Lowe MINUTES CLOSED SESSION MAY 4,1999 The meeting was convened at 10:03 p.m. Present were: Mayor Gerald Farley; Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Daniel Nocchi, Michaele Skowron and Irvana Wilks. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Community Development Director William Cooney. Land Acquisition Community Development Director Cooney provided a general overview of the preliminary plan for public parking behind the Busse Avenue businesses to accommodate 18 spaces as part of the Redevelopment Project. He stated the plan provides for employee parking for the Busse Avenue businesses and should address the overall-parking situation on Busse Avenue. He stated that there have been some discussions with Tod Curtis through the respective attorneys regarding the acquisition of the rear portion of his building. Consensus of the Village Board was to support filing of a Condemnation Suit for the back portion of the Tod Curtis building to accommodate the parking lot and the development under consideration. Fannie May Mr. Cooney stated that staff has approached Fannie May about considering exchanging the Fannie May property for the White Hen property. He stated research has shown that the Village cannot go after prior owners but the tanks have been removed even though the soil removes. Village Manager Janonis stated that the Village may ultimately have to incur the cost if no agreement is reached to ensure the reuse of the property. Mr. Cooney stated that Fannie May may look for assistance in the future at the White Hen site if no soil is disturbed as part of the redevelopment and can move into the White Hen today but not diminish the redevelopment possibilities in the future. Fannie May may consider going after the previous station owners to help mitigate the cost of clean up. 117 South Main Street Mr. Janonis stated that the owners have not responded and have been ordered to Court to respond. Mr. Janonis stated that he is planning to request a Closed Session prior to the regular Board meeting on May 18 to discuss litigation.
