Illinois 60056 Phone: /U8 I 392-6000 Fax: 708 I 392-6022 TOO: 708 I 392-6064 CONFIDENTIAL MINUTES CLOSED SESSION JANUARY 16, 1996 The Closed Session was called to order at 8:35 p.m., in the second floor conference room of the Village Hall, 100 South Emerson Street, for the purpose of discussing Potential Litigation. Present at the Closed Session were: Mayor Gerald Farley; Trustees George Clowes, Richard Hendricks, Paul Hoefert, Michaele Skowron and Irvana Wilks. Absent from the Closed Session was Trustee Timothy Corcoran. Also present were: Village Manager Michael Janonis, Village Attorney Everette Hill and Assistant Village Manager David Strahl. Also in attendance at the Closed Session were members of the Mt. Prospect Park District Board of Commissioners who had prior to the Closed Session convened a Special Meeting of the Mt. Prospect Park District Board of Commissioners and had Moved to join the Village Board in Closed Session. Present from the Mt. Prospect Park District Board were: President Tom Reese and Commissioners Rosemary Argus, Bill Fisher, William Walters, Jim Graves, Ruth Bettenhausen and Bill Klicka. Also present were Park District staff Walter Cook, Steve Durlacher and Park District Attorney Tom Hoffman. A Motion was made by Trustee Wilks and Seconded by Trustee Hoefert to defer approval of previous Closed Session Minutes until after discussion with the Mt. Prospect Park District Board. Potential Litigation Mayor Farley welcomed members from the Mt. Prospect Park District Board and expressed appreciation on their willingness to discuss the Zoning status of the Pop S~lOp in an attempt to avoid litigation over same. Mayor Farley indicated that the Village's best interests were served through cooperation between the two government bodies. Mayor Farley indicated that the Village Board felt that it was extremely important that the Village's Zoning and Permit process be followed. Issues regarding drainage, flooding, parking and pedestrian access were important issues to the community. Finally, Mayor Farley indicated that the Village Board was not attempting to judge the actions of the Park District. They were simply concerned about maintaining the integrity of the process. Park Board President Thomas Reese indicated that he also felt it was imperative that the two entities work together cooperatively. He indicated that it was the intention of the Park District to submit appropriate applications for Rezoning the Pop Shop property. President Reese indicated that Park District staff had been directed to move forward on this matter as soon as practicable. Mayor Farley suggested that future differences might be resolved through the utilization of joint Village/Park sub-committees. There was brief discussion among Village and Park District Board members regarding the benefit of intergovernmental cooperation and the need to act in the best interest of the community. Trustee Hendricks indicated that based on the commitment by the Park District to submit for Rezoning, that he felt the issue at question had been resolved. He left the meeting at 8:55 p.m. Village Board and Park District Board members exchanged final comments and the Park District Board Moved out of Closed Session at 9:00 p.m. After the Park District Board had left the room, the Village Board reviewed the Minutes of the December 5, 1995 Closed Session. Village Manager Mike Janonis provided a brief update on some of the items contained in those Minutes. On a Motion by Trustee Wilks and Seconded by Trustee Hoefert, the Minutes of the December 5, 1995 Closed Session were Approved following a roll call of Mayor Gerald Farley, Trustees George Clowes, Paul Hoefert, Michaele Skowron and Irvana Wilks. Trustees Corcoran and Hendricks were absent for the vote. Trustee Skowron made a Motion and Trustee Wilks Seconded the Motion to adjourn the Closed Session. Upon roll call of Mayor Gerald Farley; Trustees George Clowes, Paul Hoefert, Michaele Skowron and Irvana Wilks, the Closed Session adjourned at 9: 13 p.m. The regular meeting of the Village Board was adjourned at 9:15 p.m. without any other action.
