HomeMy WebLinkAboutRes 10-59 03/10/1959 RESOLUTION NO. 119 - s;:9 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the corporate authorities of the Village of Mount Prospect have heretofore annexed the property de- scribed as follows: The South 1653.37 feet of the East 1/2 of the Southwest 1/4 (measured on the East line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows: commencing at the Southeast corner of the Southwest 1/4 of Section 35, thence West along the South line of the said Southwest 1/4 for a distance of 1108.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginningj thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mount Prospect Road extended North, thence South 62.11 feet along said West line to the point of begin- ningj and excepting from said tract that part thereof described as follows: commencing at the Southeast corner of the Southwest 1/4 of Section 35, thence West along the South line of the said Southwest 1/4 for a distance of 1318.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginningj thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57 degrees and 17 minutes with the last described line measured from Southeast to South for a distance of 197.02 feet to the point of beginningj and excepting from said tract that part of the East 1/2 of the Southwest 1/4 of said Section 35, which lies South of the Southerly line of Rand Road (Route 12) and West of a line described as beginning at a point on the South line of the said Southwest 1/4 1318.91 feet West of the Southeast corner of said Southwest 1/4; thence running North along a line which makes an angle of 90 degrees with the South line of said Southwest 1/4 to the Southerly line of Rand Road (Route 12), and excepting therefrom that part of said tract lying in Rand Road, Central Road or West Ga te Road, A L S 0 The Southwest 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part of the Southwest 1/4 of the Southwest 1/4 lying Southwesterly of the Northeasterly Right of Way line of Rand Road) in Coo~ County, Illinois. AND vlHEREAS, heretofore said property was zoned "B_I" by Ordinance No. 643; and VlHEREAS, the owners of said land did file a certain covenant in the Office of the Recorder of Deeds of Cook County providing as follows: In consideration of the zoning of the property lIB_I" by the Village of Mount Prospect, Cook County, Illinois, pursuant to case No. 58-16 it is agreed and covenanted in the event that application shall not be made for a building permit as hereinafter provided, and said building permit not issued prior to November 1, 1961, then the owners of said land agree and consent to any action taken by the Village Board of the said Village of Mount Prospect to rezone said land for the uses permitted under an "R_l" classification as set forth in the Zoning Ordinance of the Village of Mount Prospect in effect as of Outober 1, 1958; provided, however, that such action by the Board of Trustees of the Village of Mount Prospect shall be taken not later than February 1, 1962, after which date, if no such action is taken, this covenant shall be void. Said application for a building permit shall be for the erection of a shopping center substantially in accordance with the plans submitted by the Petitioner at the public hearing in said case No. 58-16 and on file with the Village of Mount Prospect. Nothing herein contained shall impair the right of the owner or future owners of the land to apply to the Village of Mount Prospect at any time for variations, changes or amendments in the zoning ordinances applicable to said land, or, in the event said land is rezoned IIR_l", to institute such - 2 - ~, , proceedings as they desire, to vary, alter or amend the zoning laws or ordinances affecting said land. The purpose of this covenant is solely to permit the Village of Mount Prospect, if it so desires, within the time limits above set forth, to rescind the zoning granted pursuant to case No. 58-16 if a permit is not issued as aforesaid. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: That the plat hereto attached and marked Exhibit "A" has been examined by the corporate authorities of this Village and that the same is substantially in accordance with the plan submitted at the public hearing in Cause No. 58-16 and on file with the Village of Mount Prospect; IT IS FURTHER RESOLVED, that the owners of said land, upon compliance with the applicable provisions of the Village of Mount Prospect Muni- cipal Code, Plan Ordinance, Zoning Ordinance and Building Code, may proceed to erect or cause to be erected a shopping center in accordance with Exhibit "A", provided all ordinances of this Vil- lage applicable thereto are complied with. o. .. j ~~ 'IiJ~1 ~ .
