocks within the Village may make it - 2 - desirable that an exception be made by allowing curb-type sidewalks; and miEREAS, in new subdivisions and in unimproved residential lots it is and hereafter shall be the policy of the President and Board of' Trustees of this Village to re- quire sidewalks to be installed, said sidewalks of the parkway type to be located not more than one (1) foot from the property line and not less tl1an five (5) feet wide and built in accordance with specifications approved and authorized by the President and Board of Trustees of the Village; and W11EREAS, it is the desire of the President and Board of Trustees that sidewalks be installed on residential property presently improved on a voluntary basis in accordance with this resolution, said work to be perfornled on or before September 15, 1957. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: 1. Effective immediately all residential property hereinafter developed within the Village of Mount Prospect shall have constructed thereon sidewalks of the parkway type located not more than one (1) foot from the property line and not less than five (5) feet wide, built in accordance with specifications as may be from time to time adopted, approved and authorized by the President and Board of Trustees of the Village and on file with the Village Manager. - 3 - 2. Notwithstanding the provisions contained in A property Paragraph 1, upon a petition presented by lOO~o of the owner s in any block within the Village, said petition requesting authority to put in curb-t":lpe sidewalks not less than five (5) feet in width, and said petition stipulating that the property owners agree to put in crosswalks at intersections and that all work shall be done without public benefit and at the sole ezpense of the property owners and further agree that all snow shall be removed from said curb-type sidewalks onto the property side and not on public streets, then the Village l\:Ianager is authorized to hereafter permit curb-type sidewalks; provided however, that no existing sidewalks of the parkway type shall be removed in order to install curb-type sideHalks. For pur- poses of this resolution, a block is defined to mean one side of a street from cross street to cross street. 3. vfuerever and whenever within the Village of Mount Prospect sideHalks are to be constructed by special assessment or special taxation, any and all sidewalks con- structed thereby shall be of the parkt-va:r type located not more than one (1) foot from the property line, shall be not less than five (5) feet wide, and shall be built in accordance with specifications as may be from time to time adopted, approved and authorized by the President and Board of Trustees of the Village and on file with the Village Manager. 4. All developed residential property located within the Village of Haunt Prospect which does not have sidewalks thereon, shall have sidewalks installed thereon by the property owners in accordance with this resolution on or before September 15, 1957.
