Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION October 16, 2001 The Closed Session was convened at 9:35 p.m. to discuss Property Sale, Personnel and Litigation. Present were: Mayor Gerald Farley and Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael Zade!. Staff present included: Village Manager Michael Janonis. The Closed Session was held in the Human Services Conference Room. Property Sale Village Manager Janonis shared with the Board an inquiry by an individual interested in purchasing the Village-owned parcel on the 200 block of South Emerson. The individual was interested in the possibility of constructing a single-family home. The consensus of the Village Board was to retain the property at this time for the purpose of facilitating either a larger development involving additional surrounding properties or for potential future downtown parking. Personnel The Village Manager requested the Village Board consider covering Police Chief Richard Eddington's relocation expenses up to a maximum of $25,000 net of income taxes. IRS regulations provide that relocation expenses involving a move of less than 30 miles are considered taxable income. At the time the Village Manager negotiated the Employment Agreement with Chief Eddington, neither party was aware of the IRS regulations. The Village Board indicated that they should honor the intent of the Employment Agreement and the reimbursement provisions and thereby authorized the Village Manager to cover Chief Eddington's relocation expenses on a net basis up to $25,000. Litiqation With regard to litigation, the Village Manager informed the Village Board that the Village had, within the last 24 hours, been served with a Federal Lawsuit naming the Village as well as a Police Officer as having effectuated a false arrest. The Lawsuit was claiming violation of civil rights and seeking appropriate compensatory and injunctive damages. The Village Manager reviewed with Board members the facts of the case as were known at that time. Village Attorney Everette Hill felt, based on first impressions, that the Officer had acted within his/her authority. The Village Board directed the Village Manager to keep Board members apprised of the status of the Lawsuit as things progressed. There was no other business discussed in Closed Session. On a Motion by Trustee Wilks and Seconded by Trustee Hoefert, the Closed Session adjourned at 9:55 p.m. No action was taken. MEJ/rcc
