Janonis ~iIIage of Mount Prospect v~~~; ~i~~~~K I:.~/ 100 South Emerson Stre~INu~~~t Prospect, Illinois 60056 CLOSED SESSION MARCH 24,1998 The Closed Session was called to order at 9:50 p.m., in the conference room of the Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing Litigation, Property Acquisition and Miscellaneous. Present at the Closed Session were: Mayor Gerald L. Farley; Trustees George Clowes, Paul Hoefert, Richard Lohrstorfer, Daniel Nocchi and Irvana Wilks. Absent from the Closed Session was Trustee Timothy Corcoran. Also present were: Village Manager Michael Janonis and Assistant Village Manager David Strahl. Consideration of Minutes from previous Closed Session was deferred in order to expedite the Closed Session. Property Acquisition Village Manager Michael Janonis indicated that staff was in receipt of the appraisal for Northwest Electric and that the appraised value was $1.5 million. Mr. Janonis indicated that staff had not received any of the previously requested information from Northwest Electric as to new site requirements or business expenses which they felt should be reimbursed. There was brief discussion among Board members and the consensus was not to release the Village's appraisal to Northwest Electric until some of the requested information was forthcoming. Mr. Janonis was directed to contact Northwest Electric and to again request the necessary information. Mr. Janonis also advised the Board that the property located at Three South Wille Gunk yard) was now listed with a realtor for $214,000. It was noted that the Village's previously appraisal was for $185,000. It was also noted that Phase I and Phase II Environmental Studies had indicated a low to moderate level of surface contamination on the site. Cost of clean-up would be dependent on the type of development eventually located on the property. After brief discussion, it was the consensus of the Village Board to reinitiate discussions with the owner. It was felt that given the likelihood of redevelopment activity, the value of the property would be driven up by speculators. The Village Board authorized the Village Manager to acquire the property in an amount not to exceed the appraised value. Litigation Mr. Janonis advised the Board members that conditions at Prospect Commons apartment complex were deteriorating. The Village was currently seeking an Administrative Warrant to get into some of the apartments. An attorney for the management company had written the Village threatening legal action based on discrimination and harassment. Mr. Janonis felt that the situation could deteriorate and would likely lead to increased chances of litigation. However, it was noted that this apartment complex was probably the most trouble-plagued in the Village and required immediate and intense attention from the Village. After brief discussion, Board members indicated that staff should continue to take a strong, but reasonable, approach to improving conditions at the apartment complex. Miscellaneous Mr. Janonis indicated that Village Attorney Buzz Hill was close to finalizing the Complaint to file Suit against the Pontarellis for breach of the Developer Agreement at Clocktower Place. Phase I site work was underway at the Two-Ten East Northwest Highway (Francek) properties. There was also brief discussion about the need to contact Norb Huecker regarding the availability of his property. There was no other business discussed in Closed Session. The Closed Session was adjourned by unanimous vote based on a Motion by Trustee Wilks and Seconded by Trustee Nocchi at 10:12 p.m. There was no other business undertaken by the Village Board and the regular Board meeting was adjourned at 10:14 p.m. Respectfully submitted, MICHAEL E.
