GUNNELL, are the owners of the premises located at the South East corner of the intersections of Elmhurst Road (Route 83) and Foundry Road on which there is presently located "GUNNELL BOWLING LANES!l and which is legally described as follows, to-wit: The North 274.6 feet of that part of the North West quarter of the North East quar- ter of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, lying West of center line of Rand Road, also the South 87 feet of the North 361.6 feet of that part of the North West quarter of the North East quarter lying West of center line of Rand Road of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, ; and WHEREAS, LAURA POPP, FRANK POPP and ANDREW POPP, as the heirs-at-law and devisees of GEORGE POPP, deceased, are the Owners of the premises located at the North West corner of the intersections of Rand Road (Route 12) and Foundry Road and on which there is presently located the EL RANDO TAVERN, said property being legally described as follows, to-wit: .....;l PARCEL #1 That part of the South West Quarter of Section 2'7, Township 42 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at a point in the center line of Rand Road, 407.55 feet North Westerly from the point of intersection of said center line of Rand Road with the East line of said South West quarter of Section 27 aforesaid; thence West on a line parallel to the South line of said South West quarter, 252.39 feet; thence South on a line parallel to the East line of said South West quarter, 482.08 feet to the South line of Section 27 aforesaid (being also the center line of Foundry Road); thence East on said South line of Section 27 aforesaid, 376.06 feet to a point 175.51 feet West of the South East corner of the South West quarter of said Section 27; thence North 365.71 feet to the center line of Rand Road; thence North Westerly on the center line of Rand Road, 166.27 feet to the place of beginning; ALSO - 2 - PARCEL #2 That part of the South West quarter of Section 27 aforesaid described as follows: Commencing at the South East corner of South West quarter of said Section 27; run- ning thence West on South line of South West quarter of said Section 27, 175.51 feet; thence North parallel with East line of South West quarter of Section 27 aforesaid; 365.71 feet to center of Rand Road; thence South Easterly on center line of Rand Road, 241.28 feet to East line of the South West quarter of Section 27; thence South on said East line of South West quarter of Section 27, 196.10 feet to place of beginning, all in Cook County, Illinois, , and WHEREAS, said Owners have legal title to the middle of Foundry Road immediately adjacent to and adjoining the above described properties; and WHEREAS, the said properties not within a public right of way are not within the corporate limits of the VILLAGE OF MOUNT PROSPECT, a Municipal Corporation, but are in the Un- incorporated area of Cook County, Illinois, and, therefore, are subject to its rules and regulations pertaining to zoning and other matters; and WHEREAS, said VILLAGE OF MOUNT PROSPECT, a Municipal Corporation, has annexed to the Corporate limits of the VILLAGE certain roadways more particularly described in Ordinance No. 638, part of said roadways being adjacent and contiguous to the property owned by the Owners herein, and that said Owners have indicated their objections to said proposed annexation at var- ious meetings of the VILLAGE BOARD OF MOUNT PROSPECT, a Munici- pal Corporation, and that said Owners have indicated that they are considering necessary legal action to contest the validity of said annexation and the additional proposed annexation of the so-called llBURMEISTER PROPERTyl1 which is North of the pro- perty owned by JACK H. and LILLIAN L. GUNNELL, and that said VILLAGE OF MOUNT PROSPECT has indicated to said Owners that if - 3 - they will not take legal action against the annexation of ei ther Foundry Road or the so-called "BURMEISTER PROPERTY, 11 that said VILLAGE will not now or hereafter either propose or entertain the annexation of the properties of the Owners herein, and that said Owners have represented to the corporate authorities of said Village they shall not proceed with any such legal action; and WHEREAS, the corporate authorities of the Village believe it is in the public interest to avoid litigation when solutions to problems so presented are in the public interest and by adopting this resolution do not in any manner express concern of the legality of the enactment of Ordinance No. 638, NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: That the VILLAGE OF MOUNT PROSPECT, a Municipal Cor- poration, by and through its Board of Trustees, does not now contemplate the annexation of the property hereinafter described as follows, to-wit: The North 274.6 feet of that part of the North West quarter of the North East quarter of Sec- tion 34, Township 42 North, Range 11, East of the Third Principal Meridian, lying West of center line of Rand Road, also the South 87 feet of the North 361.6 feet of that part of the North West quarter of the North East quarter lying West of center line of Rand Road of Sec- tion 34, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, and PARCEL #1 That part of the South West quarter of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at a point in the center line of Rand Road, 407.55 feet North Westerly from the point of intersection of said center line of Rand Road with the East line of said South West quarter of Section 27 aforesaid; thence West on a line parallel to the South line of said South West quarter, 252.39 feet; thence South on a line parallel to the East line of said South West quarter, 482.08 feet to the South line of Section 27 aforesaid (being also the - 4 - center line of Foundry Road); thence East on said South line of Section 27 aforesaid, 376.06 feet to a point 175.51 feet West of the South East corner of the South West quar- ter of said Section 27; thence North 365.71 feet to the center line of Rand Road; thence North Westerly on the center line of Rand Road, 166.27 feet to the place of beginning; ALSO PARCEL #2 That part of the South West quarter of Section 27 aforesaid described as follows: Commencing at the South East corner of South West quarter of said Section 27; run- ning thence West on South line of South West quarter of said Section 27, 175.51 feet; thence North parallel with East line of South West quar- ter of Section 27 aforesaid; 365.71 feet to cen- ter of Rand Road; thence South Easterly on center line of Rand Road, 241.28 feet to East line of the South West quarter of Section 27, thence South on said East line of South West quarter of Section 27, 196.10 feet to place of beginning, all in Cook County, Illinois; nor will it consider or entertain, at a future date, a possible annexation of said premises either by referendum or any other legal means of annexation, other than by petition of the Owners of said premises. IT IS FURTHER RESOLVED by the PRESIDENT AND BOARD OF TRUSTEES of the VILLAGE OF MOUNT PROSPECT, a Municipal Corpora- tion, by and through its Board of Trustees that the purpose of this resolution is to express the appreciation of the Board of Trustees to the Owners of the hereinabove described property for their cooperation with the said VILLAGE OF MOUNT PROSPECT and its Board of Trustees in not contesting said annexation hereinabove described, which they believe to be beneficial to the interests of the VILLAGE OF MOUNT PROSPECT, a Municipal Corporation.
