DISSOLUTION OF SOLID WASTE COMMISSION

The Solid Waste Commission was first formed in 1989. Its original mission was to advise the Village
Board regarding ways to promote recycling efforts in the Community. Additionally, the Commission
reviewed and opined on staff recommendations regarding moving to exclusive residential, and later
exclusive commercial waste hauling franchises. The Commission was also instrumental in reviewing
vendor bid results and moving the Village toward a"toter" collection system.
Since the implementation of the above changes to the Village's Refuse & Recycling program, the
Commission has been largely inactive. It has been the long standing practice of the Village Board to
review, on a regular basis, the continued necessity of all appointed Boards and Commissions. It
appears at this time the Solid Waste Commission has successfully accomplished its stated mission.
The work of the Solid Waste Commission, over these past twenty one years, is a testament to
residents lending their expertise, insight and love of community to address important and timely
issues of the day. The Commission and its many memoors have largely accomplished the mission
they were tasked with and as such I am recommending dissolution of the Solid Waste Commission at
this time.
This recommendation in no way diminishes the stellar service the Commission members have
rendered to the Community; it simply recognizes the appropriate closure of this chapter in the
Village's evolution. Attached is a copy of my letter of notice and thanks to current Commission
members. I have received no objections to this recommendation.

Dear George:
This letter is to thank you for your many years of service to the Village of Mount Prospect Solid
Waste Commission. As you know the Commission has been inactive for the last few years.
Although it seemed to make ~sense to dissolve the Commission years ago, I delayed that
decision because I wanted to be certain there were no other tasks which could be assigned to a
Solid Waste Commission.
Unfortunately, I believe, at this time, the Commission's original mission has been accomplished.
This letter is intended to inform you that the Village Board will consider formal dissolution of the
Solid Waste Commission at the April 20, 2010 Village Board of Meeting. I wanted the
commission members to have a few weeks to digest this information, and to contact me about
anything in this letter.
The Solid Waste Commission was first formed in 1989; three of you commissioners have served
since its inception. In its current configuration, the responsibilities of the Solid Waste
Commission no longer serve the current needs of the Village. Throughout the years we often
look at the duties of the Commissions and whether they continue to serve a purpose. Some we
reconstitute; some we merge with others and others finally dissolve.
I do want to personally thank you for the many years you've served the community. Please
know that as long as there were tasks to undertake, the commission members were there in
both spirit and deed.
Thanks again for all you have done and for the many hours over the years you have given to the

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 5, ENTITLED,
"BOARDS AND COMMISSIONS"
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE
EXERCISE OF THEIR HOME RULE POWERS:
SECTION 1: Chapter 5, Article XI entitled "Solid Waste Commission" of the
Mount Prosp~ct Village Code shall be amended by deleting Article XI in its entirety and
reserving it.
SECTION 2: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by law.

SUBJECT: SURPLUS ITEMS AT EXISTING FIRE STATION #14
As we prepare to move into the new Fire Station #14 next week, arrangements are being
made to clear out the contents of the old building. While a few items such as physical
fitness equipment, cookware, and artwork will be utilized in the new station, the majority is
being replaced as part of the project. The Fire Department is seeking Village Board
approval to declare several items in the existing building as surplus.
Air Compressor
One of the items in the existing Fire Station #14 that is no longer needed is an air
compressor. Rather than send this item to auction, the Fire Department would like to sell it
to Mr. Eddie Figus for $750. In researching the current value of the compressor, we feel
this is a fair price, and is more than it would bring in at an auction. Mr. Figus is prepared to
present the Village with a check for the agreed upon price if it is deemed surplus.
Appliances & Furniture - Donation to Joseph Academy
The existing station also has multiple appliances and furniture items that are being
replaced. Rather than dispose of these items, the Fire Department would like Village
Board approval to donate many of them to Joseph Academy based in Des Plaines.
Joseph Academy is a special education organization whose mission is to "serve children
and adolescents with behavioral, emotional, and learning disorders by helping them
develop the social, academic, and vocational skills they need to function in society."
Students from all overthe Chicagoland area, ranging in age from 5 to 21, attend programs
through Joseph Academy in schools in Des Plaines, Melrose Park, and Hometown. The
items we are looking to donate would be utilized in the organization's "Life Skills Program,"
designed to prepare students for independent living.

The following is a list of items the Fire Department would like to donate based on a walk-
through of the building with staff from Joseph Academy:
· Kitchen Appliances - 2 refrigerators, range, dishwasher, and microwave
· Laundry Appliances - wash machine and dryer
· Outdoor - grill and picnic table
· Furniture - couch, 5 recliners, 2 end tables, TV stand, 5 mattresses with
frames, 2 desks, 5 office chairs, office cabinets, and 2 bulletin boards
The majority of these items no longer have any monetary value. The few items that do
would normally go to auction; however, we feel that the value in donating these items far
outweighs the funds we could receive from the sale. We are therefore requesting that the
Village Board approve this donation request to Joseph Academy.
Conclusion
The Fire Department is requesting Village Board approval to declare the air compressor
and above listed appliances and pieces of furniture as "surplus." This action would allow
the department to sell and/or donate these items, which are no longer needed. Staff will be
available to answer any questions regarding this request.

ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE DISPOSAL OF
CERTAIN PERSONAL PROPERTY
OWNED BY THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Corporate Authorities of the Village of Mount Prospect, Cook County, Illinois, have
determined that it is no longer necessary, useful or in the best interest of the Village of Mount Prospect to
retain ownership of an air compressor and certain appliances and furniture used at old Fire Station #14;
and
WHEREAS, it has been determined by the President and Board of Trustees of the Village of Mount
Prospect that the best interests of the Village would be served by the sale of the surplus air compressor
at fair market value; and
WHEREAS, it has been determined by the President and Board of Trustees that the best interests of the
Village and the children and adolescents of the Joseph Academy, "Life Skills Program" would be served
by the donation of certain appliances and furniture from old Fire Station #14.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR
HOME RULE POWERS:
SECTION ONE: The air compressor is no longer necessary or useful to the Village of Mount Prospect.
The best interests of the Village will be served by disposing of the property in the manner specified below.
SECTION TWO: The Fire Department air compressor will be sold for $750.00 to:

SUBJECT: RESERVATION OF PRIVATE ACTIVITY BOND VOLUM
PURPOSE:
To present for Village Board consideration an ordinance that would reserve f e
Village's 2010 private activity bond volume cap.
BACKGROUND:
The Internal Revenue Code allows state and local governments to issue tax-exempt
debt for the benefit of certain qualified private development projects. These projects
include the acquisition or construction of industrial facilities and apartments for low
and moderate-income families. The amount of such private activity debt issued in
2010 cannot exceed the equivalent of $90 per resident. The Village's private activity
bond volume cap is currently $4,799,970 (based on a population of 53,333 as
estimated by the U.S. Census Bureau).
DISCUSSION:
According to the regulations. any volume cap not reserved or committed by a
municipality by April 30th is automatically transferred to the State of Illinois. If a
community does not have any specific projects that would qualify for the tax exempt
financing, it can cede, or transfer, the volume cap to another community.
It has become common for municipalities to transfer their unused volume cap to
other municipalities in exchange for a fee if a demand exists. This has not been the
case though for several years. When a fee is provided in exchange for the volume
cap, the ultimate beneficiary of the tax-exempt financing is responsible for payment.
The amount of the fee paid depends upon the economy and the current interest rate
environment. The Village has in the past received between 1-2% for the sale of its
volume cap, most recently, the Village sold volume cap in 2006. For the past three
years volume cap was transferred to benefit the "Assist" first-time homebuyer
program administered through the City of Aurora.

The Village has a total of $4,799,970 of private activity bond volume cap it must
reseNe by April 30th or it will be transferred to the State of Illinois. The Village can
choose to hold onto the volume cap after it is reseNed until a project is identified.
The cap may also be carried over for up to three years depending on the type of
project being considered. There are currently no projects at this time placing a
request on the Village's volume cap.
RECOMMENDATION:
It is recommended the Village Board adopt the attached ordinance reseNing the
Village's private activity bond volume cap for 2010.

AN ORDINANCE RESERVING VOLUME CAP IN CONNECTION WITH
PRIV A TE ACTIVITY BOND ISSUES, AND RELATED MATTERS.
WHEREAS, the Village of Mount Prospect, Cook County, Illinois (the "Municipality "), is
a municipality and a home rule unit of government under Section 6 of Article VII of the 1970
Constitution of the State of Illinois; and
WHEREAS, Section 146 of the Internal Revenue Code of 1986, as amended (the "Code"),
provides that the Municipality has volume cap equal to $90.00 per resident of the Municipality in
each calendar year, which volume cap may be reserved and allocated to certain tax-exempt
private activity bonds; and
WHEREAS, the Illinois Private Activity Bond Allocation Act, 30 Illinois Compiled
Statutes 1998, 345/1 et seq., as supplemented and amended (the "Act "), provides that a home
rule unit of government may transfer its allocation of volume cap to any other home rule unit of
government, the State of Illinois or any agency thereof or any non-home rule unit of government;
and
WHEREAS, it is now deemed necessary and desirable by the Municipality to reserve all of
its volume cap allocation for calendar year 2010 to be applied toward the issuance of private
activity bonds (the "Bonds "), as provided in this Ordinance, or to be transferred, as permitted by
this Ordinance;
Now, THEREFORE, Be It Ordained by the President and the Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois, as follows:
SECTION 1. That, pursuant to Section 146 of the Code and the Act, the entire volume
cap of the Municipality for calendar year 2010 is hereby reserved by the Municipality, which
shall issue the Bonds using such volume cap, or shall use or transfer such volume cap, without
any further action required on the part of the Municipality, and the adoption of this Ordinance
shall be deemed to be an allocation of such volume cap to the issuance of the Bonds or such
other bonds; provided, that any such transfer shall be evidenced by a written instrument executed
by the Mayor or any other proper officer or employee of the Municipality.
SECTION 2. That the Municipality shall maintain a written record of this Ordinance in
its records during the term that the Bonds or any other such bonds to which such volume cap is
allocated remain outstanding.
SECTION 3. That the President, the Village Clerk and all other proper officers, officials,
agents and employees of the Municipality are hereby authorized, empowered and directed to do
all such acts and things and to execute all such documents and certificates as may be necessary
to further the purposes and intent of this Ordinance.
SECTION 4. That the provisions of this Ordinance are hereby declared to be separable,
and if any section, phrase or provision of this Ordinance shall for any reason be declared to be
invalid, such declaration shall not affect the remainder of the sections, phrases and provisions of
this Ordinance.
SECTION 5. That all ordinances, resolutions or orders, or parts thereof, in conflict
herewith are, to the extent of such conflict, hereby superseded; and that this Ordinance shall be
in full force and effect upon its adoption and approval.
